RESOLUTION NO. 97-27 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 198, TO MODIFY AN EXISTING UNMANNED CELLULAR SYSTEM FACILITY BY RELOCATING SIX EXISTING 60" HIGH ANTENNAE AND ADDING TWO NEW 60" HIGH ANTENNAE AND RELATED NEW SCREENING, LOCATED AT 500 SILVER SPUR ROAD WHEREAS, on December 19, 1996, the applicant, L.A. Cellular, submitted an application for Conditional Use Permit No 198 to allow a modification to an existing cellular facility by relocating six existing 60" high antennae and adding two additional 60" high antennae with new screening ranging from 5.5 to 6.5' higher than the existing rooftop parapet at 500 Silver Spur Road, and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et seq., the City's Local CEQA Guidelines, and Government Code Section 65962 5(f) (Hazardous Waste and Substances Statement), this project is categorically exempt from CEQA per Section 15301, and, WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on May 13, 1997, at which time all interested parties were given an opportunity to be heard and present evidence Section 1: The site is adequate in size and shape to accommodate the proposed antennae as the proposed antennae will be located within an area of the site that is already developed (mounted on the roof of the existing building), and the antennae will be located more than 250 feet from the nearest residential area to the east, and the antennae and equipment will not alter or interfere with the existing use of the site as an office building Section 2: The site for the proposed use relates to streets and highways properly designed to cavy the type and quantity of traffic generated by the subject use, because although maintenance vehicles will occasionally visit the site to service the antennas and equipment, the project will not result in a significant increase in vehicular trips to and from the site, and therefore will not result in any measurable change to the existing level of service on Silver Spur Road Section 3: In approving the subject use at the specific location, there will not be a significant adverse effect on adjacent property or the permitted use thereof because the proposed antennae will not cause any significant visual or aesthetic impacts as the antennae are setback from the existing building edge/parapet and they will be screened by a fiberglass material that will be compatible with the existing rooftop mechanical equipment screening and the colors of the existing building Section 4: The proposed use is not contrary to the General Plan because the project has been designed to be consistent with the goals and policies of the General Plan, including- "it is the goal of the City of Rancho Palos Verdes to preserve and enhance the community's quality living environment, and, "It is the policy of the City to develop controls to preserve existing significant visual aspects from future disruption or degradation"; and, "It is the goal of the City of Rancho Palos Verdes to provide for land uses which will be sensitive to and enhance the natural environment and character of the community " Section 5: In providing certain requirements for special setbacks and additional screening, the project will provide the minimum necessary safeguards to protect the health, safety and general welfare as the proposed project is designed and painted to blend in with the surrounding environment. Section 6: Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council. Pursuant to Section 17 56 070 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the appropriate appeal fee, no later than fifteen (15) days following May 13, 1997, the date of the Planning Commission's final action Section 7: For the foregoing reasons and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby approves Conditional Use Permit No 198, thereby approving the amendment to an existing unmanned cellular facility, including relocating six 60" high antennae, adding two new 60" high antennae, and adding new 5.5' high to 6 5' high screening on the existing roof at 500 Silver Spur Road, subject to the conditions of approval contained in Exhibit "A", attached hereto and made a part -thereof, which are necessary to protect the public health, safety and welfare. NOES ABSTENTIONS ABSENT Carolynn PeWu Director of Planning, Budding and Code Enforcement, and, Secretary to the Planning Commission Donald E Vannorsdall Chairman PC Resolution No 97- 2 7 Page 3 of 4 EXHIBIT "A" CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT NO. 198 500 SILVER SPUR ROAD Within thirty (30) days of this approval, landowner shall submit to the City a statement, in writing, that they have read, understand, and agree to all Conditions of Approval contained in this document. Failure to provide such statement shall render this approval null and void 2. All construction shall be completed in substantial conformance to the plans approved by the Planning Commission on May 13, 1997. 3. This approval is for the relocation of six existing 60" high antennae, the addition of two new 60" high antennae, and the addition of a 5.5' and a 6.5' high screen on the roof of the existing building. 4 Prior to issuance of a building permit final inspection, the applicant shall obtain approval from the Director of Planning, Building and Code Enforcement to ensure that the antennae and all supporting equipment are of a texture and are painted a color to match the surrounding env ironment/structures 5 Prior to issuance of building permits, the applicant shall comply with all recommendations and requirements of the Division of Building and Safety N1GROUPIPiANNINGIRESOSIPCIRECUP198 RES P.C.
