A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES ADOPTING A
NEGATIVE DECLARATION PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT FOR A
PROPOSED VARIANCE NO. 418 AND ASSOCIATED
TENTATIVE PARCEL MAP NO. 24634 FOR PROPERTY
LOCATED AT 28300 AND 28326 WESTERN AVENUE.
WHEREAS, on January 10, 1997, Robert Sylvor submitted applications for
Tentative Parcel Map No 24634, Variance No 418, and Environmental Assessment
No 693 in order to subdivide an existing commercial parcel at the southeast corner of
the intersection of Western Avenue and Westmont Drive into two lots, and,
WHEREAS, the project site is fully developed with two commercial buildings and
associated parking, access, and landscaping, and,
WHEREAS, the proposed Variance No 418 and Tentative Parcel Map No
24634 will not result in any modification to the existing site improvements; and,
WHEREAS, pursuant to the provisions of the California Environmental Quality
Act, Public Resources Code Sections 21000 et seq ("CEQA"), the State CEQA
Guidelines, California Code of Regulations, Title 14, Sections 15000 et seq , the City's
Local CEQA Guidelines, and Government Code Section 65952.5(f) (Hazardous Waste
and Substances Statement), the City of Rancho Palos Verdes prepared an Initial Study
and determined that there is no substantial evidence that the approval of Variance No
418 and Tentative Parcel Map No 24634 would result in a significant adverse effect on
the environment Accordingly, a Draft Negative Declaration has been prepared and
notice of that fact was given in the manner required by law, and,
WHEREAS, after issuing notice pursuant to the requirements of the City's
Development Code and the State CEQA Guidelines, the Planning Commission of the
City of Rancho Palos Verdes held a public hearing on June 24, 1997 at which time all
interested parties were given an opportunity to be heard and present evidence
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES HEREBY FINDS, DETERMINES, AND RESOLVES AS
FOLLOWS -
Section 1 The Planning Commission has reviewed and considered the
proposed Negative Declaration, the public comments upon it, and the other evidence
before the Commission and finds that the Negative Declaration was prepared in a
manner required by law, that there is no substantial evidence that the approval of the
Variance and the Tentative Parcel Map would have a significant effect on the
environment, and that no mitigation measures are necessary to eliminate significant
environmental effects of the proposed project.
Section 2: The Planning Commission finds that the approval of the Variance
with respect to the lot width and the subdivision of the property will not result in
significant adverse environmental impact because no changes to the existing
development will result
Section 3 That although the Negative Declaration analyzes the environmental
impacts associated with Variance No. 418 and Tentative Parcel Map No 24634
separate environmental review will be performed for any projects on either of the
proposed parcels prior to receiving any approvals from the City, as required by the
California Environmental Quality Act and the Rancho Palos Verdes Municipal Code
Section 4: That the proposed Variance and Tentative Parcel Map are not
contrary to the General Plan, since the existing shopping center is consistent with the
commercial Land Use designation and the project will not result in any changes to the
commercial center
Section 5. Based upon the foregoing findings, the adoption of the Draft
Negative Declaration is in the public interest
Section 6 Based upon the facts contained in this Resolution, in the Staff
Report and other components of the legislative record, in the proposed Negative
Declaration, and in the public comments received by the Commission, the Planning
Commission hereby adopts the proposed Negative Declaration associated with
Environmental Assessment No. 693 for the proposed Variance No. 418 and Tentative
Parcel Map No 24634 for subdivision of an approximately two (2) acre site into two (2)
40,000 square foot commercial parcels with widths less than those required by the
Municipal Code
PASSED, APPROVED, and ADOPTED this 24th day of June, 1997 by the
following roll call vote:
