RESOLUTION NO. 95-23 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 176 REVISION "A" THEREBY APPROVING THE USE OF AN ADDITIONAL ROOM, GRASSY AREA, AND THE RECONVERSION OF A STORAGE AREA INTO FUNCTIONAL RESTROOMS FOR THE EXPANSION OF THE PALOS VERDES MONTESSORI SCHOOL AT THE LADERA LINDA COMMUNITY CENTER (32201 FORRESTAL DRIVE) WHEREAS, on April 12, 1995, the applicants, Mr and Mrs John Ernst, submitted Conditional Use Permit No 176 Revision "A", a request to use an additional room and a grassy area, and reconvert a storage area into functional bathrooms for the expansion of the existing Rancho Palos Verdes Montesson School, and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 2100 et seq ("CEQA"), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et. seq., the City's Local CEQA Guidelines, and Government Code Section 65952 5(e) (Hazardous Waste and Substances Statement), Staff found no evidence that Conditional Use Permit No 176 Revision "A" would have a significant effect on the environment. Accordingly, the proposed project has been found to be exempt (Section 15061 (3)), and, WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on June 13, 1995, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS Section 1: That the site for the intended use is adequate in size and shape to accommodate said use because the proposal to expand a private educational use on the subject site is very similar to the original use of the site and the other educational uses that have been previously permitted on the site The existing facilities are more than adequate to accommodate the expansion of the Montesson School. As a result of the significant reduction in the City's Recreation and Parks programs and the departure of Times Mirror/Dimension Cable, and Canyon Verde College, the Ladera Linda site is currently being utilized at a far less intensive level than when all of the other tenants and events were present The occupation of a small area of the site by the Montessori School will not disrupt or have any adverse effects on the existing active park, (including the City's office and Discovery Room), or any community meetings that are generally held at the site during evening hours (or weekends) In addition, the use of the Community Center by the Montessori School will not have an adverse effect on the site's parking accommodations for the same reasons mentioned above Section 2: That the traffic generated by the proposed expansion will not have an adverse impact on the two primary streets of access, Forrestal Drive and Palos Verdes Drive South, since the current uses on the site will generate significantly less traffic than when all of the previous uses occupied the site Section 3: That, in approving the subject uses at the specific location, there will be no significant adverse effect on adjacent property or the permitted use thereof, since the streets of access, (Palos Verdes Drive South and Forrestal Drive) are adequate to carry the traffic generated by the proposed school without creating significant congestion that would adversely effect the area residents entering and exiting their neighborhood. The classroom buildings are essentially shielded from adjacent residential communities by surrounding athletic fields and playground areas and it is not anticipated that the noise from classroom and other activities will be a nuisance to the surrounding areas since these activities would be conducted during regular daytime hours (7 30 a.m. to 5 30 p.m., Monday through Friday) As indicated in Section 2, there will be adequate parking on site to accommodate the minor expansion. Section 4: The current land use designation of Institutional (I) is reflected on both the City's General Plan Map and zoning map The City's General Plan (1975) identifies the Ladera Linda property as an institutional site and addresses the potential for future the expansion of the such facilities. The intent of this City planning document is reflected in the zoning requirements contained in Chapter 17.24 of the Development Code. Therefore, the subject site is designated for Institutional land uses and the proposed expansion of the Palos Verdes Montessori School is compatible with this designation. Section 5: That, in requiring the certain safeguards regarding the placement, design, and operation of the lights, the Planning Commission deems said requirements to be the minimum necessary to protect the health, safety and general welfare. The safeguards are listed as conditions of approval attached as Exhibit "A" of this P C Resolution. Section 6: The time within which the judicial review of the decision reflected in tlus Resolution, if available, must be sought is governed by Section 1094 6 of the California Code of Civil Procedure Section 7: For the foregoing reasons and based on the information and findings included in the Staff Report, and all other records of the proceedings, the Planning Commission hereby grants Conditional Use Permit No 176 Revision "A", thereby approving the use of an additional room and grassy area, and the reconversion of a storage area into functional restrooms, subject to the conditions contained in Exhibit "A", attached hereto and made a part hereof, which are necessary to preserve the public health, safety, and general welfare in the area. Any request for signage shall be reviewed and approved by the Director of Planning, Building, and Code Enforcement. 4) Within thirty (30) days of this approval, the applicants shall submit in writing, a statement that they have read, understand, and agree to all conditions of approval contained herein.
