A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES FORWARDING A
FINDING TO THE CITY COUNCIL THAT THE PROPOSED
STREET VACATION OF THE ALLEYWAYS ADJACENT TO
BEACHVIEW DRIVE, SEACOVE DRIVE, AND NANTASKET
DRIVE IS CONSISTENT WITH THE GOALS AND
POLICIES OF THE GENERAL PLAN
WHEREAS, the applicant, Decron Management Corporation,
submitted a request to vacate three alleyways within the Porto
Palos Verdes Apartment complex which are adjacent to Beachview
Drive, Nantasket Drive and Seacove Drive; and, located within the
City; and,
WHEREAS, on December 6, 1994, the City Council allowed the
applicant to proceed with the request, following the Vacation
Procedures as established in Resolution No. 90-93 ; and,
WHEREAS, on March 22, 1995, the City's Traffic Committee
reviewed the applicant's request with respect to traffic and
circulation issues and recommended that the applicant be permitted
to continue with the Street Vacation process; and,
WHEREAS, pursuant to the provisions of the California
Environmental Quality Act, Public Resources Code Sections 2100 et.
seq. ("CEQA") , the State CEQA Guidelines, California Code of
Regulation, Title 14, Sections 15000 et. seq. , the City's Local
CEQA Guidelines, and Government Code Section 65952 .5 (e) (Hazardous
Waste and Substances Statement) ,. the City of Rancho Palos Verdes;
and, determined that the proposed project would not have a
significant impact on the environment and is categorically exempt
(Class I) ; and,
WHEREAS, after issuing notice pursuant to the requirements of
the City's Development Code, the Planning Commission of the City of
Rancho Palos Verdes held a public hearing on April 25, 1995, at
which time all interested parties were given an opportunity to be
heard and present evidence; and,
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES HEREBY FINDS, DETERMINES, AND RESOLVES AS FOLLOWS:
Section 1: That the road is truly a local road and is not
needed as thoroughfare in the collector and arterial road network.
The alleys with access to Beachview Drive and Nantasket Drive are
paved, and provide access only to the parking areas for the
apartment complex. The alley with access to Seacove Drive is a
landscaped (unpaved) and is not currently used for access, nor is

it required for future access. Therefore, the abandonment of the
alleyways will not impact traffic flow in the neighborhood, nor
interfere with the use of right-of way easements along Beachview
Drive, Seacove Drive or Nantasket Drive.
Section 2 : That the Public Works Department will impose
conditions of approval to guarantee the proper upkeep, including
frequency of repair, maintenance standards etc. , of the vacated
right-of-ways.
Section 3 : Dedication of non-vehicular easements for
utility purpose will also be imposed by the Public Works
Department, as necessary and appropriate.
Section 4: For the foregoing reasons and based on the
information and findings contained in the Staff Report, minutes,
and records of the proceedings, which are each attached hereto by
reference, the Planning Commission hereby forwards this matter for
further consideration by the City Council with the finding that the
requested Street Vacation is consistent with the goals and policies
of the City's General Plan.

by the following vote:
