A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 181
AND GRADING NO. 1030 AT 2255 SPARTA DRIVE .
WHEREAS , Marc and Robin Mittleman have requested a Variance
and Grading Permit to allow existing downslope retaining walls in
excess of 3 ' 6" and two ( 2 ) decks in an extreme slope at 2255
Sparta Drive; and
WHEREAS, after notice pursuant to the City' s Development Code
a public hearing was held on November 10 , 1987, at which time all
interested parties were given an opportunity to be heard and
present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions that exist relative to this property
which do not apply generally to other properties in the same
district in that the Flood Hazard Boundary Line is at the top of
the slope of the canyon, grading is minimal and such slope
improvements as modified do not adversely affect existing slope
nor do they promote flood hazards .
Section 2 : That such Variance is necessary for the
preservation and enjoyment of a substantial property right of the
applicant which right is possessed by others under like
circumstances in the same zoning district since other property
owners in the same residential district can have similar
improvements with an Extreme Slope Permit.
Section 3 : That the granting of such a Variance would not
result in adverse effects to the public welfare or the surrounding
development patterns as the modified retaining walls, the
remaining deck and the deleted concrete path segment will not
result in view impairment, visual impact, slope instability or
increased runoff.
Section 4 : That the granting of such a Variance will not be
contrary to the objectives of the General Plan in that said
project as modified would be consistent with the Natural or Urban
Overlay District.
Section 5 : That the site cannot reasonably accommodate the
structure in another location involving an extreme slope .

Section 6 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby approved
Variance No. 181 and Grading No. 1030 , subject to the conditions
in Exhibit "A" .
APPROVED and ADOPTED this 24th day of November, 1987 .

EXHIBIT "A"
VARIANCE NO. 181 AND GRADING NO. 1030
CONDITIONS OF APPROVAL
1 . Only one downslope retaining wall shall be permitted to equal
a height of 3 ' 6" . All other walls shall not exceed a height
of 30 inches. To accommodate this provision, the lowering of
wall heights and/or earth berming is acceptable . A revised
grading and slope treatment plan shall be submitted and
approved by the Department of Environmental Services .
2 . Deck #2 shall be removed.
3 . The owners shall remove the lowest, vertical path that links
the lowest horizontal path to the canyon bottom.
4 . Where such removal of improvements is required, the owner
shall replant the area with natural vegetation species of the
canyon. A landscape plan for these areas shall be approved.
5 . The owner shall provide hand rails for those portions of
access paths that require such handrails under the Los
Angeles County Building Code.
6 . The existing irrigation system shall be replaced with an
irrigation system approved by the Director of Environmental
Services .
7 . The owner shall submit soils and hydrology reports reviewing
impacts caused from such improvements and any such mitigation
measures or recommendations shall be complied with.
8 . All remaining and revised improvements in this slope area
shall be stained to blend with the dark brown railroad ties .
9 . The owner shall obtain applicable building permits for all
work within this slope area .
10 . A deed restriction shall be recorded on the property that
prohibits any further improvements to occur in the slope area
as defined as below the edge of the existing leveled back
yard.
11 . Commencement of these conditions shall begin no later than 60
days from the date of this approval, with completion no
longer than one year , unless an extension is approved by the
Director of Environmental Services .
