RESOLUTION NO. 97-10 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 96 -REVISION 'C', THEREBY APPROVING ADDITIONS TOTALLING 3,189 SQUARE FEET TO TEN (10) ELEMENTARY CLASSROOMS IN TWO (2), EXISTING SINGLE -STORY CLASSROOM BUILDINGS AT ST. JOHN FISHER SCHOOL, LOCATED AT 5448 CREST ROAD WHEREAS, on December 9, 1996, the applicant, the Roman Catholic Archdiocese of Los Angeles, submitted an application for Conditional Use Permit No. 96-Revision'C' to allow the addition of computer labs to ten (10) elementary classrooms at St John Fisher School on Crest Road; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et seq ("CEQA:'), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et seq., the City's Local CEQA Guidelines, and Government Code Section 65962 5(f) (Hazardous Waste and Substances Statement), Staff found no evidence that Conditional Use Permit No 96 -Revision 'C' would have a significant effect on the environment and, therefore, the proposed project has been found to be categorically exempt (Class 1, Section 15301(e)(2)); and, WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on February 11, 1997, at which time all interested parties were given an opportunity to be heard and present evidence NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS Section 1: That the site for the intended use is adequate in size and shape to accommodate said use and for all of the yards, setbacks, walls or fences, landscaping and other features required by this title [Title 17 "Zoning"] or by conditions imposed under this section [Section 17 56 060] to adjust said use to those on abutting land and within the neighborhood because the project results in a negligible decrease in open space area; the proposed additions substantially exceed the minimum front- and side -yard setback requirements, and additional parking will be provided to bring the site back into conformance with previous City approvals. Section 2: That the site for the proposed use relates to streets and highways properly designed to carry the type and quantity of traffic generated by the subject use because access to the site is provided by Crenshaw Boulevard and Crest Road, which are major arterial roadways, and the expansion of the classrooms will result in neither increased numbers of school staff nor significant additional enrollment, thereby creating no significant increase in trips or decrease in the level of service of surrounding streets and intersections Section 3: That, in approving the subject use at the specific location, there will be no significant adverse effect on adjacent property or the permitted use thereof because the distance and vertical separation of the project site from surrounding residences and streets reduces or eliminates any public or private view impairment; the site is adequately served by public services and facilities to allow for development consistent with the General Plan, and project site is not environmentally sensitive. Section 4: That the proposed use is not contrary to the General Plan because it is consistent with the Institutional land use designation, is consistent with Institutional Activity Policy No 1 to "[locate] schools on or near major arterials or collectors, buffered from residential uses, and provide adequate parking and automobile access", and implements a stated goal of the Urban Environment Element of the General Plan to "encourage the development of institutional facilities to serve the political, social and cultural needs of [the City's] citizens " Section 5: That, in providing certain requirements for setbacks, parking and phasing, the project will provide the minimum necessary safeguards to protect the health, safety and general welfare Section 6: Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council Pursuant to Section 17 56 070 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the appropriate appeal fee, no later than fifteen (15) days following February 11, 1997, the date of the Planning Commission's final action Section 7: For the foregoing reasons and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby approves Conditional Use Permit No 96-Revision'C', thereby approving additions totalling 3,189 square feet to ten (10) elementary classrooms in two (2), existing single -story classroom buildings at St. John Fisher School, located at 5448 Crest Road, subject to the conditions contained in Exhibit 'A', attached hereto and made a part hereof, which are necessary to protect the public health, safety and welfare in the area PC Resolution No 97-10 Page 2 of 5 0 PASSED, APPROVED, AND ADOPTED this 11th day of February 1997, by the following vote AYES: Commissioners Alberio, Cartwright, Clark, Ng, Slayden, Vice Chairman Whiteneck, and Chairman Vannorsdall NOES: ABSTENTIONS 91MVATI M-*-- 0 R I I Chairman W" Carolynn Fkbtru Director of Planning, Building and Code Enforcement, and, Secretary to the Planning Commission P.C. Resolution No 97-10 Page 3 of 5 L] EXHIBIT 'A' • CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT NO. 96 -REVISION 'C' (5448 Crest Road) A. General Conditions: 1) Within thirty (30) days following adoption of this Resolution, the applicant and the property owner shall submit to the City a statement, in writing, that they have read, understand, and agree to all conditions of approval contained in this Resolution Failure to provide said written statement shall render this approval null and void 2) This approval is for additions totalling 3,189 square feet in two (2) phases to ten (10) elementary classrooms at St John Fisher School at 5448 Crest Road The maximum height of both phases is fourteen feet six inches (14'6"), which is the height of the ridgeline of the existing buildings The Phase I addition of 1,269 square feet shall maintain a front -yard setback from Crest Road of seventy-five feet nine inches (769") The Phase 11 addition of 1,920 square feet shall maintain a front -yard setback from Crest Road of seventy-four feet four inches (74'4") and a side -yard setback of eighty-three feet (83'0") Any change shall require approval of a further revision to Conditional Use Permit No. 96 by the Planning Commission and shall require a new and separate environmental review 3) All project development on the site shall conform to the specific standards contained in these conditions of approval or, if not addressed herein, in the I district development standards of the City's Municipal Code Failure to comply with and adhere to all of these conditions of approval will be cause to revoke the approval of the project 4) If the Phase I addition has not been established (i.e., building permits obtained) within two (2) years of the effective date of this Resolution, or if construction has not been completed on both Phase I and Phase 11 additions within five (5) years of the issuance of building permits for the Phase I addition or within two (2) years of the issuance of building permits for the Phase II addition (whichever occurs first), approval of the project shall expire and be of no further effect unless, prior to expiration, a written request for extension is filed with the Department of Planning, Building and Code Enforcement and approved by the Planning Commission Otherwise, a conditional use permit revision must be approved prior to further development PC Resolution No 97-10 Page 4of5 5) In the event that any of these conditions conflict with the recommendations and/or requirements of another permitting agency or City department, the stricter standard shall apply. 6) Unless otherwise designated in these conditions, all construction shall be completed in substantial conformance with the plans submitted to the City on January 13, 1997 7) The hours of construction shall be limited to 7.00 AM to 7.00 PM, Monday through Saturday No construction shall be permitted on Sundays or on legal holidays 8) No grading is permitted by this approval 9) All other conditions of approval of P.C. Resolution No 85-6, approving Conditional Use Permit No 96, remain in effect B. Prior to the issuance of Building Permits for each phase: 10) The applicant shall submit plans to the Planning Division for planning clearance Plans for Phase 11 of the project shall substantially conform to the site plan, Phase I floor plans and Phase I elevations submitted to the City on January 13, 1997 The colors and materials for both Phase I and Phase II shall be the same as or substantially similar to each other and to those of the existing classroom buildings C. Prior to Building Permit final for Phase l: 11) Notwithstanding the plans submitted to the City on January 13, 1997, the applicant shall submit a revised site and parking plan for the project for the review and approval of the Director of Planning, Budding and Code Enforcement The revised plan shall provide for four (4) additional off-street parking spaces, above and beyond the four (4) new spaces near the convent as shown on the plans submitted to the City on January 13, 1997 A total of three hundred fifty-nine (359) off-street spaces shall be provided for the entire site, as required by the approval of Variance No 116 on April 9, 1985 M \USERS\KITF\WPWIN60\PROJECTS\CUP96RC\CUP96RC RES PC Resolution No 97-10 Page 5 of 5
