RESOLUTION NO. 2000- 22 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 190 REVISION "All TO ALLOW TWO WALL MOUNTED ANTENNA PANELS ON THE EASTERN SIDE OF THE EXISTING MAUSOLEUM, AND A CONCRETE PAD FOR A FUTURE BASE TRANSCEIVER UNIT (BTS) AT THE GREEN HILLS MEMORIAL CEMETERY AT 27501 S. WESTERN AVENUE. WHEREAS, on May 8, 2000, Pacific Bell Wireless submitted a revision to Conditional Use Permit No. 190 (Revision "A") to install two wall mounted antenna panels on the eastern side of the existing mausoleum building, and a concrete pad (3' X 5') that will be located on the ground level for a future base transceiver unit (BTS). The concrete pad will be located adjacent to the mausoleum at the property located at 27501 S. Western Avenue; and, WHEREAS, on June 7, 2000 the application was deemed complete, and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Section 21000 et.seq. ("CEQA"), the State's CEQA Guidelines, and Government Code Section 65962.5(f) (Hazardous Waste and Substances Statement), Staff found no evidence that the proposed project would have a significant effect on the environment in terms of risk to human health and aesthetics and, therefore the proposed project has been found to be categorically exempt (Class 1, Section15301), and, WHEREAS, after notices issued pursuant to the requirements of Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on July 25, 2000, at which all interested parties were given the opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS Section 1: The site is adequate in size and shape to accommodate the two wall mounted antenna panels along with the associated equipment boxes, and a 3'x 5' concrete pad for a future base transceiver unit (BTS) area since 1) the subject property is 4,845,000 square feet in size, 2) the proposed antenna panels will be located within an area that is already developed, and 3) the antenna panels will be attached to the wall of the existing mausoleum. Additionally, the antenna panels and the concrete pad will be located approximately 161' feet from the nearest single family residential area, therefore the placement of the antenna panels and the concrete pad for a future base transceiver unit would not alter or interfere with the existing use of the site as a cemetery. Section 2: The streets and highways serving the site are properly designed to carry the type and quantity of traffic generated by the proposed use since the subject property is located on Western Avenue, which has been identified in the General Plan as a major arterial roadway. Further, the occasional trips made by maintenance vehicles will not increase the vehicular traffic trips to and from the site Therefore, the granting of the project will not result in any measurable change to the existing level of service on Western Avenue Section 3: Granting the revision to the Conditional Use Permit for the proposed wall mounted antenna panels would not create a significant adverse effect on the adjacent property since the existing mausoleum is located in the northeast corner of the cemetery and is surrounded by landscaping, and mature trees. Although, this mausoleum is partially visible from Western Avenue, the proposed antenna and future base transceiver unit equipment will not be visible from this roadway since the color of the antenna panels will blend with the existing structure, and the equipment will be screened with foliages Further, due to the significant distance from the property lines, the project will not create an adverse visual impact. Therefore, the granting of the revision to the Conditional Use Permit would not create an adverse impacts including, light, glare, or noise that will result from the proposed project. Section 4: The proposed use is not contrary to the General Plan since the subject site is designated as Cemetery The proposed project would not change the overall land use of the site and would not create an adverse impact to the surrounding properties Section 5: The proposed project is not subject to comply with the applicable overlay control district requirements since subject property is not located within an overlay control district Section 6: Granting the revision to the Conditional Use Permit for the proposed wall mounted antenna panels will provide the necessary safeguards to protect the health, safety, and general welfare since the proposed antenna panels would comply with the required setbacks and would not exceed the maximum ridgeline height of 24'9". Section 7: The proposed project is consistent with all of the City's wireless communication antenna development guidelines P.C. Resolution No. 2000-22 Page 2 of 3 Section 8: Any interested person may appeal this decision or any portion of this decision to the City Council. Pursuant to Section 17.80.070 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, In writing, and with the appropriate appeal fee, no later than fifteen (15) days, following the date of the Planning Commission's final action. 11111action 21 For the foregoing reasons and based on the information and findings Included In the Staff Report, Minutes and other record of proceeding, the Planning Commission of the City of Rancho Palos Verdes hereby approves Conditional Use Permit No. 190 Revision "A" for the approval of two wall mounted antenn@ ponels on the eastern aide of the existing mausoleum, and a concrete pad for a future base transceiver unit (STS), subject to the conditions contained in Exhibit "A", attached hereto and made a part hereof, which are necessary to protect the public health, safety and welfare In the area. Prior to the submittal of plans into Building and Safety "plan check", the applicant shall submit to the City a statement, that they have read, understand and agree to all the conditions of approval contained herein. Failure to provide said written statement within ninety (90) days of approval shall render this approval null and void. 2 The approval shall be null and void after one (1) year from the date of approval unless the approved plans are submitted to the Budding and Safety Division to initiate the "plan check" review process, pursuant to Section 17.86.070 of the City's Development Code This approval shall become null and void after initiating the "plan check" review process, or receiving a building permit to begin construction, said "plan check" or permit is allowed to expire or is withdrawn by the applicant. 3 The Director of Planning, Building and Code Enforcement is authorized to make minor modifications to the approved preliminary plans or any of the conditions if such modifications shall achieve substantially the same results as would strict compliance with said plans and conditions. 4 The abandonment or non-use of this approval after a period of one (1) year shall terminate the approval and any privileges granted hereunder shall become null and void 5. The project shall substantially conform to the stamped approved plans dated the effective date of this approval CONDITIONAL USE PERMIT 6 The two antenna panels and equipment boxes shall be mounted on the eastern side of the existing mausoleum building which is located at the northeast portion of the property. All panels and boxes shall be painted the same color as the existing building fagade and no portion of the panels or boxes shall exceed the existing ridgeline of the mausoleum 7 The proposed concrete pad for the future placement of a base transceiver unit (BTS) shall not exceed 15 square feet in area (3' x 5') The pad shall be located at the northern side of the mausoleum. Prior to installation of the base transceiver unit (BTS), the applicant must obtain proper permits and approval from the city's planning, and building and safety divisions. However, the applicant will not be required to apply for a revision to this permit for the equipment. Upon approval of the future equipment, additional conditions may be placed on the equipment area such as: screening, height, foliage type, etc. 9. In the event that these conditions are in conflict with any Building and Safety Division code requirement, the stricter standard shall apply. 10. The hours of construction shall be limited to 7:00 a.m. to 7:00 p.m., Monday through Saturday. No construction shall be permitted on Sunday or any legal holidays. 11. The construction site shall be kept free of all loose material resembling trash debris in excess of that material used for immediate construction purpose. Such excess material may include, but not limited to: accumulation of debris, garbage, lumber, scrap metal, concrete, asphalt, piles of earth, salvaged materials, abandoned or discarded furniture, appliances, or other household fixtures.
