A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING
TENTATIVE PARCEL MAP NO. 24634 FOR THE
SUBDIVISION OF PROPERTY LOCATED AT 28300 AND
28326 WESTERN AVENUE.
WHEREAS, on January 10, 1997, Robert Sylvor submitted applications for
Tentative Parcel Map No 24634, Variance No. 418, and Environmental Assessment
No 693 in order to subdivide an existing commercial parcel at the southeast corner of
the intersection of Western Avenue and Westmont Drive into two lots; and,
WHEREAS, the protect site is fully developed with two commercial buildings and
associated parking, access, and landscaping, and,
WHEREAS, the proposed Tentative Parcel Map No 24634 will not result in any
modification to the existing site improvements, and,
WHEREAS, the lots of the proposed Tentative Parcel Map do not comply with
the Municipal Code requirements for parcels of land within the CG (commercial general)
zoning district, and,
WHEREAS, the Planning Commission of the City of Rancho Palos Verdes
adopted Resolution No. 97-34 approving Variance No 418 to allow the creation of lots
with lot widths below the minimum standards set forth in the Municipal Code; and,
WHEREAS, the proposed Tentative Parcel Map is required by the Subdivision
Map Act in order to allow the property owner to sell a portion of the approximately two
acre parcel while retaining ownership of the remainder of the parcel, and,
WHEREAS, a Draft Negative Declaration has been prepared and notice of that
fact was given in the manner required by law; and,
WHEREAS, after issuing notice pursuant to the requirements of the City's
Development Code and the State CEQA Guidelines, the Planning Commission of the
City of Rancho Palos Verdes held a public hearing on June 24, 1997 at which time all
interested parties were given an opportunity to be heard and present evidence
WHEREAS, the Planning Commission of the City of Rancho Palos Verdes
adopted Resolution No. 97-33, adopting a Negative Declaration for this project;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES HEREBY FINDS, DETERMINES, AND RESOLVES AS
FOLLOWS:
Section 1 That the proposed Tentative Parcel Map is not contrary to the
General Plan, since the existing center is consistent with the commercial Land Use
designation and the project will not result in any changes to the commercial center.
Section 2 The Planning Commission finds that the "Declaration of
Restrictions and Grand of Easements" recorded as Instruments No. 2103 and No 2523
in the Los Angeles County Recorders Office against the subject property set forth
parking and access rights across various portions of the entire 6.1 acre commercial
center and these rights ensure appropriate access and parking for the proposed
parcels, and which remains in full force and effect regardless of the proposed
subdivision.
Section 3 Based upon the facts contained in this Resolution, in the Staff
Report and other components of the legislative record, in the proposed Negative
Declaration, and in the public comments received by the Commission, the Planning
Commission hereby approves Tentative Parcel Map No. 24634 to allow for subdivision
of an approximately two (2) acre site into two (2) 40,000 square foot commercial parcels
with widths less than those required by the Municipal Code and which are located at
28300 and 28326 Western Avenue. The approval of Tentative Parcel Map No 24634
shall be subject to the conditions of approval set forth in Exhibit "A" attached hereto,
which are necessary to protect and preserve the public health, safety and welfare.

Tentative Parcel Map No. 24634 - Conditions of Approval
General
Within thirty (30) days of the approval of the project, the applicant shall submit, in
writing, a statement that he has read, understands, and accepts all conditions of
approval
2 The City's filing fee for final map shall be paid within six (6) months of approval of
the tentative map The applicant can submit requests to the Director of
Planning, Building and Code Enforcement to allow extensions to the filing of said
fee. Filing fee extensions shall run concurrently with the life of the map
3 The applicant shall supply the City with one mylar and one print of the recorded
map
4. This approval shall expire twenty-four (24) months from the date of approval of
this Map by the Planning Commission of the City of Rancho Palos Verdes,
unless otherwise extended. The applicant will be allowed to submit requests for
one year extensions in accordance with the Subdivision Map Act and any other
pertinent legislation.
5 No additional access points, modification to site improvements, or changes in
use are approved herein

6 Prior to submitting the Final Map for recordation pursuant to Section 66442 of
the Government Code, clearance shall be obtained from all affected departments
and divisions, including clearance from the City Engineer for items including, but
not limited to, the following
a Mathematical accuracy
b. Survey analysis
C. Correctness of certificates
d Signatures
7 Prior to recordation of the Final Map the applicant shall post Faithful
Performance Bonds for Monumentation in the full amount of the cost of setting
such monuments, guaranteeing the faithful performance of all such work of
setting monuments and furnishing notes, pursuant to Sections 16 20.160 and
16 20 170 of the Municipal Code.

8 Within twenty-four (24) months from the date of the filing of the Final Map, the
developer shall set survey monuments and tie points and furnish the notes to the
City Engineer All lot corners shall be referenced with permanent survey
markers in accordance with the Subdivision Map Act

9 If signatures of record title interests appear on the Final Map, the applicant shall
submit a preliminary guarantee A final guarantee will be required at the time of
filing of the Final Map with the County Recorder. If said signatures do not
appear on the Final Map, a preliminary title report/guarantee is needed that
overs the area showing all fee owners and interest holders The account for this
preliminary tale report guarantee should remain open until the Final map is filed
with the County Recorder
10. All easements for utilities, drainage, parking, and access as currently recorded
against the subject property shall remain in full force and effect upon recordation
of the Final Map
11. Prior to affecting any change to the buildings, the site improvements, or uses of
the properties subject to this parcel map, the applicant or owner shall first obtain
all necessary City reviews, approvals, and permits as set forth by the Rancho
Palos Verdes Municipal Code
