PC RES 1995-045P.C. RESOLUTION NO. 95-45 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES RECOMMENDING TO THE CITY COUNCIL APPROVAL OF AMENDMENTS TO CERTAIN CHAPTERS OF TITLE 16 AND 17 OF THE MUNICIPAL CODE a WHEREAS, in December 1991, after extensive formal and public review of comprehensive revisions to the City's Development Code (Titles 16 and 17), the City Council adopted all of the non -Title 17 revisions, and conceptually approved the proposed Title 17 revisions, with the exception of six specific unresolved sections, and, WHEREAS, due to the City Council's desire to establish residential design review standards as part of Title 17, the adoption of revised Title 17 was tabled until such standards/ procedures could be examined and proffered by a City Council/ Planning Commission Subcommittee However, due to unresolved issues with respect to the appropriate level of residential design control, the Subcommittee was disbanded in December 1992 and final adoption of revised Title 17, including the sections already conceptually approved, was postponed indefinitely, and, WHEREAS, in January 1994, the City Council directed Staff to re-initiate the Development Code Revision proceedings, and, WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Municipal Code, the Planning Commission and/or the Planning Commission Sub - Committee conducted a public hearing on December 14, 1993, February 8, 22, and 23, 1994; March 8, 22 and 23 1994, April 12, 26 and 28, 1994, May 10 and 24, 1994, June 14, and 28, 1994; August 9 and 16, 1994; September 13 and 27, 1994, November 9, 1994; December 13, 1994, January 24, 1995, February 14 and 28, 1995; March 14, 1995, April 25, 1995, July 11, 1995, September 12 and 26, 1995, October 10 and 24, 1995, at which time all interested parties were given an opportunity to be heard and present evidence regarding said amendments to Title 16 and 17 as set forth in the Planning Commission Staff Reports of those dates. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1 The Planning Commission has reviewed and considered the proposed amendments to the Title 16 and 17 chapters of the Municipal Code listed herein Section 2 The proposed amendments to the Title 16 and 17 chapters listed herein are consistent with California Government Code Section 65853, zoning amendment procedures Section 3 The proposed amendments to the Title 16 and 17 chapters listed herein are consistent with the Rancho Palos Verdes General Plan and Coastal Specific Plan in that they uphold, and do not hinder, the goals and policies of those plans; in particular the amendments seek to control and direct future growth towards making a positive contribution to all elements of the community. Section 4* The proposed amendments to the Title 16 and 17 chapters listed herein are consistent with the purposes and intent of Proposition M in that the revisions concerning the Proposition M language further the goals of Proposition and merely reorganize and clarify that portion of the Municipal Code. Section 5- The proposed amendments to the Title 16 and 17 chapters listed herein, insofar as they are substantially the same as previous provisions of the Rancho Palos Verdes Municipal Code, should be construed as a restatement and continuation of those previous provisions and not as new enactments Section 6• The amendments to the Title 16 and 17 chapters listed herein are necessary to preserve the public health, safety and welfare in the City. Section 7* For the foregoing reasons and based on the information and findings included in the Staff Reports, Minutes, and other records of the proceedings, the Planning Commission hereby recommends to the City Council approval of the amendments to twenty-one (21) chapters of Titles 16 and 17 of the Rancho Palos Verdes Municipal Code, listed below and attached hereto as Exhibit "A": Title No. 16 (Subdivisions Chapter 16.04 - General Provisions Chapter 16 16 - Tract Maps Chapter 16.20 - Dedications and Improvements Chapter 16 24 - Vesting Tentative Maps Chapter 16 32 - Reversions to Acreage and Mergers Title No. 17 (Zoning) Article 1 - Residential Districts Chapter 17.02 - Single Family Residential Districts Chapter 17 04 - Multi -Family Residential Districts Article II - Commercial Districts Chapter 17 12 - Commercial Districts Article V - Special Districts Chapter 17 40 - Overlay Control Districts Article VI - Use and Development Standards Chapter 17 48 - Lots, Setbacks, Open Space, and Building Area Chapter 17 50 - Parking and Loading Standards P.C.
