A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
CONDITIONAL USE PERMIT NO. 180, THEREBY APPROVING
A 200 SQUARE FOOT STORAGE SHED WITHIN THE CITY'S
LANDSLIDE MORATORIUM AREA AND AN OPEN SPACE
HAZARD (OH) ZONE AT 10 PEPPERTREE DRIVE
WHEREAS, the applicant, Mr. Stanley Clarke, has submitted Conditional Use Permit No
180, to maintain a 200 square foot storage structure within the City's Landslide Moratorium area and
an Open Space Hazard (OH) zone, and,
WHEREAS, pursuant to the provisions of the California Environmental Quality Act (CEQA)
and the local CEQA guidelines, the proposed project has been found to be Categorically Exempt; and,
WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes
Development Code, a duly noticed public hearing was held on August 23, 1944, at which time all
interested parties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS.
Section 1: That the site for the intended use is adequate in size and shape to accommodate
said use and for all of the yards, setbacks, walls, or fences, landscaping and other features required
by this Title or by conditions imposed under this section to adjust said use with those on abutting land
and within the neighborhood since the lot is of considerable size (37,000 sq ft )and the 200 square
foot temporary shed structure is insignificant in scale; the lot coverage for the lot would be an
inconsequential figure The shed satisfies all other Development Code standards for setbacks and
height, and the applicant has modified the exterior of the structure, as directed by the City Council,
such that it now represents a structure with a "rustic" theme, the Portuguese Bend Community
Association has approved of the applicant's modifications to the exterior of the structure (see attached
letter)
Section 2: That the proposed use, for recreational purposes, will have no impacts to
surrounding streets and highways.
Section 3: That, in approving the subject use at the specific location, there will be no
significant adverse effect on adjacent property or the permitted use thereof, since the subject storage
shed will be utilized for the maintenance of the applicant's horses The property is zoned with an
Equestrian Overlay designation which allows not only the applicant, but neighbors throughout all of
the Upper Portuguese Bend Club area, the ability to maintain horses on their properties, a use not
only allowed, but also commonly found throughout the area The applicant's request will not have
any impacts to the nearby community
Section 4: That the proposed use is not contrary to the General Plan since it recognizes the
Upper Portuguese Bend Club as a passive recreational area In approving the applicant's request, the
Commission would enable the applicant to further enjoy the recreational aspects of the property,
which is consistent with the General Plan
Section 5: That, in requiring the certain safeguards such as for setbacks, height, etc., the
Planning Commission deems said requirements to be the minimum necessary to protect the health,
safety and general welfare, and the safeguards are listed as conditions of approval attached as Exhibit
"A" of this P.0 Resolution
Section b: The time within which judicial review of the decision reflected in this Resolution,
if available, must be sought is governed by Section 1094 6 of the California Code of Civil Procedure
Section 7: For the foregoing reasons, and based on the information and findings included in
the Staff Report, and records of the proceedings, the Planning Commission hereby Approves
Conditional Use Permit No 180 for the existing 200 square foot shed structure at 910 Peppertree
Drive, subject to the conditions contained in Exhibit "A", attached hereto and made a part hereof,
which are necessary to preserve the public health, safety, and general welfare in the area
PASSED, APPROVED, AND ADOPTED this 23rd day of August 1994

CONDITIONS OF APPROVAL
FOR CONDITIONAL USE PERMIT NO 180
(10 PEPPERTREE DRIVE)
1) The maximum height of the shed shall not exceed 12'-0"
2) The shed shall be modified in substantial conformance to the plans stamped as received by the
City on June 6, 1994
3) The property shall be maintained free of any offensive odors related to the equestrian use of
the lot
4) The applicant shall routinely maintain the shed such that it does not become unsightly and
such that the materials and tools that are stored within the shed are kept out of sight
5) The applicant shall maintain appropriate recreational fencing for the horses.
6) There shall be no permanent parking or storage of any vehicles (including tractors) on, or
adjacent to the subject property
7) The shed shall be modified such that it incorporates a finish that will represent a "rustic"
building, so as to be consistent with the architectural style found throughout the area, and
comply with the City Council's previous direction
8) There shall be no excess use of water in conjunction with this project. Water shall be used
for maintenance of the horses and existing landscaping, only
