RESOLUTION NO. 94-55 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES FORWARDING A FINDING TO THE CITY COUNCIL THAT THE PROPOSED STREET VACATION OF PALO VISTA DRIVE AND SEACLIFF DRIVE IS CONSISTENT WITH THE GOALS AND POLICIES OF THE GENERAL PLAN VaffiREAS, the applicant, Palos Verdes Seacliff Hills Homeowners Association, submitted a request for the street vacation of Palos Vista Drive and Seacliff Drive on July 13, 1993; and, WHEREAS, on August 3, 1993, the City Council recommended that the applicant proceed with the request and to follow the Vacation procedures as established in Resolution No. 90-93; and, WHEREAS, on March 9, 1994, the City's Traffic Committee reviewed the applicant's request with respect to traffic and circulation issues and recommended that the applicant be permitted to continue with the Street Vacation process, and, WHEREAS, on December 6, 1994, after reviewing the title report and Traffic Committee recommendations, the City Council forwarded the request to the Planning Commission to review the propdsed street vacations for consistency with the City's General Plan; and, WHEREAS, on December 13, 1994, the Planning Commission conducted a noticed public hearing on the Street Vacation request, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS Section 1. That the road is truly a local road and is not needed as a thoroughfare in the collector and arterial road network Both Palo Vista Drive and Seacliff Drive are truly local roads in that they exist to serve as access to the homes in the immediate tract, only. As one enters the tract from Palos Verdes Drive South onto Seacliff Drive, there is no alternative to leave the tract other than to turn around and exit the development onto Palos Verdes Drive South again Seacliff Drive serves as access to only ten (10) lots while Palo Vista serves as access to 26 properties. It is Staffs opinion that the proposed street vacation will not interfere with the use of the right-of- way easement along Palos Verdes Drive South, nor would it interfere with the approved (Ocean Trails project) Class I and II bicycle/pedestrian trails along the landward side of Palos Verdes Drive South Section 2. That an assessment district or a C C.&R. district is established which will allow the district to levy taxes or legally enforceable assessments for road maintenance. In addressing the issue of the cost of future road maintenance for Palos Vista Drive and Seacliff Drive, the Homeowner's Association is already aware of the self imposed responsibility (via the privatization of the streets) for the upkeep and maintenance, physically and financially, of the subject streets. The Public Works Department would impose a condition relative to the legal assessment of fees/taxes. Section 3. That provisions will be made by the Public Works Department in the form of conditions of approval to guarantee the proper upkeep, including frequency of repair, maintenance standards, etc Section 4. Dedication of non -vehicular easements for utility purposes will also be imposed by the Public Works Department as a condition of approval. Section 5. For the foregoing reasons, and based on the evidence presented to the Planning Commission at the public hearing, including the Staff Reports and the oral and written testimony, the Planning Commission hereby forwards this matter for further consideration by the City Council, with the finding that the requested street vacations are consistent with the goals and objectives of the City's General Plan.
