RESOLUTION NO. 97-52 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING SITE PLAN REVIEW NO. 8056, THEREBY APPROVING PORTIONS OF PROPOSED RETAINING WALLS NEAR THE CORNER OF BLACKHORSE ROAD AND DIAMOND HEAD LANE TO EXCEED THE 30" HEIGHT LIMITATION FOR STRUCTURES WITHIN THE INTERSECTION VISIBILITY TRIANGLE AND TO ALLOW AN 84" LAMP POST NEAR THE CORNER OF DIAMOND HEAD LANE AND FALCON ROCK PLACE TO EXCEED THE 30" HEIGHT LIMIT INSIDE THE INTERSECTION VISIBILITY TRIANGLE. THIS APPROVAL ALSO INCLUDES 1,021 SQUARE FEET OF NEW BUILDING FOOTPRINT, LOCATED AT 4835 FALCON ROCK PLACE WHEREAS, on July 1, 1997, the landowner, Hugh and Doris Edey, submitted an application for Site Plan Review No. 8056 to allow portions of proposed retaining walls near the corner of Blackhorse Road and Diamond Head Lane to exceed the 30" height limitation for structures within the intersection visibility triangle and to allow an 84" lamp post near the corner of Diamond Head Lane and Falcon Rock Place to exceed the 30" height limit inside the intersection visibility triangle This approval also includes 1,021 square feet of new building footprint, located at 4835 Falcon Rock Place, and WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"}, the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et seq , the City's Local CEQA Guidelines, and Government Code Section 65962 5(9 (Hazardous Waste and Substances Statement), Staff found no evidence that Site Plan Review No 8056 would have a significant effect on the environment and, therefore, the proposed roject has been found to be categorically exempt (Class 1, Section 15301(e)(1 )}, and, WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on September 23, 1997, at which time all interested parties were given an opportunity to be heard and present evidence NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS Section 1: The proposed retaining walls, new landscaping and lamp post exceeding the 30" height limitation for structures within the intersection visibility triangle, may be constructed at the corners of the Blackhorse Road at Diamond Head Lane and Diamond Head Lane at Falcon Rock Place because the project, as conditioned, will not impair traffic visibility at the street intersections, determined by the Director of Public Works (based on analysis and recommendations by the City's Traffic Engineer) Section 2: The proposed 1,021 square foot of new building footprint is in compliance with the following Residential Development Standards for the RS -4 zoning district under the City's Development Code a Residential height restriction - Building additions to the existing residence will not exceed the 160" height limitation for residential structures on a pad lot with less than 5% slope, as measured from the highest elevation of the existing building pad covered by the structure to a maximum height of 160" and the height of the downslope (lower elevation) of the structure is limited to a maximum height of 20'0", measured where the lowest foundation or slab meets finished grade b Property line setbacks - The proposed project will maintain the required minimum structure setback from property lines because the expanded building footprint, enclosed courtyard, dining room addition, bay windows and new trellis will not encroach within the 20'0" front yard, 160" rear yard, 10'0" street -side and 60" interior -side setbacks C Required open space - The subject property will exceed the required minimum open space of 50% because the new lot coverage created by the additional building footprint, enclosed courtyard, new driveway and rear yard trellis will cover only 41% of the property Therefore the amount of open space on lot will decrease from 64% to 59%, exceeding the minimum required 50% d Front setback area landscaping - The front setback area will maintain the inimum required 50% of landscaping because the proposed project will create 53% new and redesigned landscaping along Falcon Rock Place Section : The four proposed skylights, three flush with the roof pitch and one conical, pyramid -shaped skylight, are approved because the skylights will not project above the existing ridgeline of 192" and no protected view from adjacent properties will be impaired P.C. Resolution No 97-52 Page 2 of 3 Section 4: Based on foliage analysis conducted on site visits to the property in processing the applications, no trees or vegetation on the subject property were found to significantly impair a protected view of an surrounding residence. Section 5: Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council. Pursuant to Section 17 80 070(A) of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the appropriate appeal fee, no later than fifteen (15) days following September 23, 1997, the date of the Planning Commission's final action. Section 6: For the foregoing reasons and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby approves Site Plan Review No 8056, thereby approving portions of proposed retaining walls near the corner of Blackhorse Road and Diamond Head Lane to exceed the 30" height limitation for structures within the intersection visibility triangle and to allow an 84" lamp post near the comer of Diamond Head Lane and Falcon Rock Place to exceed the 30" height limit inside the intersection visibility triangle The approval also includes 1,021 square feet of new building footprint, located at 4835 Falcon Rock Place, subject to the conditions contained in Exhibit'A', attached hereto and made a part hereof, which are necessary to protect the public health, safety and welfare in the area PASSED, APPROVED, AND ADOPTED this 23 rd day of September 1997, by the following vote AYES Alberio, CartwM,ght, Clark, Ng, Slayden, Whiteneck, Vannorsdall NOES ABSTENTIONS. Whnorsdall Chairman PC Resolution No 97- 52 Page 3 of 3 EXHIBIT 'A' CONDITIONS OF APPROVAL FOR SITE PLAN REVIEW NO. 8056 (4835 FALCON ROCK PLACE) 1. Within ninety (90) days following approval of Site Plan Review No. 8056, the applicant/property owner shall submit to the City a statement, in writing, that they have read, understand and agree to all conditions of approval listed below. Failure to provide said written statement shall render this approval null and void. 2. This approval is for portions of proposed retaining walls near the corner of Blackhorse Road and Diamond Head Lane to exceed the 30" height limitation for structures within the intersection visibility triangle and to allow an 84" lamp post near the corner of Diamond Head Lane and Falcon Rock Place to exceed the 30" height limit inside the intersection visibility triangle. This approval also includes 1,021 square feet of new building footprint, located at 4835 Falcon Rock Place. 3. Within the intersection visibility triangle at the corner of Blackhorse Road and Diamond Head Lane, the combined height of the retaining wall and landscaping shall not exceed 36", measured from the back of sidewalk 5'0" into the interior of the subject property. Within the intersection visibility triangle at Diamond Head Lane and Falcon Rock Place, the combined height of the retaining wall and landscaping shall not exceed 36", measured from the back of sidewalk 3'0" into the interior of the subject property. 4. The 84" (7') lamp post shall be allowed within the intersection visibility triangle at Diamond Head Lane and Falcon Rock Place, in the location noted on the site plans. 5. The maximum ridgeline height for the modified roof, new roof pitch over the garage, dining room addition and enclosed courtyard shall not exceed 16'0", as measured from the highest elevation benchmark covered by existing structure (northwest corner of the residence). The existing ridgeline of 19'2" shall be maintained for all other portions of the structure. The applicant shall provide to the Building and Safety Division certification that the maximum ridge height of the additions does not exceed 16'0". 6. The 3 surface skylights along the roof pitch and the one conical, pyramid-shaped skylight shall not project above the existing ridgeling height of 19'2". P.C. Resolution No. 97-52 Page 1 of 2 0 * 7. The maximum eave projection allowed into the required setback areas shall not exceed 6 inches for each 1 foot of required setback. 8. The following structure setbacks from property line shall be maintained: Front yard setback: 20'0" (proposed) Rear yard setback: 28'0" (proposed) Interior-side yard setback: 5'9" (proposed) Street-side yard setback 12'0" (proposed) 9. The new garage shall maintain an interior ground space of no less than 18'0" in width by 20'0"in depth, unobstructed for the parking and storage of vehicles. 10. A minimum of 50% open space shall be maintained on the property (proposed: 59%). 11. A minimum of 50% landscaping shall be maintained in the front yard setback area (proposed: 53%). 12. Based on a foliage analysis conducted during review of this project, there is no existing foliage on the subject property that impairs views from any nearby residences. Therefore, none of the vegetation on the subject lot needs to be trimmed or removed prior to submitting the project for Building and Safety Plan Check. However, this determination does not preclude or prevent a property owner from filing for view restoration permit against the subject property at a future date. 13. In the event that a Planning requirement and Building & Safety requirement are in conflict with one another, the stricter standard shall apply. 14. Unless otherwise designated in these conditions, all construction shall be completed in substantial conformance with the revised plans prepared by Greer & Associates, titled Addition and Alterations to residence of Hugh and Doris Edey, submitted to the City on September 12, 1997. 15. The hours of construction shall be limited to 7:00 AM to 7:00 PM, Monday through Saturday. No construction shall be permitted on Sundays or on legal holidays. 16. The construction site shall be kept free of all loose materials resembling trash and debris in excess of that material used for immediate construction purposes. Such excess material may include, but is not limited to, the accumulation of debris, garbage, lumber, scrap metal, concrete, asphalt, piles of earth, salvage materials, abandoned or discarded furniture, appliances or other household fixtures.
