RESOLUTION NO. 99-07 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING WITHOUT PREJUDICE TENTATIVE PARCEL MAP NO. 25271 FOR THE SUBDIVISION OF A 29.40 -ACRE SITE INTO TWO (2) PARCELS, LOCATED AT THE NORTHWEST CORNER OF CRENSHAW BOULEVARD AND CRESTRIDGE ROAD WHEREAS, on August 11, 1998, the applicant, Palos Verdes Portuguese Bend Company, submitted applications for Tentative Parcel Map No 25271 and Environmental Assessment No 703 to allow the subdivision of a vacant, 29 40 -acre site into three (3) parcels for financing and conveyance purposes, and, WHEREAS, on November 18, 1998, the applications for Tentative Parcel Map No 25271 and Environmental Assessment No 703 were deemed complete by Staff; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines, California Code of Regulations, Title 14, Section 15000 et. seq , the City's Local CEQA Guidelines, and Government Code Section 65962 5(f) (Hazardous Waste and Substances Statement), the City of Rancho Palos Verdes prepared an Initial Study and determined that there is no substantial evidence that Tentative Parcel Map No 25271 would result in a significant adverse effect upon the environment and, therefore, a Negative Declaration has been prepared and notice of same was given in the manner required by law, and, WHEREAS, on February 18, 1999, the applicant amended the proposed map to subdivide the 29.40 -acre site into two (2) parcels; and, WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code and the State CEQA Guidelines, the Planning Commission held a duly noticed public hearing on January 26, February 9, February 23, and March 9, 1999, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS Section 1: The proposed map is not consistent with the Rancho Palos Verdes General Plan for the following reasons. A The 1988 soils/geology report provided by the applicant is not acceptable for the proposed subdivision because it only addresses the suitability of a small portion of Parcel 2 for future development, and does not reflect changed soils and geologic conditions on and adjacent to the project site Although the report was previously ,-e: Z; 1= - . 0 0 approved in 1988, it fails to take into consideration the recent landslide that occurred dust to the north of the site last year, which resulted in the destruction of office buildings in the City of Rolling Hills Estates. In addition, the report only addresses that portion of Parcel 2 located at the corner of Crenshaw Boulevard and Crestridge Road It fails to address the remainder of Parcel 2 or any of Parcel 1 This is inconsistent with the provisions of Sections 16 04 040 and 16.20.120 of the Rancho Palos Verdes Development Code, which require the approval of such reports as a precondition of the approval of a tentative parcel map Similarly, it is inconsistent with the standards of Resource Management District 2 (Extreme Slope) of the General Plan which require a "[detailed] engineering/geologic study [to] accompany any proposal for development or use " B Institutionally -zoned land allows for a wide range of intensity and use and has few development standards other than building setback and height, and the requirement for a conditional use permit for most development. As such, the adequacy of the size and configuration of the proposed parcels cannot be fully assessed without specific development proposals. In addition, the approval of the proposed map would create two institutionally -zoned parcels on Crestridge Road where only one exists today, which could lead to adverse environmental impacts that cannot be anticipated at this time. This is inconsistent with Institutional Activity Policy No 6 of the General Plan, which requires the City to "[review] the location and site design of future institutional uses very carefully to ensure their compatibility with adjacent sites " Section 2: The Negative Declaration that was prepared by Staff, in conjunction with Tentative Parcel Map No 25271, is not adopted by the Planning Commission because the Planning Commission finds that further geologic studies are warranted due to recent landslide activity in the area located to the immediate north of the site and which could lead to adverse environmental impacts that cannot be anticipated at this time Section 3: Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council Pursuant to Section 17 80 030 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the appropriate appeal fee, no later than fifteen (15) days following March 9, 1999, the date of the Planning Commission's final action Section 4: For the foregoing reasons and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby denies without prejudice Tentative Parcel Map No. 25271, thereby denying the subdivision of a 29 40 -acre site into two (2) parcels, located at the northwest corner of Crenshaw Boulevard and Crestridge Road P.C.
