A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING A FINAL NEGATIVE
DECLARATION FOR ENVIRONMENTAL ASSESSMENT NO. 661 IN
ASSOCIATION WITH TENTATIVE PARCEL MAP NO. 23912 FOR
THE SUBDIVISION OF A 33,853 SQUARE FOOT PARCEL INTO
TWO SINGLE FAMILY RESIDENTIAL LOTS ON THE PROPERTY
LOCATED AT 6324 VIA COLINITA.
WHEREAS, the applicant, Mr. Richard Ducharme, has requested
approval for Tentative Parcel Map No. 23912, Environmental
Assessment No. 661, Grading Permit No. 1727, and Grading Permit No.
1743 to allow for the division of a 33,853 square foot parcel into
two (2) lots, located at 6324 Via Colinita within the RS -3 (Single
Family Residential - Minimum lot size 13,000 square feet) zoning
district; and,
WHEREAS, pursuant to the provisions of the California
Environmental Quality Act, Public Resources Code Sections 21000 et.
seq. ("CEQA), the State CEQA Guidelines, the City's local CEQA
Guidelines, and Government Code Section 65952.5 (e), the City has
prepared an Initial Study and determined that there is no
substantial evidence that the approval of Tentative Parcel Map No.
23912 would result in potentially significant adverse effects on
the environment. Accordingly, a draft Negative Declaration was
prepared and notice of that fact was given by the manner required
by law; and,
WHEREAS, after notice issued pursuant to the provisions of the
Development Code and State CEQA Guidelines, the Planning Commission
held a public hearing on the project on June 14, 1994, September
13, 1994, and February 28, 1995, March 14, 1995, April 25, 1995,
May 23, 1995, and June 13, 1995, at which time all interested
parties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: The Planning Commission has reviewed and
considered the Initial Study and the proposed Negative Declaration,
and finds that the environmental documentation was prepared in
compliance with the requirements of CEQA, that the proposed project
as conditioned herein, would not create any significant adverse
effects to the adjacent properties or the permitted use thereof,
and that no potentially significant environmental effects would
occur as a result of the subdivision.
Section 2 : The time within which judicial review of the
decision reflected in this Resolution, if available, must be sought
is governed by Section 1094 . 6 of the California Code of Civil
Procedure.
Section 3 : For the foregoing reasons and based on minutes,
information and findings included in the Initial Study, Staff
Report, evidence presented at the public hearings, and records of
the proceedings, the Planning Commission of the City of Rancho
Palos Verdes hereby approves Final Negative Declaration for
Environmental Assessment No. 661 in conjunction with Tentative
Parcel Map No. 23912 for the subdivision of a 33 , 853 square foot
parcel into two single family residential lots at 6324 Via
Colinita.
PASSED, APPROVED AND ADOPTED this 13th day of June 1995 by the
following vote:
AYES: Commissioners Alberio, Ferraro, Wang, Whieneck, Chairman Mowids
NOES: Commissioner Vannorsdall
