A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING
CONDITIONAL USE PERMIT NO. 197 FOR A PROPOSED
UNMANNED CELLULAR ANTENNAE FACILITY INCLUDING
TWO V HIGH BY V WIDE BY 5" THICK ANTENNAE MOUNTED
ON THE BUILDING AND ONE EQUIPMENT BOX LOCATED IN
AN EXISTING STORAGE ROOM, AT THE 7/11 CONVENIENCE
MARKET BUILDING AT 28041 HAWTHORNE BOULEVARD
WHEREAS, on November 20, 1996, the applicant, L A. Cellular, submitted an application
for Conditional Use Permit No 197 to allow a cellular antennae mounted atop the end of the roof
ridge at the 7/11 convenience market building, 28041 Hawthorne Boulevard, and,
WHEREAS, on June 3, 1997, the applicant submitted a revised proposal that includes two
1' high by 1' wide by 5" thick cellular antennae, one installed on an 8" pole attached to the roof
facing Hawthorne Boulevard, and the second mounted to the building facade facing Granvia
Altamira, and,
WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public
Resources Code Sections 21000 et seq ("CEQA!'), the State's CEQA Guidelines, California
Code of Regulation, Title 14, Section 15000 et seq., the City's Local CEQA Guidelines, and
Government Code Section 65962 5(f) (Hazardous Waste and Substances Statement), this
project is categorically exempt from CEQA per Section 15301, and,
WHEREAS, at the request of the Planning Commission, the applicant installed a "mock-
up" of the proposed revised antenna on the subject property from June 10 to June 24, 1997, for
review by the Commission, staff and public, and,
WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes
Development Code, the Planning Commission held a duly noticed public hearing on March 25,
1997, April 29, 1997, May 27, 1997 and June 24, 1997, at which time all interested parties were
given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS
Section 1: The site is adequate in size and shape to accommodate the proposed
antennae as the proposed antennae will be located within an area of the site that is already
developed (mounted to the existing building), and the antennae and equipment will not alter or
interfere with the existing use of the site as a commercial/office building
Section 2: The site for the proposed use relates to streets and highways properly
designed to cavy the type and quantity of traffic generated by the subject use, because although
maintenance vehicles will occasionally visit the site to service the antennas and equipment, the
project will not result in a significant increase in vehicular trips to and from the site, and therefore
will not result in any measurable change to the existing level of service on Hawthorne Boulevard
or Granvia Altamira
Section 3: In approving the subject use at the specific location, there will not be a
significant adverse effect on adjacent property or the permitted use thereof because the proposed
antennae will not cause any significant visual or aesthetic impacts as the revised antennae size
is much smaller and less bulky than previously proposed In addition, since the antennae would
be located more than 170 feet away from the nearest residence to the east and would be
mounted below the level of the roof ridgeline, the proposed project will not cause any significant
view impairment Additionally, the antennae will be painted to match the existing building color
and roof color so that each will almost be unnoticeable as viewed from the surrounding area.
Section 4: The proposed use is not contrary to the General Plan because the project has
been designed to be consistent with the goals and policies of the General Plan, including: '7t is
the goal of the City of Rancho Palos Verdes to preserve and enhance the community's quality
hv►ng environment; to enhance the visual character and physical quality of existing
neighborhoods.. ", and, "It is the policy of the City to develop controls to preserve existing
significant visual aspects from future disruption or degradation", and, "It is the policy of the City
to enhance views and vistas where appropriate through vanous visual accents", and, "It is the
goal of the City of Rancho Palos Verdes to provide for land uses which will be sensitive to and
enhance the natural environment and character of the community ."
Section 5: In providing certain requirements for special setbacks and additional
screening through the use of fencing, painting and landscaping, the project will provide the
minimum necessary safeguards to protect the health, safety and general welfare as the proposed
project is designed and painted to be compatible with and blend into the existing building and
surrounding environment, and because the proposed roof top antennae is set back approximately
170 feet from the nearest residence and is partially screened by placing the antennae below the
ridgeline of the building Additionally, the support equipment will be completely enclosed in an
exiting storage room
Section 6: Any interested person aggrieved by this decision or by any portion of this
decision may appeal to the City Council Pursuant to Section 17.56.070 of the Rancho Palos
Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the
appropriate appeal fee, no later than fifteen (15) days following June 24, 1997, the date of the
Planning Commission's final action
Section 7: For the foregoing reasons and based on the information and findings included
in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Conditional Use Permit No 197, thereby
approving the installation of an unmanned cellular antennae facility, including two 1' high by 1'
wide by 5" thick antennae, and one equipment cabinet, at the 7/11 convenience market building,
28041 Hawthorne Boulevard, subject to the conditions of approval contained in the attached
Exhibit "Xwhich are necessary to protect the public health, safety and welfare.

CONDITIONS OF APPROVAL
CONDITIONAL USE PERMIT NO. 197
28041 HAWTHORNE BOULEVARD
Within thirty (30) days of this approval, landowner shall submit to the City a
statement, in writing, that they have read, understand, and agree to all Conditions
of Approval contained in this document. Failure to provide such statement shall
render this approval null and void.
2. All construction shall be completed in substantial conformance to the plans
approved by the Planning Commission on June 24, 1997
3. This approval is for two 1' high by 1' wide by 5" thick cellular antennae One
antennae is to be mounted on an 8" high pole attached to the roof facing Hawthorne
Boulevard The second antenna shall be mounted on a bracket attached to the
upper portion of the building facade that faces Granvia Altamira. No portion of
either antenna shall extend above the roof ridgeline of the building This approval
is also for one equipment cabinet to be located at grade level within an existing storage
room beneath a stairway on the north side of the building
4. The antenna mounted on the building facade facing Granvia Altamira shall be
painted to match the wall color which the antennae is mounted to The antenna
mounted on the roof facing Hawthorne Boulevard shall be painted and maintained
a color that matches the roof tile color Prior to issuance of a building permit final
inspection, the applicant shall obtain approval from the Director of Planning,
Building and Code Enforcement to ensure that the antennae and all supporting
equipment are painted a color to match the background environment
5 Prior to issuance of building permits, the applicant shall comply with all
recommendations and requirements of the Division of Building and Safety
6 Subject to review and approval by the Director of Planning, Building and Code
Enforcement, If any existing roof tiles need to be replaced as a result of Installing
the proposed antennae and/or wiring, then the replacement roof tiles shall match
the color, size, and materials of existing roof tiles. '
