A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING
CONDITIONAL USE PERMIT NO. 158 -REVISION 'B' FOR
MISCELLANEOUS REVISIONS TO THE ARCHITECTURAL
AND SITE DEVELOPMENT STANDARDS FOR THE
CONSTRUCTION OF INDIVIDUAL RESIDENCES WITHIN
THE APPROVED RESIDENTIAL PLANNED DEVELOPMENT
FOR VESTING TENTATIVE TRACT MAP NO. 46628,
LOCATED AT HAWTHORNS BOULEVARD AND PALOS
VERDES DRIVE WEST
WHEREAS, on March 17, 1992, the City Council adopted Resolution No 92-27,
approving Conditional Use Permit No 158 in conjunction with Vesting Tentative Tract Map
No 46628 for a residential planned development of seventy-nine single-family lots and five
open space lots on a 132 -acre vacant site, located seaward of the terminus of Hawthorne
Boulevard at Palos Verdes Drive West, between the Lunada Pointe community on the
north and the Point Vicente Interpretive Center on the south, and,
WHEREAS, on February 25, 1997, the Planning Commission adopted PC
Resolution No. 97-12, approving Conditional Use Permit No 158 -Revision 'A' for minor
revisions to certain conditions of approval related to the relocation of Lots 78 and 79 of
Vesting Tentative Tract Map No 46628, as required by the U S Fish and Wildlife Service,
and,
WHEREAS, on February 9, 1998, the applicant, RPV Associates LLC, submitted an
application for Conditional Use Permit No 158 -Revision 'B' to allow the revision of
miscellaneous architectural and site development standards for Vesting Tentative Tract
Map No 46628, and,
WHEREAS, on March 11, 1998, the application for Conditional Use Permit No. 158 -
Revision B' was deemed complete by Staff, and,
WHEREAS, pursuant to the provisions of the California Environmental Quality Act,
Public Resources Code Sections 21000 et seq ("CEQA"), the State's CEQA Guidelines,
California Code of Regulations, Title 14, Section 15000 et. seq , the City's Local CEQA
Guidelines, and Government Code Section 65962 5(f) (Hazardous Waste and Substances
Statement), Staff found no evidence that Conditional Use Permit No. 158 -Revision B'
would have a significant effect on the environment because the environmental impacts of
the project have been previous addressed by the mitigation measures adopted pursuant
to Final Environmental Impact Report No 35, the proposed revisions are within the scope
of the project analyzed in Final Environmental Impact Report No 35 and are consistent
with the mitigation measures, and,
WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos
Verdes Development Code, the Planning Commission held a duly noticed public hearing
on April 14, 1998, at which time all interested parties were given an opportunity to be
heard and present evidence
NOW, THEREFORE, THE PLANNING COMMISSION DOES HEREBY FIND, DETERMINE
AND RESOLVE AS FOLLOWS:
Section 1: The site is still adequate in size and shape to accommodate said use
and for all of the yards, setbacks, walls or fences, landscaping and other features required
by this title [Title 17 "Zoning"] or by conditions imposed under this section [Section
17.60.050] to adjust said use to those on abutting land and within the neighborhood
because the proposed revisions are aesthetic in nature and do not materially affect the
overall design of the project
Section 2: The site for the proposed use still relates to streets and highways
properly designed to carry the type and quantity of traffic generated by the subject use
because the proposed revisions have no effect upon the approved network of vehicular,
pedestrian and equestrian improvements and facilities which are a part of the project
Section 3: In approving the subject use at the specific location, there will be no
significant adverse effect on adjacent property or the permitted use thereof because the
proposed revisions are minor and aesthetic in nature, and additional conditions are
imposed which will ensure that these revisions do not create significant adverse impacts
upon other properties.
Section 4: The proposed use is still consistent with the General Plan because the
proposed revisions are consistent with the Residential, <1 DU/acre land use designation
and the overall pattern of land use for the site will not change as a result of these
revisions
Section 5: The site of the proposed use is within the Natural (OC -1), Socio/Cultural
(OC -2) and Urban Appearance (OC -3) overlay control districts established by Chapter
17 40 (Overlay Control Districts of this title [Title 17 "Zoning"], and both the approved
project and the proposed revisions are consistent with the performance criteria established
by these districts
Section 6: Conditions regarding any of the requirements listed in RPVDC Section
17.60 050(A)(6), which the Planning Commission finds to be necessary to protect the
health, safety and general welfare, have been imposed [including but not limited to]
setbacks and buffers; fences or walls, lighting, vehicular ingress and egress, noise,
vibration, odors and similar emissions, landscaping; maintenance of structures, grounds

or signs; service roads or alleys, and such other conditions as will make possible
development of the City in an orderly and efficient manner and in conformity with the intent
and purposes set forth in this title [Title 17 "Zoning"], as described in the conditions of
approval of the attached Exhibit'A.'
Section 7: Any interested person aggrieved by this decision or by any portion of
this decision may appeal to the City Council Pursuant to Section 17.60.060 of the Rancho
Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and
with the appropriate appeal fee, no later than fifteen (15) days following April 14, 1998, the
date of the Planning Commission's final action
Section 8: For the foregoing reasons and based on the information and findings
included in the Staff Report, Minutes and other records of proceedings, the Planning
Commission of the City of Rancho Palos Verdes hereby approves Conditional Use Permit
No 158 -Revision 'B', thereby approving miscellaneous revisions to the architectural and
site development standards for the construction of individual residences within the
approved residential planned development for Vesting Tentative Tract Map No 46628,
located at Hawthorne Boulevard and Palos Verdes Drive West, subject to the conditions
contained in Exhibit 'A', attached hereto and made a part hereof, which are necessary to
protect the public health, safety and welfare in the area.
