RESOLUTION NO. 94-48 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING COASTAL PERMIT NO. 125 TO ALLOW THE RELOCATION OF THE EXISTING COASTAL SETBACK LINE SEAWARD, TO THE TOP OF THE BLUFF (APPROXIMATELY 40'-0" FROM THE REAR OF THE HOUSE) AT 16 SEACOVE DRIVE WHEREAS, the applicant, Mr. Greg Gawlick, has requested Coastal Permit No. 125, to allow the relocation of the existing Coastal Setback Line seaward from its current location to the top of the bluff, which is approximately 40'-0" from the rear of the existing residence, and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, (CEQA) and local CEQA guidelines, the proposed project has been found to be categorically exempt, and, WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a duly noticed public hearing was held on September 27, 1994, at which time all interested parties were given an opportunity to be heard and present evidence WHEREAS, the Planning Commission duly considered the current available geotechnical information provided by the applicant, that has been reviewed and confirmed by the City's Geotechnical Consultant; which supports the relocation of the Coastal Setback Line seaward, as requested NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS - Section 1: That the granting of the Coastal Permit is in conformance with the Coastal Specific Plan's policies for Subregion 4, since the potential residential activity, which would be possible with the relocation of the Coastal Setback Line, is the most compatible use for the area Section 2: That the proposed development is in conformance with applicable public access and recreation policies of the Coastal Act in that the relocation of the Coastal Setback Line will not have any impacts to public access easement that exists on the subject property.
