A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING AN
EXISTING DECORATIVE BRICK TRACT ENTRY
MONUMENT WALL AND CONSTRUCTION OF A NEW
RETAINING WALL BEHIND THE BRICK WALL, WHICH
EACH EXCEED 30 INCHES IN HEIGHT WITHIN THE
INTERSECTION VISIBILITY TRIANGLE, ON PROPERTY
LOCATED AT THE REAR OF 30871 CASILINA DRIVE, ON
THE NORTHWEST CORNER OF PALOS VERDES DRIVE
EAST AND CASILINA DRIVE.
WHEREAS, On April 19, 1995, the City Council approved a Recycling Grant
Permit Application submitted by the Mira Catalina Homeowners Association (HOA) to
allow improvements to an existing 8 25 foot high (including the light fixture on top) tract
entry monument sign, located at the northwest corner of Palos Verdes Drive East and
Casilina Drive, which is in excess of 30 inches in height within the intersection visibility
triangle, and,
WHEREAS, he subject applications were submitted to the City on January 31,
1996 and were deemed complete for processing on March 1, 1996; and,
WHEREAS, pursuant to the provisions of the California Environmental Quality
Act, Public Resources Code Sections 2100 et seq ("CEQA" ), the State's CEQA
Guidelines, California Code of Regulation, Title 14, Section 15000 et. seq , the City's
Local CEQA Guidelines, and Government Code Section 65952 5(e) (Hazardous Waste
and Substances Statement), Staff found no evidence that Variance No. 405 would have
a significant effect on the environment Accordingly, the proposed project has been
deemed to be categorically exempt (Class 1), and,
WHEREAS, pursuant to the provisions of the Rancho Palos Verdes
Development Code, notice of the public hearing was mailed to all property owners
within 300 feet of the subject property on March 7, 1996, and,
WHEREAS, on March 26, 1996, the Planning Commission held a public hearing,
at which time all interested parties were given an opportunity to be heard and present
evidence
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES HEREBY FINDS, DETERMINES AND RESOLVES AS
FOLLOWS
Section 1 The subject property provides a highly visible location for
construction of the tract entry identification sign for the Mira Catalina development.
This is the only location, outside of the City's right-of-way, that the sign and monument
wall may be placed, while still providing appropriate identification of the tract's entry
For this reason, the Planning Commission finds that there are exceptional or
extraordinary circumstances or conditions applicable to the property involved, which do
not apply generally to other property in the same zoning district.
Section 2 That, since there are many similar tract entry monument signs
located throughout the City which exceed 30 inches in height within the intersection
visibility triangle, denial of this request would deny the property owners and the
Homeowners Association a right that is enjoyed by other developments in the City with
similar conditions
Section 3 The existing wall has been in its present location for over 23 years,
and the City has not received any complaints regarding its construction Additionally,
the location of the existing and proposed wall has been reviewed by the Department of
Public Works Staff, who have found that the wall will not significantly impair vehicular
or pedestrian visibility at this intersection Finally, the applicant will be required to
comply with all recommendations and requirements of the Division of Building and
Safety Therefore, the Planning Commission finds that the granting of the Variance will
not be materially detrimental to the public welfare or injurious to property and
improvements in the area.
Section 4 The granting of the Variance will not be contrary to the General
Plan since the subject property will continue to be used for single family residential
purposes In addition, it is the intent of the General Plan to provide for land uses which
will enhance the character of the community and supply appropriate facilities to serve
residents and visitors The maintenance of this tract entry monument and sign provides
an attractive entry, as well as identification, for the Mira Catalina neighborhood The
property is not located within the Coastal Zone, and is therefore not subject to the
policies and requirements of the Coastal Specific Plan
Section 5 That the time within which the judicial review of the decision
reflected in this Resolution, must be sought, if available, is governed by Section 1094 6
of the California Code of Civil Procedure

Section 6: For the foregoing reasons and based on the information and findings
included in the Staff Report, the minutes of the public hearing, and all other records of
the proceedings, the Planning Commission of Rancho Palos Verdes hereby approves
Variance No. 405 for the existing decorative brick tract entry monument wall and
construction of a new retaining wall behind the brick wall, which each exceed 30 inches
in height within the intersection visibility triangle, on property located at the rear of
30871 Casilina Drive, on the northwest corner of Palos Verdes Drive East and Casilina
Drive, subject to the conditions of approval contained in the attached Exhibit "A" which
are necessary to protect the public health, safety, and welfare.
PASSED, APPROVED, AND ADOPTED this 26th day of March 1996, by the
following roll call vote:

CONDITIONS OF APPROVAL
VARIANCE NO. 405
30871 CASILINA DRIVE
1 Within thirty (30) days, the landowner shall submit to the City a statement, in
writing, that they agree to all conditions contained in this approval Failure to
submit said statement shall render this approval null and void
2 The landowner and applicant shall comply with all recommendations and
requirements, if any, of the Division of Building and Safety
3 Approval of this permit is subject to the concurrent approval of Grading Permit No
1866 and Sign Permit No 795 by the Planning Commission
4 The maximum height of the retaining wall shall not exceed forty-two (42) inches
5 Construction of the project shall substantially conform to the approved plans
submitted to the City on January 31, 1996
