RESOLUTION NO. 97-6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES RECOMMENDING ADOPTION OF A NEGATIVE DECLARATION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, AND RECOMMENDING APPROVAL OF GENERAL PLAN AMENDMENT NO. 23, COASTAL SPECIFIC PLAN AMENDMENT NO. 6, AND ZONE CHANGE NO. 25 TO THE CITY COUNCIL FOR THE PROPERTIES LOCATED AT 6108, 6118, AND 6124 PALOS VERDES DRIVE SOUTH. WHEREAS, on June 26, 1975, the City Council of the City of Rancho Palos Verdes approved and adopted Resolution No 75-43 adopting the General Plan of the City of Rancho Palos Verdes which applied a Land Use Designation of Residential (2 to 4 dwelling units per acre) to properties at 6108, 6118, and 6124 Palos Verdes Drive South, and, WHEREAS, commercial office uses existed on properties at 6108 and 6118 Palos Verdes Drive South at the time of adoption of the City's General Plan and those uses became pre-existing nonconforming uses upon adoption of the General Plan and application of the Single Family Residential RS4 Zone to those properties; and, WHEREAS, the commercial office uses have been continued on the properties at 6108 and 6118 Palos Verdes Drive South for over twenty-six years since the adoption of the General Plan and such uses are expected to continue into the future due to the existence of commercial structures on the sites, and, WHEREAS, the property at 6124 Palos Verdes Drive South was used as a fire station, which is an institutional land use, at the time of adoption of the City's General Plan, and which became a pre-existing non -conforming use upon adoption of the General Plan and application of the Single Family Residential RS4 Zone to the property, and, WHEREAS, the institutional use has been continued on the property at 6124 Palos Verdes Drive South for over twenty-six years since the adoption of the General Plan and such use is expected to continue into the future due to the existence of the fire station structure on the site; and, WHEREAS, on December 19, 1978 the City Council of the City of Rancho Palos Verdes adopted Resolution No 78-81 which adopted the Coastal Specific Plan of the City of Rancho Palos Verdes, and which included land use designation of Residential (2-4 dwelling units per acre) for properties at 6108, 6118, and 6124 Palos Verdes Drive South; and, -1- WHEREAS, the on-going commercial uses at 6108 and 6118 Palos Verdes Drive South, and institutional uses on property at 6124 Palos Verdes Drive South, are pre-existing nonconforming uses with respect to the Coastal Specific Plan land use designation, and, WHEREAS, on July 5, 1996, the City Council of the City of Rancho Palos Verdes considered a General Plan Initiation Request and directed staff to initiate a General Plan Amendment I Zone Change to consider amendments that would make the existing and on-going land uses at 6108, 6118, and 6124 Palos Verdes Drive South legal uses in conformance with the General Plan Land Use Designations and Zoning of the sites, and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et seq ("CEQA"), the State CEQA Guidelines, California Code of Regulations, Title 14, Sections 15000 et seq , the City's Local CEQA Guidelines, and Government Code Section 65952 5(e) (Hazardous Waste and Substances Statement), the City of Rancho Palos Verdes prepared an Initial Study and determined that there is no substantial evidence that the approval of General Plan Amendment No 23, Coastal Specific Plan Amendment No. 6, and Zone Change No 25 would result in a significant adverse effect on the environment Accordingly, a Draft Negative Declaration has been prepared and notice of that fact was given in the manner required by law, and, WHEREAS, after issuing notice pursuant to the requirements of the City's Development Code and the State CEQA Guidelines, the Planning Commission of the City of Rancho Palos Verdes held public hearings on December 10, 1996 and January 14, 1997 at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES HEREBY FINDS, DETERMINES, AND RESOLVES AS FOLLOWS. Section 1: The Planning Commission has reviewed and considered the proposed Negative Declaration, the public comments upon it, and the other evidence before the Commission and finds that the Negative Declaration was prepared in a manner required by law, that there is no substantial evidence that the adoption of the General Plan Amendment, Coastal Specific Plan Amendment, and Zone Change would have a significant effect on the environment, and that no mitigation measures are necessary to eliminate significant environmental effects of the proposed project Section 2: The Planning Commission finds that the approval of these land use amendments and zone changes will not result in significant adverse environmental impact because the revised general plan, coastal- specific plan, and zoning designations would be consistent with the existing use of the sites and a development agreement -2- PC RESOLUTION NO 87-6 PAGE 2OF4 would accompany the changes to further control the impacts of the operation of businesses at 6108 Palos Verdes Drive South. Section 3- That although the Negative Declaration analyzes the environmental impacts associated with General Plan Amendment No 23, Coastal Specific Plan Amendment No 6, and Zone Change No. 25, separate environmental review will be performed for any projects requiring a building permit on each of the sites prior to receiving any approvals from the Department of Planning, Building and Code Enforcement Section 4. That the proposed amendments are not contrary to the General Plan, since consistency between the historic use of the sites and the land use regulations applicable to the sites will result. Section 5 The Planning Commission finds that the sites are suitable for commercial and institutional uses since the properties are located adjacent to a major arterial roadway, due to the existing improvements on the sites, and due to the drainage channel (lower Barkentine Canyon) to the south of the subject properties which serves as a buffer between neighboring residential uses. Section 6 The Planning Commission finds that existing agreements between the property owner of 6118 Palos Verdes Drive South and the City address requirements for parking at the site through provision of additional off-site parking at the City -owned flower stand parking area at the southwest corner of Seacove Drive and Palos Verdes Drive South (Abalone Cove Shoreline Park), and that the continued commercial/office use will not result in parking problems due to restrictions and provisions of the agreement. Section 7 The Planning Commission finds that the uses permitted by the proposed general plan land use designation, coastal specific plan land use designation, and zoning at 6108 Palos Verdes Drive South would be compatible with surrounding development because a development agreement will be executed between the City and the property owner to control the use and operation of the site The development agreement is found to be necessary in order to address parking requirements, and to ensure the provision of adequate parking near the site for any potential future commercial uses Section 8 The Planning Commission finds that the development standards of the Commercial Professional (CP) zone are most consistent with the existing site uses and development at 6108 and 6118 Palos Verdes Drive South, and that the development standards of the Institutional (1) zone are most consistent with the existing site uses and development 6124 Palos Verdes Drive South However, application of these zones will result in nonconforming structures on the sites as the existing structures do not comply with all of the standards set forth in the proposed zones -3- P C RESOLUTION NO 97-6 PAGE 3 OF 4 n n Section 9 Based upon the foregoing findings, the adoption of the Draft Negative Declaration is in the public interest Section 10: Based upon the facts contained in this Resolution, in the Staff Report and other components of the legislative record, in the proposed Negative Declaration, and in the public comments received by the Commission, the Planning Commission hereby recommends that the City Council of the City of Rancho Palos Verdes adopt the proposed Negative Declaration associated with Environmental Assessment No 686 and approve General Plan Amendment No. 23, Coastal Specific Plan Amendment No 6, and Zone Change No 25 to change the land use and zoning designation on the properties located at 6108 and 6118 Palos Verdes Drive South from Residential to Commercial (office) and the property located at 6124 Palos Verdes Drive South from Residential to Institutional This Resolution shall be transmitted to the City Council and shall constitute the written recommendation required by Section 65354 of the Government Code.
