A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING SITE
PLAN REVIEW NO. 8417, ALLOWING THE
CONSTRUCTION OF A 288 SQUARE FOOT ADDITION TO
AN EXISTING 2,925 SQUARE FOOT, TWO-STORY,
SINGLE-FAMILY RESIDENCE. THE ADDITION WILL
CONSIST OF 273 SQUARE FEET ON THE FIRST FLOOR
AND A 15 SQUARE FOOT BAY WINDOW ON THE SECOND
FLOOR, AT A HEIGHT OF 17'-6", ON PROPERTY
LOCATED AT 6012 SANDBROOK DRIVE.
WHEREAS, on December 18, 1998, the landowner's (Sharon Yerber)
representative, Sue Van Every, submitted Site Plan Review No 8417, requesting approval
to allow for the construction of a two-story addition totaling 288 square foot to an existing
2,925 square foot, two-story, single-family residence, at a proposed height of 17'-6" from
finished grade, on property located at 6012 Sandbrook Drive, and,
WHEREAS, on January 13, 1999, Site Plan Review No 8417 was deemed
complete by Staff; and,
WHEREAS, pursuant to the provisions of the California Environmental Quality Act,
Public Resources Code Sections 21000 et seq ("CEQA"), the State's CEQA Guidelines,
California Code of Regulation, Title 14, Section 15000 et. seq , the City's Local CEQA
Guidelines, and Government Code Section 65962 5(f) (Hazardous Waste and Substances
Statement), Staff determined that Site Plan Review No 8417 will not have a significant
effect on the environment and, therefore, the proposed project has been found to be
categorically exempt under Class 1 (Section 15301) since the site is developed with a
single-family residence and the project involves the construction of an addition that will not
significantly disturb the site, and,
WHEREAS, on January 20, 1999, a public notice was sent to all property owners
immediately adjacent to the subject property, including those across the right-of-way,
informing residents of the proposed development; and,
WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos
Verdes Development Code, the Planning Commission held a duly noticed public hearing
on February 9, 1999, at which time all interested parties were given an opportunity to be
heard and present evidence,
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS
Section 1: The proposed addition will be constructed in conformance with the
criteria contained in the 1994 Uniform Building Code
Section 2: The proposed two-story addition to an existing single-family residence
does not significantly impair a view from adjacent properties to the north, south, east and
west of the subject property in that the proposed addition is not located in a viewing area
and is located below the existing roof ridge line.
Section 3: Any interested person may appeal this decision or any portion of this
decision to the City Council Pursuant to Section 17.02.040(C)(1)(j) of the Rancho Palos
Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with
the appropriate appeal fee, no later than fifteen (15) days following the date of the
Planning Commission's final action
Section 4: For the foregoing reasons, and based on the information and findings
included in the Staff Report, Minutes and other records of proceedings, the Planning
Commission of the City of Rancho Palos Verdes hereby approves Site Plan Review No.
8417, hereby approving the construction of a 288 square foot addition to an existing 2,925
square foot, two-story, single-family residence Of the 288 square feet, 273 square feet
will be added to the first floor and a 15 square foot bay window will be added to the second
story, at a proposed height of 17'-6" Furthermore, a new covered entry porch will be
constructed at a height of 15'-6", as well as, the removal and replacement of existing doors
and windows and the reconfiguration of some nonbearing interior walls, on property
located at 6012 Sandbrook Drive, subject to the conditions set forth in Exhibit A, attached
hereto and made a part hereof, which are necessary to protect the public health, safety
and welfare in the area

EXHIBIT'A'
CONDITIONS OF APPROVAL
SITE PLAN REVIEW NO. 8417
Prior to the submittal of plans into Building and Safety plan check, the applicant
and/or property owner shall submit to the City a statement, in writing, that they have
read, understand and agree to all conditions of approval contained in this approval
Failure to provide said written statement within ninety (90) days following the date
of this approval shall render this approval null and void
2 The approval shall becomes null and void after 180 days from the date of approval
unless the approved plans are submitted to the Building and Safety Division to
initiate the "plan check" review process
3 The proposed project shall be constructed in substantial compliance with the plans
dated and received by the Planning Department on December 18, 1998
4 The Director of Planning, Building and Code Enforcement is authorized to make
minor modifications to the approved plans or any of the conditions if such
modifications achieve substantially the same results as would strict compliance with
said plans and conditions
5 The abandonment or non-use of this approval after a period of six months shall
terminate the approval and any privileges granted hereto shall become null and
void
6 The following minimum setbacks shall be maintained
Front yard 20'-0" minimum (proposed 20'-6" minimum)
Side yard 5'-0" minimum each side (proposed 8')
Rear yard 15'-0" minimum (proposed 30' minimum)
7 The proposed addition shall not exceed 288 square feet, of which 273 square feet
shall be located on the first floor and 15 square feet shall be added to the second
floor as a bay window
8 The maximum structure size for the subject property shall not exceed 4,666 square
feet. The proposed total structure size is 3,978 square feet (garage included)
9 The proposed bay window on the second floor shall not extend in height beyond the
existing roof eave and shall not exceed a height of 17'-6" as measured from the
highest point of existing (preconstruction) grade to be covered by the structure
10 The first floor addition of 273 square feet shall not exceed 11'-6" as measured from
the highest point of existing (preconstruction) grade to be covered by the structure
11. The new covered entry shall not exceed 15'-6" in height
12 This approval shall permit the removal and replacement of existing windows and
doors with similar sized windows and doors.
13 This approval shall permit the reconfiguration of nonbearing interior walls
14. No grading shall be permitted (excluding foundation excavation)
15. A dump deposit receipt shall be submitted to the Building and Safety Division for
the exported earth materials prior to final inspection of the project
16. The open space requirement for the subject property located in the RS -5 zoning
district shall be no less than forty-eight (48%) The proposed open space is 74%
17. A maximum of fifty (50%) percent lot coverage shall be allowed within the required
20 -foot front yard setback area
18 The property shall be temporarily enclosed with a six (6-0") foot high chain-link
fence during the length of construction of the addition
19 In the event that a Planning requirement and a Building & Safety requirement are
in conflict with one another, the stricter standard shall apply
20. The hours of construction shall be limited to 7.00 a m to 7 00 p m , Monday through
Saturday No construction shall be permitted on Sundays or on legal holidays.
21 The construction site shall be kept free of all loose materials resembling trash and
debris in excess of that material used for immediate construction purposes. Such
excess material may include, but is not limited to, the accumulation of debris,
garbage, lumber, scrap metal, concrete, asphalt, piles of earth, salvage materials,
abandoned or discarded furniture, appliances or other household fixtures
