PC RES 1998-021s a s A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 8 - REVISION "C", AND GRADING PERMIT NO. 1991, TO ALLOW THE CONSTRUCTION OF A NEW 4,039 SQUARE FOOT STRUCTURE WITH ASSOCIATED GRADING AT THE EXISTING MOUNT OLIVE LUTHERAN CHURCH SITE LOCATED AT 5975 ARMAGA SPRING ROAD. WHEREAS, on November 11, 1997, the Mount Olive Lutheran Church submitted applications for Conditional Use Permit No. 8 - Revision C, Grading Permit No. 1991, and Environmental Assessment No 700 to the City, and, WHEREAS, the Institutional zoning district in which the subject property is located allows for the continued use of the subject property as a religious and educational facility, as well as for the expansion of the facilities for related uses; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et seq ("CEQA:'), the State CEQA Guidelines, California Code of Regulations, Title 14, Sections 15000 et seq , the City's Local CEQA Guidelines, and Government Code Section 65952 5(e) (Hazardous Waste and Substances Statement), the City of Rancho Palos Verdes prepared an Initial Study and determined that, there is no substantial evidence that the approval of Conditional Use Permit No 8 - Revision "C"/Grading Permit No 1991 would result in a significant adverse effect on the environment Accordingly, a Draft Mitigated Negative Declaration has been prepared and notice of that fact was given in the manner required by law, and, WHEREAS, the Initial Study was prepared on March 23, 1998 and distributed for circulation and review from March 28, 1998 through April 18, 1998, and, WHEREAS, copies of the draft Mitigated Negative Declaration were distributed to the Planning Commission and prior to taking action on the proposed Conditional Use Permit No 8 - Revision "C"/Grading Permit No. 1991, the Planning Commission independently reviewed and considered the information and findings contained in the Mitigated Negative Declaration and detem3ined that the document was prepared in compliance with the requirements of CEQA and local guidelines, with respect thereto, and adopted P.C. Resolution No 98-20, and, WHEREAS, after issuing notice pursuant to the requirements of the City's Development Code and the State CEQA Guidelines, the Planning Commission of the City of Rancho Palos Verdes held a public hearing on May 26, 1998, at which time all interested parties were given an opportunity to be heard and present evidence NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS Section 1: This application would permit the construction of a new 4,039 square foot structure, which includes an assembly hall, administrative offices, restrooms, a kitchen, and a storage area, and a total of 385 cubic yards of grading activity (340 cubic yards of cut and 45 cubic yards of fill), with a 4.5' deep cut, to the Mount Olive Church located at 5975 Armaga Spring Road. Section 2: The site for the intended use is adequate in size and shape to accommodate said use and for all of the yards, setbacks, walls or fences, landscaping and other features required by this title or by conditions imposed under this section, to adjust said use with those on abutting land and within the neighborhood because the minimum setbacks under the Institutional zoning district will be maintained, and that adequate parking exists on the site to accommodate the proposed structure. Section 3: The site for the proposed use relates to streets and highways properly designed to cant' the type and quantity of traffic generated by the subject use because the site is served by collector streets and an arterial roadway which are adequate to accommodate the slight increase in the number of trips generated by the project. Section 4: The proposed use is not contrary to the General Plan because the proposed assembly hall use, is an allowable use in the Institutional -Religious land use designated under the General Plan Section 5: In requiring certain safeguards, the Planning Commission deems said requirements to be the minimum necessary to protect the health, safety and general welfare special setbacks and buffers, fences and/or walls, lighting, regulation of points of vehicular ingress and egress, regulation of noise, vibration, odors, landscape and maintenance requirements, service road or alley requirements, and other such conditions to make development in an orderly and efficient manner within the City, because the existing circulation pattern is adequate to accommodate the parking requirements of the on-site uses, thereby protecting the health, safety and welfare of the community Section 6: In approving the subject use at the speck location, there will be no significant adverse effect on adjacent property or the permitted use because the project site is zoned Institutional, which allows for the proposed use, and that adequate parking exists on the site to accommodate the proposed structure Section 7: The proposed Grading of 385 cubic yards (340 cubic yards of cut and 45 cubic yards of fill) is consistent with all of the Criteria for evaluation of Major Grading Applications because, 1), the grading does not exceed that which is necessary for the permitted primary use of the lot as the grading concept design has created a level pad that will aid in reducing the overall mass and height of the proposed structure.; 2), The grading does not significantly adversely affect the visual relationships with, nor the views from, neighboring properties, because the proposed grading concept will lower the building pad, and a visual analysis has been conducted that shows that the proposed project will not cause any significant view impairment to neighboring properties, 3), the nature of the grading minimizes disturbance to the natural contours P.C. Resolution No 98-21 Page 2 of 8 i and finished contours are reasonably natural as the new grade will match surrounding level grade, 4), the grading takes into account the preservation of natural topographic features by maintaining the surrounding grade level; 5), the grading would not cause excessive and unnecessary disturbance of the natural landscape or wildlife habitat through the removal of vegetation as the grading involves no impacts to vegetation or wildlife; and 6), the grading conforms to all of the standards found in Municipal Code Section No 17 76 040(E)(8) Section 8: Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council Pursuant to Section 17.80 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the appropriate appeal fee, no later than fifteen (15) days following May 26, 1998, the date of the Planning Commission's final action. Section 9: For the foregoing reasons and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby approves Conditional Use Permit No. 8 - Revision "C/Grading Permit No 1991, thereby allowing the Mount Olive Lutheran Church to add a 4,039 square foot assembly hall budding to the existing site, located at 5975 Armaga Spring Road, subject to the conditions contained in Exhibit'A', attached hereto and made a part hereof, which are necessary to protect the public health, safety and welfare in the area PASSED, APPROVED, AND ADOPTED this 26th day of May 1998, by the following vote: AYES. Resolution No. 98-21 Page 3 of 8 EXHIBIT 'A' CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT NO.8 - REVISION "C" GRADING PERMIT NO. 1991 ENVIRONMENTAL ASSESSMENT NO. 700 ( 5975 ARMAGA SPRING ROAD) General: Prior to the submittal of plans to building plan check, the applicant and the property owner shall submit to the City a statement, in writing, that they have read, understand, and agree to all conditions of approval contained in this Resolution Failure to provide said written statement within ninety (90) days of adoption of this Resolution shall render this approval null and void 2 All construction shall be completed in substantial conformance to the plans approved by the Planning Commission on May 26, 1998 3. This approval is for a new 4,039 square foot structure, which includes an assembly hall, administrative offices, restrooms, a kitchen, and a storage area, a total of 385 cubic yards of grading activity (340 cubic yards of cut and 45 cubic yards of fill), with a 4.5' deep cut, and 6" to 4 5' high retaining wall. 4. The following minimum setbacks shall be maintained, Front yard setback 25' Rear yard setback 20' Interior Side yard setback 20' 5 All conditions from the original Conditional Use Permit No 8 (Resolution 75-37), Conditional Use Permit No 8- Revision "A" (Resolution 90-28), and Conditional Use Permit No 8 -Revision "B" (Resolution 97-29) shall apply to this application 6. Any modification to this Conditional Use Permit No 8 -Revision "C"/Grading Permit No. 1991 shall require review and approval from the Planning Commission 7 These approvals shall expire twenty-four (24) months from the date of this action unless application for budding permits is made Extensions of up to one year may be granted by the Planning Commission if requested prior to expiration P C. Resolution No 98-20 Conditional Use Permit No. 8 -Rev. "C" 9. Detailed landscape (including all planted, hardscape and fencing elements) and irrigation plans shall be submitted for review and approval by the Director of Planning, Building and Code Enforcement prior to Issuance of any permits Said plans shall be consistent with the requirements found in Municipal Code Section 15 34, where applicable, and Incorporate drought tolerant plant materials Irrigation systems shall be on automatic timers and shall use drip and bubbler systems where appropriate Irrigation systems shall be adjusted for seasonal water needs 10 The maximum height of the proposed structure from the highest existing grade to be covered by structure to the roof peak shall be 16-11 ", and to the top of the proposed architectural feature (steeple) shall be 23'-5". The maximum height of the proposed project from the point where the foundation or slab meets lowest finished grade to the roof peak shall be 21'-6", and to the top of the proposed architectural feature (steeple) Is 28'- 0" Prior to pouring of concrete for foundations and slab, the developer shall provide certification of finished pad elevation Prior to installation of roof sheathing, Ridge Height Certification shall be submitted by the developer 11. A fee equivalent to the amount of a Site Plan Review Application shall be submitted for each review The annual review will focus on the previous year's operations, and the upcoming year's operations If it is determined by the Director that there are parking or circulation impacts occurring or that may occur as a result of the proposed project/use, then the applicant shall be responsible for mitigating such impacts to the satisfaction of the Director. The applicant may appeal the Directors decision to the Planning Commission If it is determined by the Planning Commission that the potential impacts have not been mitigated to a level of insignificance, then the CUP shall be revoked, and the use of the new assembly hall structure will cease to be operated at the subject site 12. The use of gardening equipment and garbage collection shall not occur between the hours of 7 00pm and 7 00am The use of Leaf Blowers on the site shall be consistent with Municipal Code Section 8.16. 13 Parking and security lighting shall be kept to minimum safety standards and shall conform to City requirements within the Development Code Fixtures shall be shielded so that only the subject property is illuminated, there shall be no spillover onto residential properties. A trial period of three (3) months from issuance of Certificate of Occupancy, for assessment of exterior lighting impacts shall be instituted At the end of the 3 -month period the City may require additional screening or reduction in intensity of any light which has been determined to be excessively bright Grading Permit No. 1991 14 Grading activity shall be limited to a total of 385 cubic yards (340 cubic yards of cut and 45 cubic yards of fill), a 4 5' deep cut, and a 6" to 4.5' high retaining wall. The applicant may also clean and grub the site of existing landscaping at the proposed new budding location 15 An as -graded soils and geologic report, complete with geologic map, shall be submitted and reviewed prior to issuance of a budding permit. 16 Foundations and floor slabs cast on expansive sods will be designed in accordance with Los Angeles County Code Section 2907-1 17. All grading shall be monitored by a licensed engineering geologist and/or soils engineer in accordance with applicable provisions of the Municipal Code and the recommendations of the Director of Public Works and/or City Engineer. 18. Grading activity on the site shall occur in accordance with all applicable City safety standards P C. Resolution No 98-21 1 19 Any dirt or other material deposited on the roadways from construction operations shall be removed by the applicant on a timely basis 20. The use of a rock crusher is not permitted on the site 21 Approval of this development is contingent upon connection to the local main line sewer. 22 If it is found that the requirements of the Plumbing Code cannot be met, no building permit will be issued for construction. 23 The development shall be served by adequately sized water system facilities which shall include fire hydrants of the size and type and location as determined by the Los Angles County Fire Department The water mains shall be of sufficient size to accommodate the total domestic and fire flows required for the development Domestic flow requirements shall be determined by the Director of Public Works Fire flow requirements shall be determined by the Los Angles County Fire Department and evidence of approval by the Los Angeles County Fire Department is required 24 Framing of structures shall not begin until after the Los Angeles County Fire Department has determined that there is adequate fire fighting water and access available to the said structures. 25. Drainage plans and necessary support documents to comply with the following requirements must be approved by the Director of Public Works prior to the issuance of building permits or commencement of grading, whichever comes first: A Provide drainage facilities to remove any flood hazard to the satisfaction of the Director of Public Works and dedicate and show easements on the Final Map B Eliminate any sheet overflow and ponding C Provide drainage facilities to protect the property from high velocity scouring action. D Provide for contributory drainage from adjoining properties 26. The contractor shall be responsible for repairs to any neighboring streets which may be damaged during development of the site, including, but not limited to, the designated haul truck route. Prior to issuance of grading permits, the developer shall post a bond, cash deposit or combination thereof, in an amount sufficient to cover the costs to repair any damage to streets and appurtenant structures as a result of this development as determined by the Director of Public Works In addition to providing a bond or cash deposit, the developer shall pay for a pavement analysis of the streets to be used as the designated haul truck route prior to the start of construction and at completion of construction The developer shall provide compensation for any loss of pavement life along the designated haul truck route as a result of this development P C. Resolution No 98-21 Page 7 of 8 27 All utilities to and on the lots shall be provided underground, including cable television, satellite dish antenna, telephone, electrical, gas and water All necessary permits shall be obtained for their installation Cable television shall connect to the nearest trunk line at the property owner's expense All such utilities shall be installed in conjunction with the development of each Individual parcel. 28.
