PC RES 1997-0579 P.C. RESOLUTION NO. 97- 57 9 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES FORWARDING A FINDING TO THE CITY COUNCIL THAT THE PROPOSED VACATION OF A PORTION OF A SANITARY SEWER EASEMENT OVER LOT 8 OF TRACT 20856 IS CONSISTENT WITH THE GOALS AND POLICIES OF THE GENERAL PLAN WHEREAS, in 1995 it was determined that a portion of a City of Rancho Palos Verdes sanitary sewer line, maintained by the County of Los Angeles Consolidated Maintenance District, had been damaged by ground movement, and, WHEREAS, the City of Rancho Palos Verdes has prepared a design of, and the County of Los Angeles Consolidated Sewer Maintenance District will be constructing, a replacement sewer line, and, WHEREAS, upon construction of the replacement sewer line, a portion of an existing sanitary sewer easement, over Lot 8, Tract 20856 will no longer be required, and, WHEREAS, The City of Rancho Palos Verdes Public Works Department has initiated vacation proceedings for the portion of the sewer easement that is no longer required; and, WHEREAS, on August 19, 1997, the City Council authorized staff to proceed with the vacation of a portion of the sanitary sewer easement, at Lot 8, Tract 20856, and, WHEREAS, Section 65402(a) of the California Government Code requires that if a general plan has been adopted, no public property shall be vacated or abandoned until the location, purpose and extent of such vacation or abandonment have been submitted to and reported upon by the planning agency as to conformity with said adopted general plan, and WHEREAS, pursuant to the provisions of the California Environment Quality Act, Public Resources Code Sections 2100 et seq ("CEQA"), the State's CEQA Guidelines, California Codes of Regulation, Title 14, Section 15000 et seq , the City's Local CEQA Guidelines, and Government Code Section 56952 5 (e) (Hazardous Waste and Substances Statement), the City of Rancho Palos Verdes reviewed the request and determined that the proposed request would not have a significant impact on the environment and has , therefore, been determined to be categorically exempt (Class 1, Section 15301(c)); and, P C. Resolution No 97-57 Page 1 of 2 WHEREAS, the Planning Commission conducted a hearing on October 28, 1997, at which time all interested parties were given an opportunity to be heard and present evidence. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS - Section 1:. The proposed vacation is consistent with the goals and policies of the Rancho Palos Verdes general Plan. Section 2 For the foregoing reasons and based on the information and findings included in the Staff Report, Minutes and all other records of the proceedings, which are attached hereto and made a part thereof by reference, the Planning Commission hereby forwards this matter to the City Council for further consideration with the finding that the proposed vacation of a portion of a sanitary sewer easement is consistent with the goals and policies of the City's General plan PASSED, APPROVED, AND ADOPTED THIS 28th day of October, 1997, by the following vote: AYES COMMISSIONERS ALBERIO, CARTWRIGHT, CLARK, NG, SLAYDEN, VICE CHAIRMAN WHITENECK, AND CHAIRMAN VANNORSDALL NOES ABSTENTIONS ABSENT Donald E Vannorsdall Chairman Ki!
