RESOLUTION NO. 99-19 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING WITHOUT PREJUDICE HEIGHT VARIATION NO. 879 FOR AN ENLARGEMENT TO AN EXISTING DETACHED TWO -CAR GARAGE BY 85 SQUARE FEET AND CONSTRUCTION OF A 425 SQUARE FOOT SECOND STORY ADDITION OVER THE EXISTING DETACHED GARAGE AT A 20 -FOOT HEIGHT, ON PROPERTY LOCATED AT 7361 BERRY HILL DRIVE. WHEREAS, on February 10, 1999, the applicant, Olympia Greer representing property owners Brent Meyer and Nancy Parsons, submitted Height Variation No 879, requesting approval for the construction of a 425 square foot second story addition over the exiting detached garage, at a height of 20 -feet above adjacent grade for property located at 7361 Berry Hill Drive, and, WHEREAS, on March 2, 1999, the application was deemed incomplete the resolution of issues raised by Staff regarding exterior stairs, and, WHEREAS, upon submittal of the necessary information and the verification of the temporary frame silhouette, Staff deemed the applications generally complete for processing on April 6, 1999; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. (" CEQA" ), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et seq , the City's Local CEQA Guidelines, and Government Code Section 65962 5(f) (Hazardous Waste and Substances Statement), Staff found no evidence that Height Variation No 879 and Site Plan Review No. 8439 would have a significant effect on the environment and, therefore, the proposed project has been found to be categorically exempt under Class 1 (Section 15301) since the project involves the alteration to an existing structure, and, WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on May 25, 1999, at which time all interested parties were given an opportunity to be heard and present evidence, NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS Section 1: The applicant has complied with the Early Neighborhood Consultation process established by the City by obtaining acknowledgement signatures from eighty percent (80%) of the property owners within 500 feet of the subject property. Section 2: The proposed second -story addition over the existing detached garage is not compatible with the immediate neighborhood character for the following reasons A The proposed 20 foot high second story addition, at 21 feet from the front property line, in front of a 16 -foot high one-story residence, will result in the domination of the two- story structure as viewed from the street B The portion of the structure that exceeds 16 -feet in height (the second story) does not comply with the front setback guideline of 25 -feet, as evidenced by the 21 -foot setback C. The two-story structure does not contain front fagade articulation, as there is no offset between the first and second story fagades along the street, and results in a bulky and massive structure at the front of the property D There are no examples in the neighborhood where a detached garage at the front of the property contains a second story Further, existing two-story residence is sufficiently setback from the street and does not result in a domineering structure as viewed from the street Section 3: Any interested person may appeal this decision or any portion of this decision to the City Council Pursuant to Section 17 02 040 C 1.j of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the appropriate appeal fee, no later than fifteen (15) days following the date of the Planning Commission's final action. Section 4: For the foregoing reasons, and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby denies without prejudice Height Variation No 879 for an 85 square foot expansion to the existing detached garage and construction of a 425 square foot second story addition over the exiting detached garage, at a height of 20 -feet above adjacent grade and 21 -feet from the front property line P C Resolution No 99-19 Page 2 of 3 . . • PASSED, APPROVED, AND ADOPTED this 25th day of May 1999, by the following vote: AYES: Alberio, Cartwright, Paris, Slayden NOES: None ABSTENTIONS: None ABSENT: Clark, Lyon, Vannorsdall on S.
