PC RES 1995-010P.C. RESOLUTION NO. 95-10 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 183, THEREBY APPROVING THE INSTALLATION OF THREE (3) LIGHT STANDARDS THAT WILL MEASURE 28'-0" IN HEIGHT AT THE PALOS VERDES ART CENTER (5504 CRESTRIDGE ROAD) WHEREAS, on January 9, 1995, a representative of the Palos Verdes Art Center, submitted Conditional Use Permit No 183, a request to allow the installation of three (3) light standards that would be located along the west side of the parking lot and would measure 28'-0" in height, and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 2100 et seq ("CEQA"), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et seq , the City's Local CEQA Guidelines, and Government Code Section 65952 5(e) (Hazardous Waste and Substances Statement), Staff found no evidence that Conditional Use Permit No 183 would have a significant effect on the environment. Accordingly, the proposed project has been found to be categorically exempt (Class I), and, WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on March 28, 1995, at which time all interested parties were given an opportunity to be heard and present evidence NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS. Section 1: That the site for the intended use is adequate in size and shape to accommodate said use and for all of the yards, setbacks, walls, or fences, landscaping and other features required by this Title or by conditions imposed under this section to adjust said use with those on abutting land and within the neighborhood since the light standards would be placed adjacent to the landscaped area located between the parking lot and the west property line. There is adequate area available in this location to accommodate the standards without interfering with the parking configuration or traffic circulation pattern on the site Section 2: The proposed installation of the three light standards would have no impacts on the traffic that is generated by the Art Center's use of the site since purpose of the new lights is to increase safety and security for the existing events that currently take place during the evening hours. Section 3: That, in approving the subject use at the specific location, there will be no significant adverse effect on adjacent property or the permitted use thereof, since there is a difference in elevation of approximately 100 feet between the Art Center property and the lots in the Mesa Palos Verdes development along Mistridge Drive Looking down from the rear yards of these properties at 5549, 5561, and 5581 Mistndge Drive, it is apparent that since the light standards would be 70+ feet lower than the pad levels of the surveyed homes, the residents along Mistridge Drive would continue to enjoy the currently unimpaired views of the L.A Basin during the daytime without any interference from the proposed light standards With regards to the potential for glare, excessive brilliance, or visual disruption of the City lights view at night, the new lights would not significantly increase the ambient illumination in the area due to the existing illumination from the street lights at the intersection of Crenshaw Boulevard and Crestridge Road, as well as the Edison facility In addition, the light standards would be placed within a row of existing, mature trees along the property line The foliage, along with the design and shielding of the individual light fixtures, would mitigate any concerns regarding glare Section 4: The General Plan promotes the development of controls to preserve existing significant visual aspects from future disruption or degradation as well as preserving and enhancing positive visual elements (pg 192) Staff believes that the proposed installation of the three light standards would be consistent with the intent of these aforementioned policies. Section 5: That, in requiring the certain safeguards regarding the placement, design, and operation of the lights, the Planning Commission deems said requirements to be the minimum necessary to protect the health, safety and general welfare The safeguards are listed as conditions of approval attached as Exhibit "A" of this P C Resolution Section 6: The time within which the judicial review of the decision reflected in this Resolution, if available, must be sought is governed by Section 1094.6 of the California Code of Civil Procedure. Section 7: For the foregoing reasons and based on the information and findings included in the Staff Report, and all other records of the proceedings, the Planning Commission hereby grants Conditional Use Permit No 183, thereby approving the three (3) light standards along the west side of the property, subject to the conditions contained in Exhibit "A", attached hereto and made a part hereof, which are necessary to preserve the public health, safety, and general welfare in the area. AYES- Commissioners Alberio, Ferraro, Vannorsdall, Wang, Whiteneck, and Vice Chair Hayes, and CHairman Mowlds NOES- NONE ABSTENTIONS NONE FA Bret Y Benjard, ACCP Director of-Plannitig, Building, and Code Enforcement, and, Secretary to the Planning Commission PC Resolution No. 95-10 Page 3 of 4 00 - EXHIBIT "A" CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT NO 183 (5504 Crestridge Road) 1) The maximum height of the light standards shall not exceed 28'-0", as measured from adjacent grade. 2) The light standards shall be located on the site, as indicated on the plan date stamped as received by the City on January 9, 1995 3) The lights shall be directed down towards the parking lot at all times and shall be shielded appropriately in order to comply with this condition 4) The lights shall be turned off at 1200 midnight, each night of the week 5) The existing density of foliage shall be maintained along the west property line abutting the Edison facility. 6) Each high pressure sodium vapor light fixture shall not exceed 400 watts each 7) In the event that a Planning requirement and Building & Safety requirement are in conflict with one another, the stricter standard shall apply dsklVcuplUre 6 P C Resolution No 95-10 Page 4 of 4
