A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING COASTAL
PERMIT NO. 138, FOR A PROPOSED UNMANNED PERSONAL
COMMUNICATION SYSTEM (PGS) FACILITY INCLUDING FOUR
PANEL ANTENNAE AND TWO EQUIPMENT BOXES, LOCATED
IN THE NON APPEALABLE AREA OF THE COASTAL ZONE AT
ST. PETER'S BY THE SEA CHURCH, 6412 PALOS VERDES
DRIVE SOUTH
WHEREAS, on November 19, 1996, in conjunction with an application for Conditional Use
Permit No 194 submitted on September 23, 1996, the applicant, Pacific Bell Mobile Services,
submitted an application for Coastal Permit No 138 to allow a personal communications systems
(PCS) facility consisting of two cross polar antennae mounted atop the existing church roof ridge,
and two equipment cabinets mounted at grade at St. Peter's by the Sea Church, 6412 Palos
Verdes Drive South, and on April 21, 1997, the applicant submitted a revised project that
replaced the proposed antennae mounted atop the existing church with four panel antennae (two
on each side of the church) to be mounted on the end of the existing beams used to support the
roof, and,
WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public
Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines, California
Code of Regulation, Title 14, Section 15000 et seq , the City's Local CEQA Guidelines, and
Government Code Section 65962.5(f) (Hazardous Waste and Substances Statement), this
project is categorically exempt from CEQA per Section 15301; and,
WHEREAS, after nonce issued pursuant to the requirements of the Rancho Palos Verdes
Development Code, the Planning Commission held a duly noticed public hearing on January 28,
1997, February 25, 1997, March 25, 1997, April 22, 1997 and April 29, 1997, at which time all
interested parties were given an opportunity to be heard and present evidence
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: The proposed project site is located within the non -appealable area of the
Coastal Zone Therefore, the City's final decision on this permit cannot be appealed to the
California Coastal Commission
Section 2: That the proposed development is in conformance with the coastal specific
plan, because within the coastal specific plan there are planning and design guidelines whose
purpose "is to insure that areas between developments and at the interface between pnvate and
public areas are planned, designed, and appropriately developed with compatible uses and
landscape treatments" Further, one of the structural design guidelines indicates, 'Wo external
masted antennas of any type should be permitted on any structure". The proposed antennae is
not considered to be "masted antennae", and the proposed antenna will not create an aesthetic
or visual impact, which is what this guideline is intended to eliminate, since the antenna will be
mounted directly onto the eave beams and will be painted to match the eave color As such, the
proposed project is consistent with this guideline, and the purpose of the design guidelines.
Section 3: That since the subject site is not located between the sea and the first public
road, the second finding required for approval of a Coastal Permit, "the proposed development,
when located between the sea and the first public road, is In conformance with applicable public
access and recreation policies of the Coastal Act", is not applicable to this project.
Section 4: Any interested person aggrieved by this decision or by any portion of this
decision may appeal to the City Council. Pursuant to Section 17 67 070 of the Rancho Palos
Verdes Municipal Code, any such appeal must be filed with the City, in writing, no later than
fifteen (15) days following April 29, 1997, the date of the Planning Commission's final action
Section 5: For the foregoing reasons and based on the information and findings included
in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Coastal Permit No 138, thereby approving the
installation of an unmanned PCS facility, including four panel antennae (two mounted at each end
of the church) and two equipment cabinets mounted at grade at St Peter's by the Sea Church,
6412 Palos Verdes Drive South
