A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING SITE PLAN REVIEW
NO. 8311, GRADING PERMIT NO. 2048 AND SIGN PERMIT NO. 961
THEREBY APPROVING DEMOLITION OF THE EXISTING 1,400
SQUARE FOOT CANOPY AND CONSTRUCTION OF A NEW 1,898
SQUARE FOOT CANOPY, A TOTAL OF 950 CUBIC YARDS OF
GRADING FOR THE TWO UNDERGROUND STORAGE TANKS,
AND INSTALLATION OF FOUR ILLUMINATED SIGNS ON THE
CANOPY FACIA, LOCATED AT 27774 HAWTHORNE BOULEVARD.
WHEREAS, on July 16, 1998, the applicant, Mr & Mrs Shiraz Govani submitted
an application for Site Plan Review No 8311, Grading Permit No 2048 and Sign Permit
No 961 to construct a new 23'0" high canopy on the subject lot located at 27774
Hawthorne Boulevard, 950 cubic yards of grading for two underground storage tanks,
replacing three exisitng tanks, and four illuminated signs on the canopy facia, and,
WHEREAS, on August 10, 1998 the application package was deemed complete,
and
WHEREAS, pursuant to the provisions of California Environmental Quality Act,
Public Resources Code Section 21000 et.seq ("CEQA"), the State's CEQA Guidelines,
California Code of Regulation, Title 14, Section 15000 et.seq , the City's Local CEQA
Guidelines, and Government Code Section 65962 5(F) (Hazardous Waste and Substances
Statement), Staff found no evidence that Site Plan Review No 8311 would have a
significant effect on the environment and, therefore the proposed project has been found
to be categorically exempt (Class 1, Section 15301 (e)(1)), and,
WHEREAS, the proposed canopy is ancillary to the primary function of the gas
pumps, and is consistent with the General Plan land use designation of Commercial, and,
WHEREAS, after the notice issued pursuant to the requirements of Rancho Palos
Verdes Development Code, the Planning Commission held a duly noticed public hearing
on September 22, 1998, at which all interested parties were given an opportunity to be
heard and present evidence
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS
Section 1: The proposed canopy may be erected above the height limit pursuant
to the requirements of the Building Code because there are no building code regulations

that preclude this Further, the proposed canopy will be constructed in accordance with
the accessory structure development guidelines of the City's Municipal Code The height
and canopy will be reviewed, inspected, and approved by the Building and Safety Division
and shall conform to the Uniform Building Codes
Section 2: The proposed canopy will not significantly impair a protected view
from the adjacent properties due to the orientation of the structures on the lot, and the
canopy is below the pad level of the upslope properties at Hilltop and Ridgegate
Condominiums
Section 3: The proposed grading of 950 cubic yards meets all nine criteria set
forth in RPVDC Section 17 76 040 since the proposed grading will not exceed what is
necessary for the tank replacement which is directly related to the permitted primary use
of the lot, and the tanks are an integral part of the permitted primary use of the existing
automotive service station
Section 4: The proposed permanent signs will not be detrimental to the public's
safety since the signs will be shielded and covered, and will not directly illuminate the
adjacent properties In addition, the number, type, and placement of signs would be
similar to other existing service stations in the City
Section 5: Any interested person may appeal this decision or any portion of this
decision to the City Council Pursuant to Section 17 80 070 of the Rancho Palos Verdes
Municipal Code, any such appeal must be filed with the City, in writing, and with the
appropriate appeal fee, no later than fifteen (15) days following the date of the Planning
Commission's final action
Section 5: For the foregoing reasons and based on the information and findings
in the Staff Report, Minutes and other records of proceeding, the Planning Commission of
the City of Rancho Palos Verdes hereby approves Site Plan Review No 8311, Grading
Permit No 2048 and Sign Permit No 961 thereby approving a canopy, with a proposed
height of 23'0" located toward the street frontage of Hawthorne Boulevard at 27774
Hawthorne Boulevard, 950 cubic yards of grading for replacement of three underground
tanks with two underground storage tanks, and four illuminated signs on the canopy facia
subject to the conditions contained in Exhibit "A", attached hereto and made a part hereof,
which are necessary to protect the public health, safety and welfare in the area
