RESOLUTION NO. 96-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING COASTAL PERMIT NO. 131, THEREBY APPROVING THE REQUEST TO CONSTRUCT A NEW 12,588 SQUARE FOOT MULTI-LEVEL HOME AND ACCESSORY STRUCTURES WITHIN THE CITY'S COASTAL ZONE AT 7 MARGUERITE DRIVE WHEREAS, the applicant, Mr. Brad Ellis, representing the property owner, Mr Don Glass, has submitted an application for Coastal Permit No 131, to allow the contruction of a new 12,588 square foot multi-level home and accessory structures on a vacant lot within the City's Coastal Zone, and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 2100 et seq ("CEQA"), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et seq , the City's Local CEQA Guidelines, and Government Code Section 65952 5(e) (Hazardous Waste and Substances Statement), Staff found no evidence that Coastal Permit No 131 would have a significant effect on the environment Accordingly, the proposed project has been deemed to be categorically exempt (Class II and III), and, WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on June 25, 1996, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS Section 1: That the proposed project is in conformance with the Coastal Specific Plan since it represents residential activity which is the most compatible use for the area from both a physical and fiscal perspective according to the Subregion's policies It is more compatible with the area than commercial or institutional uses, and fiscally it is more sound than recreational or large scale agricultural uses Additionally, it is a policy of this subregion to require proposed developments on lands affected by view corridors to maintain the resource which will be accomplished by the project Section 2: That the proposed development, when located between the sea and the first public road, is in conformance with the applicable public access and recreation policies of the Coastal Act since the project will be located on a private, residential lot, will that will not interfere with the area's provisions for public access and coastal recreational activities There are two public access corridors (existing and proposed) adjacent to the subject property within the Lunada Point subdivision and the property owned by the Japan Leasing Company (to the south of the subject lot) and to the north of the applicant's lot, in the City of Palos Verdes Estates. The construction of the proposed residence and accompanying improvements will not have any impacts to these public access points Section 3: Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council Pursuant to Section 17.67.070 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the appropriate appeal fee, no later than fifteen (15) days following June 25, 1996, the date of the Planning Commission's final action Section 4: For the foregoing reasons and based on the information and findings included in the Staff Report, minutes, and all other records of the proceedings, the Planning Commission hereby grants Coastal Permit No. 131, to allow the construction of a new 12, 588 square foot multi-level single family residence and accessory structures at 7 Marguerite Drive, subject to the Conditions of Approval contained in the attached Exhibit "A", which are necessary for the public's general health, safety, and welfare PASSED, APPROVED, AND ADOPTED this 25th day of June 1996, by the following vote AYES- Commissioners Alberio, Cartwright, Franklin, Ng, Vannorsdall, Whiteneck, and Chairman Clark. Resolution No. 96-15 Page 3of3 EXHIBIT "A" CONDITIONS OF APPROVAL FOR GRADING PERMIT NO 1877 (7 MARGUERITE DRIVE) 1) The maximum ridge elevation of the house as measured from pad elevation 247 0' shall not exceed 2604' The maximum downslope elevation of the house shall not exceed 260 4', as measured from pad elevation 230 4' RIDGE HEIGHT ELEVATION CERTIFICATION REQUIRED 2) The maximum height of the pool accessory structure shall not exceed 12 feet as measured from grade adjacent to the foundation wall to the ridge RIDGE HEIGHT CERTIFICATION REQUIRED 3) The maximum height of the tennis court accessory structure shall not exceed 12 feet as measured from grade adjacent to the foundation wall to the ridge RIDGE HEIGHT CERTIFICATION REQUIRED 4) The following minimum setbacks shall be adhered to front yard 20'-0" side yard (min to both sides) 25'-0" side yard (min to one side) 10'-0" street side yard 15'-0" rear yard 20'-0" 5) A minimum of 75% open space shall be maintained on the subject property Any additional lot coverage in the future shall first be reviewed and approved by the Planning, Building, and Code Enforcement Department. 6) The maximum eave projection into any required setbacks shall not exceed 4 inches for each 1'-0" of required setback. 7) The project shall be constructed in substantial conformance with the plans date stamped as received on April 18, 1996 8) The perimeter fencing and pilasters along the east (Palos Verdes Drive West) and south (Marguerite Drive) property lines shall not exceed 42 inches in overall height (including any lighting) If the applicant desires to pursue fencing (material which would allow 90% light and air to penetrate [except for chain link]) up to 6 feet in height, or a combination of 42 inch solid material and the remainder (up to 6 feet) of the fence to be a material which would allow 90% light and air to penetrate, an application for a Minor Exception Permit must be submitted to the Director of Planning, Building, and Code Enforcement for review and approval Exhibit "A" Conditions of Approval for Grading Permit No. 1877 7 Marguerite Drive 9) The perimeter fencing and pilasters (and gates) along the north and west property lines shall not exceed 6 feet in overall height (including any lights) [Note: That portion of the fence along the west property line that lies within the front yard setback area shall be limited to 42 inches in height. For fencing up to 6 feet in height, the applicant shall follow the procedure outlined in Condition #8 (for approval of an application for a Minor Exception Permit. 10) The immediate area surrounding the pool shall be fenced with appropriate pool safety fencing (minimum 5'-0" in height/up to 6'-0" in height) along with self latching and self locking gates prior to the plastering of the pool, or the applicant shall follow the procedure outlined in Condition #8 to appropriately fence the perimeter of the lot, again, prior to plastering of the pool 11) The maximum height of the fencing around the tennis court shall not exceed 6 feet in height If the applicant desires to pursue fencing above 6 feet in height and up to 10 feet in overall height, an application for a Minor Exception Permit shall be submitted to the Director of Planning, Building, and Code Enforcement for review and approval. 12) In the event that a Planning requirement and Building & Safety requirement are in conflict with one another, the stricter standard shall apply 13) The construction site shall be kept free of all loose materials resembling trash and debris in excess of that material used for immediate construction purposes Such excess material may include, but is not limited to the accumulation of debris, garbage, lumber, scrap metal, concrete, asphalt, piles of earth, salvage materials, abandoned or discarded furniture, appliances or other household fixtures. 14) A completed and notarized City of Rancho Palos Verdes "Covenant to Protect Views" form shall be submitted to the Planning Department prior to the submittal of the approved plans into the Building and Safety Division's Plan Check process. 15) A minimum two car garage with a minimum interior dimension of 18 feet in width and 20 feet in depth, shall be provided on the site and shall be maintained for the storage of vehicles only. Exhibit "A" Conditions of Approval for Grading Permit No. 1877 7 Marguerite Drive 16) No lighting around the tennis court has been approved with this permit 17) The maximum quantity of grading for the project shall not exceed 5,128 cubic yards, broken down as follows. cut- under house footprint- 688 cubic yards outside house footprint. 1,876 cubic yards fill under house footprint: 356 cubic yards outside house footprint 2,208 cubic yards 18) No material shall be hauled off of the site and no additional material shall be brought onto the site 19) The construction of the retaining walls shall substantially conform to the configuration, location, and heights, as depicted on the plans date stamped as received by the City on April 18, 1996 No additional retaining walls shall be constructed without the review and approval by the Director of Planning, Building, and Code Enforcement or the Planning Commission if necessary 20) The maximum grade of the driveway shall not exceed 20%. 21) Construction hours shall be limited from 7.00 a m to 7 00 p m , Monday through Saturday only.
