PC RES 1998-011A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING SITE PLAN REVIEW NO. 8216, THEREBY APPROVING AN EIGHTEEN (18") INCH HIGH PARAPET WALL ABOVE THE EXISTING ROOF DECK'S STUCCO WALL WITH A MAXIMUM HEIGHT OF 17'6" FROM HIGHEST EXISTING GRADE TO AN EXISTING 2,471 SQUARE FOOT, TWO STORY RESIDENCE, LOCATED AT 4100 SEAHORSE LANE. WHEREAS, on January 26, 1998, the applicant, Mr. & Mrs. Ludwig Zelt submitted an application for Site Plan Review No 8216 to construct an eighteen (18") inch high parapet wall above the existing roof deck's stucco wall on the subject lot located at 4100 Seahorse Lane, and, WHEREAS, pursuant to the provisions of California Environmental Quality Act, Public Resources Code Section 21000 et seq. ("CEQA"), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et.seq , the City's Local CEQA Guidelines, and Government Code Section 65962 5(F) (Hazardous Waste and Substances Statement), Staff found no evidence that Site Plan Review No. 8216 would have significant effect on the environment and, therefore the proposed project has been found to be categorically exempt (Class 1, Section 15301 (e)(1)), and, WHEREAS, the proposed parapet wall is ancillary to primary single family residential use, and is consistent with the General Plan land use designation of Residential, and, WHEREAS, after notice issued pursuant to the requirements of Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on March 10, 1998, at which all interested parties were given an opportunity to be heard and present evidence NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS Section 1: The proposed parapet wall may be erected above the height limit pursuant to the requirements of the Building Code because there are no building code regulations that preclude this Further, the proposed parapet wall will be constructed in accordance with the residential development guidelines of the City's Municipal Code. The height and wall will be reviewed, inspected, and approved by the Building and Safety Division, and shall conform to the Uniform Building Codes PC Resolution No 98-11 Page 1 of 2 Section 2: The proposed parapet wall will not significantly impair a protected view from the adjacent properties due to the orientation of the structures on the lots, the significant difference in elevation of some of the adjacent lots, and because view above the existing house from the north and northwestern properties are of sky only Section 3: Any interested person may appeal this decision or any portion of this decision to the City Council Pursuant to Section 17.80.070 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the appropriate appeal fee, no later than fifteen (15) days following the date of the Planning Commission's final action Section 4: For the foregoing reasons and based on the information and findings in the Staff Report, Minutes and other records of proceeding, the Planning Commission of the City of Rancho Palos Verdes hereby approves Site Plan Review No 8216, thereby approving a parapet wall, with a proposed height of 17'6", on an existing 2,471 square foot, two-story residence, for the property located at 4100 Seahorse Lane, subject to the conditions contained in Exhibit "A", attached hereto and made a part hereof, which are necessary to protect the public health, safety and welfare in the area PASSED, APPROVED, AND ADOPTED this 10th day of March 1998, by the following vote: AYES: ABSENTATION: ABSENT: Commissioners Alberio, Paris, Slayden, Lyon, Vannorsdall, and Vice Chairman Cartwright. Chairman Clark \A-"" 2 La Joel of*, AICP Actin rector of Planni wilding and Code Enforcement, and Secretary to the Planning Commission "LawrenceE Chairman P C Resolution No. 98-11 Page 2 of 2 EXHIBIT "A" CONDITIONS OF APPROVAL SITE PLAN REVIEW NO. 8216 Prior to the submittal of plans into Building and Safety Division "plan check", the applicant shall submit a statement to the City, in writing, that they have read, understand and agree to all the conditions of approval contained in this resolution. Failure to provide said written statement within ninety (90) days of approval shall render this approval null and void 2 The approval shall become null and void after 180 days from the date of approval unless the approved plans are submitted to the Building and Safety Division to initiate the "plan check" review process, pursuant to Section 17 86 070 of the City's Development Code This approval shall become null and void if after initiating the "plan check" review process, or receiving a building permit to begin construction, said "plan check" or permit is allowed to expire or is withdrawn by the applicant 3. The Director of Planning, Building and Code Enforcement is authorized to make minor modifications to the approved preliminary plans or any of the conditions if such modifications shall achieve substantially the same results as would strict compliance with said plans and conditions. 4 The abandonment or non-use of this approval after a period of six months shall terminate the approval and any privileges granted hereunder shall become null and void. 5 The proposed parapet wall shall not exceed eighteen (18") inches in height, and the total length shall not exceed twenty feet four inches (20'4") at the northern side, seven (7'0") feet at the eastern side, and four (4'0") feet at the western side which totals thirty-one feet four inches (31'4"). 6 The proposed wall shall not exceed seventeen feet six inches (17'6") in height, measured from the highest elevation covered by structure on the eastern side of the residence (elevation of 105 33) to the top of the wall. 7 The appearance of the exterior finishes of the proposed wall must be compatible with the existing structure. 8. The hours of construction shall be limited to 7 00 a m to 7.00 p.m., Monday through Saturday No construction shall be permitted on Sundays or on legal holidays P C. The construction site shall be kept free of all loose materials resembling trash and debris in excess of that material used for immediate construction purposes. Such excess debris may include, but is not limited to the accumulation of debris. garbage, lumber, scrap metal, concrete, asphalt, piles of earth, salvage materials, abandoned or discarded furniture, appliances or other household fixtures. 10 No foliage removal is required in conjunction with the proposed parapet wallt PC Resolution No 98-11 Exhibit "A' Page 2 of 2
