PC RES 1997-065A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 199 TO ALLOW KENNELING ACTIVITIES ASSOCIATED WITH A VETERINARIAN HOSPITAL ON PROPERTY LOCATED AT 28326 WESTERN AVENUE. WHEREAS, on July 16, 1997, Robert W. Moore applications for Conditional Use Permit No 199 and Environmental Assessment No 697 proposing to conduct kenneling activities in conjunction with a veterinarian hospital within an existing commercial building at 28326 Western Avenue, and, WHEREAS, the applications were deemed complete on September 16, 1997 after the applicant submitted required environmental information; and, WHEREAS, the project site consists of a existing commercial budding which was previously used as a restaurant, but which has been vacant for several years, and, WHEREAS, a Draft Negative Declaration has been prepared and notice of that fact was given in the manner required by law, and, WHEREAS, after issuing notice pursuant to the requirements of the City's Development Code and the State CEQA Guidelines, the Planning Commission of the City of Rancho Palos Verdes held a public hearing on November 11, 1997 at which time all interested parties were given an opportunity to be heard and present evidence; and, WHEREAS, the Planning Commission of the City of Rancho Palos Verdes adopted Resolution No. 97-64, adopting a Negative Declaration for this project prior to taking action on the Conditional Use Permit application; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES HEREBY FINDS, DETERMINES, AND RESOLVES AS FOLLOWS: Section 1 The proposed Conditional Use Permit is not contrary to the General Plan, and particularly the land use designation of Commercial - retail, based on the intended use, and its location within an existing commercial center. Section 2. The proposed site conforms to the Municipal Code requirements for parcels of land within the CG (Commercial General ) zoning district, with the exception of lot width, as permitted by Variance No. 418. s Section 3- The site is adequate in size and shape to accommodate the proposed use and for all of the yards, setbacks, walls, fences, landscaping and other features required by this title or by conditions imposed under this section to integrate said use with those on adjacent land and within the neighborhood This is demonstrated by the location within a commercial center, on a lot that meets the zoning criteria, and since the use is consistent with the surrounding uses and is set away from residential uses. Section 4. The site for the proposed use relates to streets and highways sufficient to carry the type and quantity of traffic generated by the subject use based on Its location adjacent to Western Avenue and Westmont Drive which, in conjunction with the ingress and egress features of the commercial center, adequately serve the proposed use Section 5, Approval of the subject use at 28326 Western Avenue, there will be no significant adverse effect on adjacent property or the permitted use thereof, in that the proposed uses will be contained inside the building, with the exception of incidental walking of kenneled pets, and since appropriate noise and odor control measures will be taken to minimize impact to adjacent uses. The project site is also set away from residential areas, with streets intervening as buffers Section 6: The site of the proposed use is not within any of the overlay control districts established by chapter 17 40 (Overlay Control Districts) of the Rancho Palos Verdes Municipal Code Section 7, Conditions of approval as set forth in Exhibit A, attached hereto, are found to be necessary to protect the health, safety and general welfare Section 8: Based upon the facts contained in this Resolution, in the Staff Report and other components of the legislative record, in the proposed Negative Declaration, and in the public comments received by the Commission, the Planning Commission hereby approves Conditional Use Permit No 199 to allow for kenneling activities associated with a veterinarian hospital to be located at 28326 Western Avenue The approval of Conditional Use Permit No. 199 shall be subject to the conditions of approval set forth in Exhibit "A" attached hereto, which are necessary to protect and preserve the public health, safety and welfare. Chairman Vannorsdall Dtnaldt Vannorsdall hairman Carolynn Pbtru, AICP Director of Planning, Building, and Code Enforcement, and, Secretary to the Planning Commission Attachment Exhibit "N'- Conditions of Approval PC RESOLUTION NO 97-65 M \USERS\DAVIDS\WPWIN60\CUP199\PC-CUP RES PAGE 3 OF 3 Exhibit "A" Conditional Use Permit 199 - Conditions of Approval General Within ninety (90) days of the approval of the project, the applicant shall submit, in writing, a statement that he has read, understands, and accepts all conditions of approval Failure to provide said written statement shall render this approval null and void 2 The applicant shall be responsible for submittal of the $25.00 fee environmental posting fee, made payable to Los Angeles County, within 48 hours of the approval of this permit. 3 This conditional use permit shall be reviewed by the Planning Commission six (6) months from the date of the issuance of the Certificate of Occupancy or Final Building Permit for the renovation, whichever occurs first, to ensure compliance with all conditions of approval. At that time the Planning Commission may add, delete, or modify conditions of approval as deemed necessary and appropriate. Notice of said review shall be provided in accordance with the provisions of Section 17 80 of the Rancho Palos Verdes Municipal Code 4 The Director of Planning, Building and Code Enforcement is authorized to make minor modifications to the approved preliminary plans or any of the conditions of approval if such modifications will achieve substantially the same results as would strict compliance with said plans and conditions. 5 The uses permitted herein shall commence no later than one (1) year from the date of approval, after all appeal periods have expired Failure to commence the use within this time period shall result in expiration of the permit, thereby making all approvals null and void and of no effect whatsoever The Planning Commission may, at their discretion, extend this period for up to one (1) additional year provided the applicant shows substantial hardship, delays beyond their control, or other good cause 6. The abandonment or non-use of this approval after initial establishment of the kenneling and veterinarian hospital use shall terminate the approval and any privileges granted hereunder shall become null and void. 7 The maximum lot coverage for the lots shall be 50 percent Lot coverage shall include all areas covered by the primary and accessory structures, covered patio areas and all driveway areas. Resolution No 97-65 Exhibit "N' Page 1 of 3 8 The applicant shall obtain all necessary building permits prior to commencing construction activities, and construction activity shall be limited to daytime working hours (7:00 am to 7.00 pm) Monday through Saturday No such activity shall occur on Sundays or legal holidays 9 All uses associated with the veterinarian hospital and kenneling shall be conducted inside the building, with the exception of incidental walking of kenneled pets 10 Eastview Park shall under no circumstances be utilized for walking or exercising pets kenneled at the facility approved herein 11 The applicant or operator shall comply with all Los Angeles County Health Department standards, including but not limited to disposal of biomedical wastes 12. The applicant shall obtain all necessary building permits prior to commencing any construction work. 13 The new colors and materials for the building shall be compatible with the overall commercial center, and shall be reviewed and approved by the Director of Planning, Building and Code Enforcement prior to commencing the exterior work on the building. 14 The applicant or operator shall conduct the veterinarian hospital / kenneling business in such a way that no significant noise impact to adjacent land uses will occur Further, the applicant shall implement appropriate maintenance and / or other appropriate odor controlling mechanisms so that no impact to adjacent land uses will occur. 15 The applicant shall obtain required sign permit review and approval, along with the required building permits, prior to the installation of any signage for the proposed use 16 The Planning Commission, at a duly notice public hearing, may revoke this permit for failure to comply with the conditions of approval set forth herein If revoked, Conditional Use Permit No 199 shall be null and void, and continuation of the conditional use thereafter shall constitute a violation of the Rancho Palos Verdes Municipal Code. 17 Any new use or expansion of an existing use proposed on the subject property shall be subject to review and approval of a revision to the Conditional Use Permit, including, but not limited to additional environmental review as required by the provisions of the California Environmental Quality Act. Resolution No 97-65- Exhibit "A" Page 2 of 3 6— t 18 Unless otherwise designated in these conditions, all construction shall be completed in substantial conformance to the plans as approved by the Department of Planning, Building and Code Enforcement, and stamped received on October 30, 1997. 19. During construction, the project site shall be maintained free and clear of all trash and debris. All construction material shall be neatly stored in an area substantially screened from surrounding uses, and shall not interfere with parking or circulation at the commercial center 20. In the event that these conditions conflict with those set forth by another permitting agency or City department, the stricter shall apply. 21. The applicant shall comply with the requirements of the Los Angeles County Sanitation District as discussed in the letter dated November 5, 1997. Resolution No 97-65 Exhibit "A" Page 3 of 3
