RESOLUTION NO. 97-29 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 8 - REVISION "B", THEREBY ALLOWING THE MOUNT OLIVE PRESCHOOL TO INCREASE THE ENROLLMENT FROM 45 TO 75 STUDENTS, LOCATED AT 5975 ARMAGA SPRING ROAD WHEREAS, on May 27, 1997, the applicant, Mount Olive Lutheran Church, submitted an application for Conditional Use Permit No. 8-Revision "B" and Environmental Assessment No. 695, to allow the Mount Olive Preschool to increase the enrollment from 45 to 75 students, located at 5975 Armaga Spring road; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"), the State CEQA Guidelines, California Code of Regulations, Title 14, Sections 15000 et. seq., the City's Local CEQA Guidelines, and Government Code Section 65952.5(e) (Hazardous Waste and Substances Statement), the City of Rancho Palos Verdes prepared an Initial Study and determined that there is no substantial evidence that the approval of Conditional Use Permit No. 8 - Revision B, would result in a significant adverse effect on the environment. Accordingly, a Draft Negative Declaration has been prepared and notice of that fact was given in the manner required by law; and, WHEREAS, the Initial Study was prepared on May 6, 1997 and distributed for circulation and review from May 6, 1997 through May 27, 1997; and, WHEREAS, copies of the draft Negative Declaration were distributed to the Planning Commission and prior to taking action on the proposed Conditional Use Permit No. 8 - Revision "B", the Planning Commission independently reviewed and considered the information and findings contained in the Negative Declaration and determined that the document was prepared in compliance with the requirements of CEQA and local guidelines, with respect thereto; and, WHEREAS, after issuing notice pursuant to the requirements of the City's Development Code and the State CEQA Guidelines, the Planning Commission of the City of Rancho Palos Verdes held a public hearing on May 27, 1997, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: The site for the intended use is adequate in size and shape to accommodate said use and for all of the yards, setbacks, walls or fences, landscaping and other features required by this title or by conditions imposed under this section, to adjust 0 0 said use with those on abutting land and within the neighborhood because the minimum setbacks under the Institutional zoning district will be maintained, that the project site has existing permits for signage, landscaping and lighting for the parking facility, and that adequate parking exists on the site to accommodate additional parents dropping-off and picking-up students created by increasing the enrollment. Section 2_ The site for the proposed use relates to streets and highways properly designed to carry the type and quantity of traffic generated by the subject use because the site is served by collector streets and an arterial roadway which are adequate to accommodate the slight increase in the number of trips generated by the project. In addition, the vehicle trip generation to the preschool by parents to dropping-off and pick-up students is staggered through out the day and increasing enrollment by 30 students will not significantly impact the existing public street system of the surrounding neighborhood. Section 3: The proposed use is not contrary to the General Plan because the existing preschool, as an educational facility, is an allowable use in the Institutional- Religious land use designated under the General Plan and increasing the student enrollment will promote the welfare of the City by providing valuable day care facilities. Section 4: In requiring the certain safeguards listed in the following paragraph, the Planning Commission deems said requirements to be the minimum necessary to protect the health, safety and general welfare: special setbacks and buffers, fences and/or walls, lightning, regulation of points of vehicular ingress and egress, regulation of noise, vibration, odors, landscape and maintenance requirements, service road or alley requirements, and other such conditions to make development in an orderly and efficient manner within the City, because the existing circulation pattern is adequate to accommodate the parking requirements of the preschool staff and loading/unloading of students from private vehicles, that the noise level from the preschool playground will not significantly increase by increasing enrollment because the total number of children playing at any given time shall remain unchanged, and that the playground area is adequately fenced to contain the children away adjacent residential neighborhoods, thereby protecting the health, safety and welfare of the community. Section 5: In approving the subject use at the specific location, there will be no significant adverse effect on adjacent property or the permitted use because the project site is zoned Institutional, which allows for educational uses such as day care facilities, that adequate parking exists on the site to accommodate additional parents dropping-off and picking-up students, and that noise impacts from the playground is limited by maintaining the children away from the perimeter of the site and adjacent residential neighborhoods and by limiting the number of children recreating on the playground during any recess period to a maximum of 30 children. Resolution No. 97-29 Page 2 of 4 410 Section 6: For the foregoing reasons and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby approves Conditional Use Permit No. 8 - Revision "B", thereby allowing the Mount Olive Lutheran Church and Preschool to increase the enrollment from 45 to 75 students, located at 5975 Armaga Spring Road, subject to the conditions contained in Exhibit 'A', attached hereto and made a part hereof, which are necessary to protect the public health, safety and welfare in the area. Resolution No. 97-29 Page 3 of 4 • EXHIBIT 'A' CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT NO. 8 - REVISION "B" ( 5975 ARMAGA SPRING ROAD) 1. The maximum enrollment for the preschool shall not exceed 75 students during an academic session. The maximum number of students on the playground at any given recess period shall not exceed 30 children. 2. The hours of operation of the preschool shall be limited to 7:00 a.m. to 6:00 p.m., Monday through Friday. The hours for all recess periods shall be limited to 9:00 a.m. to 4:30 p.m. 3. The applicant shall provide documentation to the Planning Division verifying that the preschool is maintaining the maximum allowable enrollment at the beginning of each academic session. 4. No increase to the existing building footprint is approved as part of this Conditional Use Permit approval. Therefore the following minimum setbacks shall be maintained: Front yard setback: 25' Rear yard setback: 20' Interior Side yard setback: 20' 5. All conditions from the original Conditional Use Permit No. 8 (Resolution 75-37) and Conditional Use Permit No. 8- Revision "A" (Resolution 90-28) shall apply to this application. 6. Any modification to this Conditional Use Permit No. 8 and revision "B" shall require review and approval from the Planning Commission. 7. The applicant shall obtain the necessary permits and licenses required by the State of California Department of Childrens Social Services to operate the day-care facility.
