PC RES 1996-016 P.C. RESOLUTION NO. 96 - 16 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 190 TO ALLOW A PERSONAL COMMUNICATION SERVICE (PCS) FACILITY AT GREEN HILLS MEMORIAL PARK AT 27501 SOUTH WESTERN AVENUE. WHEREAS, on January 29, 1996, Pacific Bell Mobile Services submitted applications for Conditional Use Permit No. 190 and Environmental Assessment No. 681 to allow a Personal Communication (PCS) Facility, which consists of four wall mounted panel antennas with equipment boxes to be located under the ridgeline of an existing 24'- 9" high mausoleum and two base transceiver stations located on the ground adjacent to the mausoleum at the property located at 27501 South Western Avenue; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA guidelines, California Code of Regulation, Title 14, Section 15000 et. seq., the City's Local CEQA Guidelines, and Government Code Section 65952.5(e) (Hazardous Waste and Substances Statement), the City determined that the proposed project would not result in potentially significant adverse effects on the environment in terms of risk to human health and aesthetics. Accordingly, the City determined that the project is Categorically Exempt (Class I); and, WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code, a public hearing was held on June 25, 1996, before the Planning Commission of the City of Rancho Palos Verdes, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the site is adequate in size and configuration to accommodate the proposed four antenna panels and associated equipment boxes since the subject property is 4,845,000 square feet is size and the proposed project will be located within an area of the site that is already developed and the antenna panels will be attached to the wall of an existing mausoleum. In addition, the antennas and associated equipment will be located more than 160 feet away from the nearest single family residential area to the north and the placement of the antennas and equipment would not alter or interfere with the existing use of the site as a cemetery. Section 2: That the streets and highways serving the site are properly designed to carry the type and quantity of traffic generated by the proposed, since the subject property is located on Western Avenue, which is identified in the General Plan as a major arterial roadway. Although maintenance vehicles will occasionally visit the site to service the antennas and equipment, the project will not result in a significant increase in vehicular trips to and from the site, therefore, the project will not result in any measurable change to the existing level of service on Western Avenue. Section 3: That, in approving the subject use at the specific location, there will be no significant adverse effect on adjacent property or the permitted use thereof, since the existing mausoleum is located in the northeast corner of the cemetery site and is surrounded by landscaping, including some mature trees. Although, this mausoleum is partially visible from Western Avenue, the proposed antenna panels and equipment will not be visible from this roadway, since they are located on building elevations that face away from the street. In addition, since the panels will be mounted flush to the building and due to the significant distance from theproperty lines, the project will not create an adverse visual effect as viewed form the adjacent properties. Furthermore, no adverse impacts including light, glare, or noise will result from the proposed project (other than some slight and temporary increase in noise and associated factors during the construction process). Section 4: That the proposed use is not contrary to the General Plan, since the subject site is designated in the General Plan as a Cemetery land use. The proposed project would not change in the overall land use of the site and would not create and adverse impacts to surrounding properties. Furthermore, Conditions of Approval have been incorporated into the project in the attached Exhibit "A", in order to maintain a harmonious correlation with the adjacent land uses and access conditions. Section 5: That, in requiring certain requirements, which are incorporated into the Conditions of Approval for the project in the attached Exhibit "A", the project will provide the minimum necessary safeguards to protect the health, safety and general welfare, since the proposed antenna panels and equipment boxes would comply with the minimum required setbacks and would not exceed the established 24'-9" high ridgeline of the existing mausoleum. Furthermore, the antenna panels and equipment will not impact the views from the surrounding properties, since they would be adequately buffered by the large setback distances and screened by the existing mature foliage. In addition, the antenna panels and equipment would not be visible from the public right-of-way along Western Avenue. P.0 Resolution No. 96-16 Page 2 Section 6: Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council. Pursuant to Section 17.56.070 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing and with the appropriate appeal fee, no later than fifteen (15) days following June 25, 1996, the date of the Planning Commission's final action. Section 7: For the foregoing reasons and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby approves Conditional Use Permit No. 190 for the unmanned Personal Communication Service (PCS) Facility at Green Hill Memorial Park located at 27501 S. Western Avenue, subject to the conditions of approval in the attached Exhibit "A", which are necessary to protect the public health, safety and welfare in the area. WESTERN AVENUE 1. Within thirty (30) days following adoption of this Resolution, the applicant and the property owner shall submit to the City a statement, in writing, that they have read, understand, and agree to all Conditions of Approval contained in this Resolution. Failure to provide said written statement shall render this approval null and void. 2. All project development on the site shall conform to the specific standards contained in these conditions of approval or if not addressed herein, the Cemetery development standards of the City's Municipal Code. Failure to comply with, and adhere to, all of these Conditions of Approval will be cause to revoke the approval of the project. Any change shall require approval of a revision to Conditional Use Permit No. 190 by the Planning Commission and shall require a new and separate permit(s). 3. This approval is for a total of four panel antennas and four equipment boxes to be mounted on the mausoleum located at northeast portion of the property. Two panel antennas and two equipment boxes shall be mounted on the west elevation of the mausoleum and two panel antennas and two equipment boxes shall be mounted on the south elevation. All panels and boxes shall be flush mounted to the building facade and no portion of the panels or boxes shall exceed the ridgeline of the mausoleum. 4. The two base transceiver units shall be located on a concrete pad adjacent to the north elevation of the mausoleum. These units shall be screened and/or covered so that they are not visible or audible from adjacent residential properties, as approved by the Director of Planning, Building and Code Enforcement. 5. If the Personal Communication Services (PCS) Facility has not been initiated (Building Permits obtained) within two years of the date final approval for Conditional Use Permit No. 190 or if construction has not been completed to the within two years of Building Permit issuance, approval of the project applications shall expire and be of no further effect, unless, prior to expiration, a written request for extension is filed with the Department of Planning, Building, and Code Enforcement and approved by the Planning Commission. Otherwise a new Conditional Use Permit must be approved prior to further development. P.0 Resolution No. 96-16 Page 4 6. In the event that any of these conditions conflict with the recommendations and or requirements of another permitting agency or City department, the stricter standard shall apply. 7. The hours of construction shall be limited to 7:00 a.m. to 7:00 p.m., Monday through Saturday. No construction shall be permitted on Sunday or on legal holidays. 8. Unless otherwise designated in these conditions, all construction shall be completed in substantial conformance to the plans as submitted to the City on January 29, 1996. 9. The construction site shall be kept free of all loose material resembling trash debris in excess of that material used for immediate construction purpose. Such excess material may include, but not be limited to: accumulation of debris, garbage, lumber, scarp metal, concrete, asphalt, piles of earth salvaged materials abandoned or discarded furniture, appliances, or other household fixtures.
