RESOLUTION NO. 97-41 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING COASTAL PERMIT NO. 134 FOR THE PROPOSED SUBDIVISION OF PROPERTY LOCATED AT 6560 PALOS VERDES DRIVE SOUTH. WHEREAS, on June 17, 1996, Frank Sciarrotta submitted applications for Tentative Parcel Map No 24546, Coastal Permit No. 134, Grading Permit No. 1882, and Environmental Assessment No 685 in order to subdivide an existing single family residential parcel at the southeast corner of the intersection of Palos Verdes Drive South and Seawolf Dave into two lots, and, WHEREAS, the applications were deemed complete on May 22, 1997 after the applicant submitted required environmental information, and, WHEREAS, the project site was developed and used as a gas station from approximately May 1967 through October 1979, at which time the improvements and underground tanks were removed from the site; and, WHEREAS, the project site is located within the a non -appealable area of the Coastal Specific Plan which means the City decisions on this project are final, and can not be appealed to the California Coastal Commission, and, WHEREAS, a Draft Negative Declaration has been prepared and notice of that fact was given in the manner required by law; and, WHEREAS, after issuing notice pursuant to the requirements of the City's Development Code and the State CEQA Guidelines, the Planning Commission of the City of Rancho Palos Verdes held public hearings on July 8, 1997 and August 12, 1997 at which time all interested parties were given an opportunity to be heard and present evidence, and, WHEREAS, the Planning Commission of the City of Rancho Palos Verdes adopted Resolution No. 97-40, adopting a Negative Declaration for this project prior to taking action on the Coastal Permit application; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES HEREBY FINDS, DETERMINES, AND RESOLVES AS FOLLOWS Section 1 The proposed Coastal Permit and the related Tentative Parcel Map No 24546 and Grading Permit No 1882 are in conformance with the General Plan and the Coastal Specific Plan with respect to the lots created in terms of lot size, density and Intended land use The project will not result in significant impact to view in conflict with the General Plan or the Coastal Specific Plan as the primary view, that from the west bound lane of Palos Verdes Drive South, has been preserved in its entirety The incremental impact to views along the east bound lane of Palos Verdes Drive South is found not to be significant since the existing views in this direction are largely impaired by existing development surrounding the subject property. Section 2 The proposed project is not located between the sea and the first public road, therefore Coastal Act policies related to public access and recreation policies do not apply. Section 3• Based upon the facts contained in this Resolution, in the Staff Report and other components of the legislative record, in the proposed Negative Declaration, and in the public comments received by the Commission, the Planning Commission hereby approves Coastal Permit No 134 to allow for subdivision of an approximately 22,344 square foot site into two (2) parcels that are 10,654 square feet and 11,690 square feet in size in an area subject to the Coastal Specific Plan located at 6560 Palos Verdes Drive South. The approval of Coastal Permit No. 134 shall be subject to the conditions of approval set forth in Exhibit "A" attached hereto, which are necessary to protect and preserve the public health, safety and welfare PASSED, APPROVED, and ADOPTED this 26th day of August 1997 by the following roll call vote AYES Commissioners Cartwright, Clark, Slayden, Vice Chairman Whiteneck, and Chairman Vannorsdall. This approval shall expire with the related Tentative Parcel Map No 24546, which is twenty-four (24) months from the date of approval, by the Planning Commission of the City of Rancho Palos Verdes, unless otherwise extended with the associated Tentative Parcel Map No. 24546. The applicant will be allowed to submit requests for one year extensions in accordance with the Subdivision Map Act and any other pertinent legislation 3. The maximum pad elevations for Parcel 1 shall be 226 5 feet, and the maximum ridgeline elevation shall be 239.4 feet 4. The maximum pad elevation for Parcel 2 shall be 228 0 feet, and the maximum ridgeline elevation shall be 240.9 feet 5. The roofs of the main structures shall have a minimum pitch of 2 in 12 A variety of roof planes shall be used to break up the visual mass of the roofline, and no roof -mounted equipment shall be permitted.
