PC RES 1996-011P.C. RESOLUTION NO. 96-11 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES FORWARDING A FINDING TO THE CITY COUNCIL THAT THE PROPOSED VACATION OF THE PORTION OF THE NARBONNE AVENUE ROAD EASEMENT LOCATED BETWEEN SUNNYSIDE RIDGE ROAD AND PALOS VERDES DRIVE EAST IS CONSISTENT WITH THE GOALS AND POLICIES OF THE GENERAL PLAN WHEREAS, the applicant, The Nazarian Corporation, submitted a request to vacate the portion of the Narbonne Avenue road easement located between Sunnyside Ridge Road and Palos Verdes Drive East; and, WHEREAS, on July 16, 1995, the City Council authorized the applicant to proceed with the request, following the City-wide Street Vacation Procedures established in Resolution No 90-93, and, WHEREAS, on April 29, 1996, the Traffic Committee reviewed the applicant's request with respect to traffic and circulation issues and recommended that the applicant be permitted to continue with the Street Vacation Procedures, and, WHEREAS, on May 8, 1996, the Recreation and Parks Committee reviewed the applicant's request with respect to public trails issues and recommended that the applicant be required to dedicate a pedestrian/equestrian trail easement on the property and make a cash payment in an amount sufficient to construct the trail and appropriate signage, and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Section 2100 et. seq (CEQA), the State CEQA Guidelines, California Code of Regulation, Title 14, Sections 15000 et. seq , the City's Local CEQA Guidelines, and Government Code Section 65952.5(e) (Hazardous Waste and Substances Statement), the City of Rancho Palos Verdes reviewed the request and determined that the proposed request would not have a significant impact on the environment and has, therefore, been determine to be categorically exempt (Class 1), and, WHEREAS, the Planning Commission conducted a hearing on May 28, 1996, at which time all interested parties were given an opportunity to be heard and present evidence NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS Section 1 That the road easement is not needed as a thoroughfare in the collector and arterial network, since the Traffic Committee has determined that there is no immediate or future need to develop this roadway easement as a public street This is so, since the extension of Narbonne Avenue was never completed by the County due to difficult topography and the alternate route provided by Palos Verdes Drive East Therefore, when the City acquired the easement in 1973, it was already fragmented and replaced by other public roads in the area Section 2 That the Recreation and Parks Committee has recommended that the landowner be required to dedicate an equestrian/pedestrian trail easement on the property when the vacation is finalized and to make a cash payment in an amount sufficient to construct the trail and appropriate signage. Section 3 For the forgoing reasons and based on the information and findings contained in the Staff Report, Minutes, and other records of the proceedings, which are attached hereto and made a part thereof by reference, the Planning Commission hereby forwards this matter to the City Council for further consideration with the finding that the proposed easement vacation of the portion of the Narbonne Avenue road right-of-way located between Sunnyside Ridge Road and Palos Verdes Drive East is consistent with the goals and policies of the City's General Plan PASSED, APPROVED and ADOPTED this 28th day of May 1996, by the following vote: AYES Commissioners Alberio, Cartwright, Franklin, Ng, Whiteneck and Chair Clark NOES None ABSTENTIONS Vice Chair Vannorsdall Lawrence E.
