A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES DENYING HEIGHT
VARIATION NO. 835, FOR A 2,152 SQUARE FOOT,
SECOND -STORY ADDITION WITH A MAXIMUM HEIGHT OF
25'10" TO AN EXISTING SINGLE -STORY, SINGLE-FAMILY
RESIDENCE AND APPROVING SITE PLAN REVIEW NO.
7988 FOR AN 8 SQUARE FOOT BAY WINDOW ON THE
EAST ELEVATION OF THE RESIDENCE, LOCATED AT 59
OCEANAIRE DRIVE
WHEREAS, on February 21, 1997, the applicants Mr & Mrs Edgerton, originally
submitted an application for Height Variation No 835 to allow a 2,434 square foot, second
story addition to an existing single -story, single-family residence and approving Site Plan
Review No 7988 for an 8 square foot bay window on the east elevation of the residence
located at 59 Oceanaire Drive, and,
WHEREAS, on June 26, 1997, the applicants, Mr & Mrs Edgerton, submitted a
revised application for Height Variation No 835 to allow a 2,152 square foot, second -story
addition to an existing single -story, single-family residence and approving Site Plan
Review No 7988 for an 8 square foot bay window on the east elevation of the residence
located at 59 Oceanaire Drive, and,
WHEREAS, pursuant to the provisions of the California Environmental Quality Act,
Public Resources Code Sections 21000 et. seq ("CEQA"), the State's CEQA Guidelines,
California Code of Regulation, Title 14, Section 15000 et. seq , the City's Local CEQA
Guidelines, and Government Code Section 65962.5(f) (Hazardous Waste and Substances
Statement), Staff found no evidence that Height Variation No 835 would have a significant
effect on the environment and, therefore, the proposed project has been found to be
categorically exempt (Class 1, Section 15301(e)(1)), and,
WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos
Verdes Development Code, the Planning Commission held a duly noticed public hearing
on August 12, 1997, and additional public hearings on August 14 and August 25, 1997,
at which time all interested parties were given an opportunity to be heard and present
evidence
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS
Section 1: The proposed structure is incompatible with the immediate
neighborhood character because of the following criteria:
Architecture (bulk and massy The existing footprint of the structure is rectangular,
with the longest side serving as the front facade facing the cul-de-sac The
proposed project, with a new second -story along the entire length of the existing
building footprint, will create a large structure with a massive appearance which will
visually dominate the surrounding neighborhood
Scale of Surrounding Residences - The habitable space of the residence will be
803 square feet larger than the largest existing home in the surrounding area and
2,428 square feet larger than the average residence in the neighborhood The scale
of the proposed second -story on an existing building footprint, the length (mass) of
which is oriented to the street, is too large an addition to be compatible with the
surrounding neighborhood.
Front Setback - The majority of residences in the neighborhood are setback
at least 30' from the street curb. The existing residence is only 21' setback from the
street curb and the proposed second -story addition would be 29' from the street
curb The proposed two-story residence would result in a large structure, whose
close proximity to Oceanaire Drive would create a structure that dominates the
street and the surrounding residences
Section 2: The proposed bay window on the east elevation of the residence
complies with the Development Code Residential Development Standards for the required
property line setbacks (minimum 5'0" interior -side setback), required open space (minimum
60%) and the structure height restriction (maximum 160"). Therefore, the bay window is
approved under Site Plan Review No 7988
Section 3: Any interested person aggrieved by this decision or by any portion of
this decision may appeal to the City Council Pursuant to Section 17.02.040(C)(1)0) of the
Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in
writing, and with the appropriate appeal fee, no later than fifteen (15) days following
August 25, 1997, the date of the Planning Commission's final action
Section 4: For the foregoing reasons and based on the information and findings
included in the Staff Report, Minutes and other records of proceedings, the Planning
Commission of the City of Rancho Palos Verdes hereby denies Height Variation No. 835,
thereby denying a 2,152 square foot, second -story addition to an existing single -story,
single-family residence and approving Site Plan Review No 7988 for an 8 square foot bay
window on the east elevation of the residence, located at 59 Oceanaire Drive
