PC RES 1997-043P.C. RESOLUTION NO. 97-43 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING GRADING PERMIT NO. 1882 FOR GRADING DOWN PADS ASSOCIATED WITH THE SUBDIVISION OF PROPERTY LOCATED AT 6560 PALOS VERDES DRIVE SOUTH. WHEREAS, on June 17, 1996, Frank Sciarrotta submitted applications for Tentative Parcel Map No 24546, Coastal Permit No. 134, Grading Permit No. 1882, and Environmental Assessment No 685 in order to subdivide an existing single family residential parcel at the southeast corner of the intersection of Palos Verdes Drive South and Seawolf Drive into two lots, and, WHEREAS, the applications were deemed complete on May 22, 1997 after the applicant submitted required environmental information, and, WHEREAS, the project site was developed and used as a gas station from approximately May 1967 through October 1979, at which time the improvements and underground tanks were removed from the site, and, WHEREAS, the Planning Commission of the City of Rancho Palos Verdes adopted Resolution No 97-41 approving Coastal Permit No. 134 to allow this project in a non -appealable area set forth by the Coastal Specific Plan, and, WHEREAS, the Planning Commission of the City of Rancho Palos Verdes adopted Resolution No. 97-42 approving Tentative Parcel Map No. 24546, subject to conditions, to allow subdivision of the project site into two single family residential parcels, and, WHEREAS, a Draft Negative Declaration has been prepared and notice of that fact was given in the manner required by law, and, WHEREAS, after issuing notice pursuant to the requirements of the City's Development Code and the State CEQA Guidelines, the Planning Commission of the City of Rancho Palos Verdes held public hearings on July 8, 1997, and August 12, 1997 at which time all interested parties were given an opportunity to be heard and present evidence; and, WHEREAS, the Planning Commission of the City of Rancho Palos Verdes adopted Resolution No. 97-40, adopting a Negative Declaration for this project, NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES HEREBY FINDS, DETERMINES, AND RESOLVES AS FOLLOWS: Section 1 The proposed grading for associated Tentative Parcel Map No 24546 is not contrary to the General Pian based on the necessity to minimize impact. to views of the ocean enjoyed over the property from Palos Verdes Drive South traveling in ,the west bound direction. Section 2 The proposed grading is not excessive beyond that necessary for the permitted primary use of the lot, since the grading will result in export of 2,900 cubic yards of material from the site, which is typical of other single family residential developments in the City, and since it is necessary to lower the pad elevations of the lots in order to minimize impacts to views from Palos Verdes Drive South. Section 3- The grading, and potential future construction, does not significantly adversely affect the visual relationships with, nor the views from, neighboring sites, since the grading is primarily intended to lower the elevation of the building pards in order to protect the public views over the site from the west bound traffic lanes on Palos Verdes Drive South Section 4. The nature of the grading minimizes disturbance to the natural contours, and the finished contours are reasonably natural, particularly since the site was a previously developed pad lot, and is not currently in a truly natural state. Section 5: Based upon the facts contained in this Resolution, in the Staff Report and other components of the legislative record, in the proposed Negative Declaration, and in the public comments received by the Commission, the Planning Commission hereby approves Grading Permit No. 1882 for lowering the pads of the lots to maximum pad elevations of 226.5 feet above sea level for Parcel 1 and 228 0 feet above sea level for Parcel 2, at property generally known as 6560 Palos Verdes Drive South The approval of Grading Permit No 1882 shall be subject to the conditions of approval set forth in Exhibit "A" attached hereto, which are necessary to protect and preserve the public health, safety and welfare. This approval shall expire with the related Tentative Parcel Map No 24546, which is twenty-four (24) months from the date of approval by the Planning Commission of the City of Rancho Palos Verdes, unless otherwise extended The applicant will be allowed to submit requests for one year extensions in accordance with the Subdivision Map Act and any other pertinent legislation 3. Any grading or construction within the Los Angeles County Storm Drain easement on Parcel 1 shall have appropriate clearances from the County prior to commencing such work. 4 During all grading activity, dust shall be controlled by frequent watering of the graded area, covering of trucks used to transport earth to prevent spillage and requiring street sweepings as determined to be necessary by the Department of Public Works 5. The applicant or developer shall monitor for petroleum contamination during grading activities in accordance with the recommendations contained in the April 24, 1997 letter from Ralph A. De La Parra - Registered Civil Engineer, and shall submit a summary report of all findings, even if no contaminants are observed, at the conclusion of the grading work 6. The project site shall be graded down to a maximum pad elevation of 226 5 feet above sea level for Parcel 1 and 228 0 feet above sea level for Parcel 2. 7 A construction plan shall be submitted to the Director of Planning, Building and Code Enforcement prior to the issuance of any grading permits Said plan shall include, but shall not be limited to: a Limits and quantities of grading b Estimated length of time to complete rough grading and improvements C Location of construction trailer, if any. d Location and type of temporary utilities Resolution No 97-43 Exhibit "A" Page 1 of 3 8 No rock crusher shall be used in conjunction with this project. 9 A note shall be placed on the approved grading plan that requires the Director of Planning, Building and Code Enforcement approval of rough grading prior to final clearance The Director, or designated representative, shall inspect the graded site for accuracy of pad elevations, created slope gradients, and pad size The Director may require certification of any grading related matter 10 Grading activities shall conform to the provisions of the Uniform Building Code as adopted and implemented at the time that grading permits are issued 11 Graded slope tops shall be rounded, slope gradients shall be varied and no significant abrupt changes between natural and graded slopes will be permitted Created slopes shall not exceed 2 1 12 All future grading of the lots, not including excavation to lower the average pad level as described in condition number 6 above, shall be minor in scope and limited to excavation for footings, landscaping, site drainage, and potentially pool and spa excavation Excavation to create more building area shall not be permitted 13 The final grading plan to lower the pad levels shall be reviewed and approved by the City Retaining walls shall be included on the plans, and shall adhere to the requirements set forth in the Rancho Palos Verdes Municipal Code 14 No additional access points, particularly from Palos Verdes Drive South are permitted, and the applicant shall cause the removal of the existing curb cuts and driveway aprons located on Palos Verdes Drive South, and the one closest to Palos Verdes Drive South on Seawolf Drive, as part of the site grading New curbing and sidewalks to match with the existing curbs shall be installed to the specifications set forth by the Rancho Palos Verdes Department of Public Works 15 Construction Activity shall be limited to daytime working hours (7 00 am to 7 00 pm) Monday through Saturday No such activity shall occur on Sundays or legal holidays All equipment shall be equipped with a muffler to reduce on-site grading noise levels Drainage 16 All site drainage shall be conducted either to the street or to an existing storm drain system in non-erosive devices Resolution No. 97-43 Exhibit "X Page 2 of 3 17. All drainage swales shall have the cement colored to earth tones, as approved by the Director of Planning, Building and Code Enforcement. 18 In the event that the applicant opts to drain the site to Sandy Point Court, appropriate easements shall be obtained from the affected property owners, and shall be recorded in conjunction with the associated Final Parcel Map No 24546.
