A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
CONDITIONAL USE PERMIT NO. 188 THEREBY
APPROVING AN INCREASE IN THE OVERALL HEIGHT OF
BUILDING TO 21'-0" AT 28300 (SOUTH) WESTERN
AVENUE (COCO'S RESTAURANT)
WHEREAS, on March 30, 1995, Mr Jeffrey Clarke, representing Coco's Family Restaurants,
submitted an application for Conditional Use Permit No 188, a request to allow a new entryway to
exceed 16 feet in height to a maximum of 21'-0" in height, and,
WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public
Resources Code Sections 2100 et seq ("CEQA"), the State's CEQA Guidelines, California Code of
Regulation, Title 14, Section 15000 et seq , the City's Local CEQA Guidelines, and Government
Code Section 65952.5(e) (Hazardous Waste and Substances Statement), Staff found no evidence that
Conditional Use Permit No 188 would have a significant effect on the environment Accordingly,
the proposed project has been found to be categorically exempt (Class I), and,
WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes
Development Code, the Planning Commission held a duly noticed public hearing on May 23, 1995,
at which time all interested parties were given an opportunity to be heard and present evidence
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS
Section 1: That the proposed building height increase will not have an impact on the
adequacy of the size and shape of the site for the intended use or on any of the yards, setbacks, walls,
or fences, landscaping and other features required by this Title or by conditions imposed under this
section to adjust said use with those on abutting land and within the neighborhood since the proposed
project involves only the increase in the height of the building to accommodate the proposed new
entryway The use of this site is not being modified, only the exterior appearance of the structure is
proposed to be modified to be consistent with the company's "new image"
Section 2: The proposed building height increase would have no impacts on the traffic along
Western Avenue, the major street of access to the site The proposed 21 foot high entryway would
not increase the amount of the traffic generated by Coco's Restaurant or modify the circulation
patterns to and from the site
Section 3: That, in approving the subject increase in building height, there will be no
significant adverse effect on adjacent properties or the permitted uses thereof, since there are no
views present in the general direction of the subject property Due to the existing physical
configuration of the surrounding and subject properties, the proposed new entryway would not create
any view impairment or visual impacts from any of the site's surrounding uses
Section 4: The current land use designation for the subject lot on both the City's General
Plan Map and zoning map is Commercial The proposed building height increase will not alter the
existing (General Plan) compatible use on the site
Section 5: That, in requiring the certain safeguards regarding the placement, design, and
operation of the lights, the Planning Commission deems said requirements to be the minimum
necessary to protect the health, safety and general welfare The safeguards are listed as conditions
of approval attached as Exhibit "A" of this P C Resolution
Section 6: The time within which the judicial review of the decision reflected in this
Resolution, if available, must be sought is governed by Section 1094 6 of the California Code of Civil
Procedure
Section 7: For the foregoing reasons and based on the information and findings included in
the Staff Report, Minutes, and all other records of the proceedings, the Planning Commission hereby
grants Conditional Use Permit No 188, thereby approving the increase in building height for the new
entryway from 16-0" to 21'-0", subject to the conditions contained in Exhibit "A", attached hereto
and made a part hereof, which are necessary to preserve the public health, safety, and general welfare
in the area

CONDITIONS OF APPROVAL
FOR CONDITIONAL USE PERMIT NO 188
(28300 SOUTH WESTERN AVENUE)
1) The maximum height of the new open entryway shall not exceed a height of 21'-0
as measured from grade adjacent to the building.
2) The project shall adhere to all of the conditions of approval required in P C
Resolution N 95-18 for Variance No 393
