PC RES 2003-054P.C. RESOLUTION NO. 2003-54 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CASE NO. ZON2003-00205 (CONDITIONAL USE PERMIT REVISION), REVISING THE PARKING LOT LIGHTING PLAN AT 5845 CRESTRIDGE ROAD (CHURCH OF JESUS CHRIST OF LATTER DAY SAINTS). WHEREAS, on November 8,1977, Conditional Use Permit No. 30 and Variance No. 15 were approved, and a Negative Declaration was certified by the Planning Commission for the construction of a religious facility, and, WHEREAS, on December 8, 1987, Conditional Use Permit No. 128 was approved, and a Negative Declaration was certified by the Planning Commission, for the installation of outdoor lighting to the rear parking lot area of the property; and, WHEREAS, on April 23, 2003, Shirl Cornwell, representing Church of Jesus Christ of Latter Day Saints, submitted Case No ZON2003-00205, an application for a revision to a Conditional Use Permit to allow a revision to the lighting plan for the church facility located at 5845 Crestridge Road, and, WHEREAS, on May 20, 2003, the application was deemed incomplete by Staff pending the submittal of additional information and applications, and, WHEREAS, on June 26, 2003, upon submittal of an Environmental Assessment application, the project was deemed complete by Staff, and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et seq , the City's Local CEQA Guidelines, and Government Code Section 65962 5(f) (Hazardous Waste and Substances Statement), the City of Rancho Palos Verdes prepared an Initial Study and determined that with appropriate mitigation, there is no substantial evidence that the approval of ZON2003- 00205 would result in a significant adverse effect upon the environment and, therefore, a Mitigated Negative Declaration has been prepared and notice of same was given in the manner required by law; and, WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on October 28, 2003, at which time the Planning Commission continued the item to November 11, 2003; and, WHEREAS, on November 3, 2003, the applicant submitted revised plans with minor modifications to the October 28th proposal, and, P.C. Resolution No. 2003-54 Page 1 WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on November 11, 2003, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: The site for the intended use is adequate in size and shape to accommodate said use because it has been found that although some light standards will be increased in height, conditions have been incorporated to ensure that spillover of light and glare will be minimized. Further, the revised lighting plan will not alter the physical parking lot area or the religious facility since the changes are to the light standards only. Section 2: The site for the proposed use relates to streets and highways properly designed to carry the type and quantity of traffic generated by the subject use because Crestridge Road has provided access to the subject site, and other similar institutional uses along Crestridge Road for a number of years. There is no evidence that Crestridge Road has operated at a deficient level of service, and the revision to the Church's lighting plan will not impact any traffic demands to the site. Section 3: There will be no significant adverse effect on adjacent property or the permitted use because mitigation measures have been incorporated that reduces the potential impacts of light and glare, therefore, there will be no significant adverse affects to adjacent property resulting from the revised lighting plan. Section 4: The proposed use is not contrary to the General Plan because, as proposed and conditioned, the project implements goals and policies of the General Plan to "...the City to review the location and site design of future institutional uses very carefully to ensure their compatibility with adjacent sites" (page 93). The proposed project will not change the existing overall land use for the site, which would be subordinate to the primary use of the property as a religious facility. Section 5: The site is not within any of the overlay control districts, so there is no need to ensure that the proposed use complies with the requirements of the chapter Section 6: Conditions have been imposed to protect the health, safety and general welfare, which includes setback and buffers, fencing, landscaping, maintenance of structures, and other conditions, as identified in Exhibit "B" hereto. Section 7: Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council Pursuant to Chapter 17.80 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing and with the appropriate appeal fee, no later than fifteen (15) days following November 11, 2003, the date of the Planning Commission's final action P.C. Resolution No. 2003-54 Page 2 Section 8: For the foregoing reasons and based on information and findings contained in the Staff Reports, minutes, and records of the proceedings, the Planning Commission hereby approves Case No. ZON2003-00205 for a Conditional Use Permit Revision, subject to the conditions of approval contained in the attached Exhibit "B", attached hereto and made a part hereof, which are necessary to protect the public health, safety, and welfare. Resolution No 2003-54 Page 3 � eta Exhibit "B" Conditions of Approval Case No. ZON2003-00205 (Conditional Use Permit) Prior to any improvements, construction or grading, the applicant and/or property owner shall submit to the City a statement, in writing, that they have read, understand and agree to all conditions of approval contained in this approval. Failure to provide said written statement within ninety (90) days following the date of this approval shall render this approval null and void. 2. Approval of Case No ZON2003-00205 (Conditional Use Permit revision) allows for a revision to the existing parking lot lighting plan. Specifically, of the 13 existing 7 - foot -tall light standards on the slope along the length of the northern property line of the parking lot, the 2 standards to the northwest of the church building will be removed and will not be replaced, 5 standards will be replaced with new taller light standards and the two to the northeast of the church building will not be modified. In the remaining portion of the parking lot, 5 new additional 15 -foot tall light standards will be installed and the remaining existing lighting will not be modified, as illustrated in the approved plans. 3 The new light standards on the slope along the northern property line shall be limited to a maximum height of 15 -feet, as measured from the grade elevation of the parking lot surface adjacent to the light standard to the top of the light standard, or no taller than the top of the existing northern property line wall, whichever is lower HEIGHT CERTIFICATION OF THE LIGHT STANDARDS BY A REGISTERED CIVIL ENGINEER SHALL BE SUBMITTED TO THE PLANNING DEPARTMENT PRIOR TO BUILDING PERMIT FINAL. 4. The maximum wattage per light standard shall be limited to 150 watts. 5. For the four 7 -foot -tall light standards immediately behind the church building that will remain, the maximum wattage per light standard shall be limited to a maximum of 70 watts. 6. The four 7 -foot -tall light standards immediately behind the church building that will remain shall be used for security lighting purposes only, and shall be on a separate timer and on a separate means of disconnect. Said security lighting shall be permitted to remain on until no later than 2.00 am. 7 Prior to the installation of any new light fixture, an updated photometric plan shall be submitted to the Director of Planning, Building and Code Enforcement. The plan shall illustrate the specific light fixture type proposed to be installed, and how it will shield and diffuse the light source so that light spillover onto adjacent property is eliminated. Subject to the satisfaction of Staff and prior to final building and/or electrical permits, each light fixture shall be inspected to ensure that each light Resolution No2003-54 Page 4 fixture is consistent with the light fixture that was illustrated and assessed on the photometric plan. 8 The project shall be reviewed by the Planning Commission three (3) months from Building and Safety permit final of the new lighting standards, to review the applicant's compliance with the conditions of approval. At that time, the Planning Commission may add, delete, or modify the conditions of approval as deemed necessary and appropriate. Notice of said review hearing shall be published and provided to owners of property within a 500' radius, to persons requesting notice, to all affected homeowners associations, and to the property owner in accordance with Rancho Palos Verdes Development Code Section 17 80 090. 9 The new rear parking lot lighting on the slope along the length of the northern property line shall be on independent means of disconnect, so that the rear parking lot lighting can be used independently from the remaining lights of the parking lot and building Further, all lights shall beset to turnoff according to "Luminaire Timer Settings" on the approved plans. 10. The parking lot lights are allowed to remain on during the following days and times: Sundays, until 9*30 pm Monday —Thursday, until 10:00 pm Friday — Saturday, until 11:00 pm The four existing 7 -foot -tall light standards behind the church building that will remain, shall be turned on after the times specified above and shall be turned off no later than 2:00 am 11 The new 15 -foot -tall light standards in the rear parking lot on the slope along the length of the northern property line shall only be turned on when the facility is in use after dark. Only the entry lights, front parking lot lights, and the four 7 -foot -tall light standards immediately behind the church building shall be permitted to remain on until 2 00 am for security lighting purposes. 12. The existing trees, hedges and landscaping along the slope along the length of the northern property line shall be maintained at a height that is not lower than the top of the new light fixtures. 13. All other conditions of approval for Conditional Use Permit No. 128 (PC Resolution No. 87-75) that were not modified by this revision shall remain in full force and effect. 14. The color and material of the new light standards shall be consistent and compatible with the existing and remaining light standards P C Resolution No 2003-54 Page 5 15. Failure to comply with and adhere to all of these conditions of approval may be cause to revoke the approval of the project by the Planning Commission after conducting a public hearing on the matter. 16 If the revision has not been established (i.e., constructed) within one year of the approval of this permit by the Planning Commission, the approval shall become null and void, unless a written request for extension is filed with the Department of Planning, Building and Code Enforcement and approved by the Planning Commission Otherwise, a conditional use permit revision must be approved prior to further development 17. In the event that any of these conditions conflict with the recommendations and/or requirements of another permitting agency or City department, the stricter shall apply 18. The hours of construction shall be limited to 7:00 a.m. to 7:00 p.m., Monday through Saturday. No construction shall be permitted on Sundays or on legal holidays. 19. The applicant shall obtain all required permits, including demolition permits, from the appropriate public agencies. 20 The Director of Planning, Building and Code Enforcement is authorized to make minor modifications to the approved plans or any of the conditions if such modifications shall achieve substantially the same results as would strict compliance with said plans and conditions.
