PC RES 1997-064A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES ADOPTING A
NEGATIVE DECLARATION PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT FOR
PROPOSED CONDITIONAL USE PERMIT NO. 199 FOR
PROPERTY LOCATED AT 28326 WESTERN AVENUE.
WHEREAS, on July 16, 1997, Robert W Moore submitted applications for
Conditional Use Permit No. 199 and Environmental Assessment No. 697 proposing to
conduct kenneling activities in conjunction with a veterinarian hospital within an existing
commercial building at 28326 Western Avenue; and,
WHEREAS, the applications were deemed complete on September 16, 1997
after the applicant submitted necessary clarifying information; and,
WHEREAS, the project site consists of a existing commercial building which was
previously used as a restaurant, but which has been vacant for several years; and,
WHEREAS, pursuant to the provisions of the California Environmental Quality
Act, Public Resources Code Sections 21040 et. seq. ("CEQA"), the State CEQA
Guidelines, California Code of Regulations, Title 14, Sections 15000 et. seq., the City's
Local CEQA Guidelines, and Government Code Section 65952 5(f) (Hazardous Waste
and Substances Statement), the City of Rancho Palos Verdes prepared an Initial Study
and determined that there is no substantial evidence that the approval of Conditional
Use Permit No. 199 would result in a significant adverse effect on the environment
Accordingly, a Draft Negative Declaration has been prepared and notice of that fact
was given in the manner required by law; and,
WHEREAS, after issuing notice pursuant to the requirements of the City's
Development Code and the State CEQA Guidelines, the Planning Commission of the
City of Rancho Palos Verdes held a public hearing on November 11, 1997 at which
time all interested parties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES HEREBY FINDS, DETERMINES, AND RESOLVES AS
FOLLOWS
Section 1 The Planning Commission has reviewed and considered the
proposed Negative Declaration, the public comments upon it, and the other evidence
before the Commission prior to taking action on the proposed project and finds that the
Negative Declaration was prepared in a manner required by law, that there is no
substantial evidence that the approval of the Conditional Use Permit would have a
significant effect on the environment, provided that the identified conditions of approval
are complied with to eliminate significant environmental effects of the proposed project.

Section 2: The proposed Conditional Use Permit is not contrary to the General
Plan, since the project site is designated for commercial uses, and since the proposed use
is consistent with the designation set forth by the General Plan Land Use Map
Section 3 The project site contains no significant native vegetation, and has
no potential to impact biological resources
Sectio Based upon the foregoing findings, the adoption of the Draft
Negative Declaration is in the public interest
Section • Based upon the facts contained in this Resolution, in the Staff
Report and other components of the legislative record, in the proposed Negative
Declaration, and in the public comments received by the Commission, the Planning
Commission hereby adopts the proposed Negative Declaration associated with
Environmental Assessment No. 697 for the proposed Conditional Use Permit No 199
for conducting kenneling activities in conjunction with a veterinarian hospital to be
located at 28326 Western Avenue.
