PC RES 1994-035RESOLUTION NO. 94 - 35 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING EXTREME SLOPE PERMIT NO. 38, THEREBY APPROVING A 322 SQUARE FOOT REAR YARD DECK AT 28813 BLYTHEWOOD DRIVE WHEREAS, the applicants Mr. and Mrs. Goetze have requested Extreme Slope Permit No. 38 to allow a 322 square foot deck which would cantilever a maximum of 41- 511 over an extreme slope; and, WHEREAS, on June 7, 1994, the applicants, Mr. and Mrs. Goetze submitted Extreme Slope Permit No. 38 to allow construction of a 322 square foot deck to cantilever a maximum of 41- 511 over the rear yard slope; and, WHEREAS, the Planning, Commission held a duly noticed public hearing on the project on August 9, 1994, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the site cannot reasonably acconiiodate the structure in another location not involving an extreme slope; and, although the front property could accommodate a deck, it is not a viewing area. Section 2: That the granting of an Extreme Slope Permit will not be materially detrimental to the public welfare or injurious to the area in which the property is located, since the proposed deck would not impair views or adversely impact the privacy of adjacent properties on both Blythewood Drive and Geronimo Drive. Section 3: That there would be no significant disturbance to the slope since the majority of the deck would cantilever 11-011 over the rear yard slope and a only a small portion of the deck (111-011 in length) would cantilever 41- 511 over the slope, the vertical support members would be screened with vegetation, and the grading for the footings at the toe of the slope would be minimal. Section 4: The Extreme Slope Permit is not contrary to the provision of the General Plan since the proposed deck would not alter the existing residential use of the site, and is in conformance with all land use control elements of the General Plan. Section 5: The time within which judicial review of the decision reflected in this resolution, if available, must be sought is governed by Section 1094.6 of the California Code of Civil procedure. Section 6: Based on the facts contained in this Resolution, in the Staff Report, Minutes, and other components of the legislative record, and in the public comments received, the Planning Commission of the City of Rancho Palos Verdes hereby approves Extreme Slope Permit No. 38, in conjunction with Grading Permit No. 1740, subject to the conditions of approval contained in P.C. Resolution 94 - for Grading Permit No. 1740, which are necessary to protect the public health, safety, and general welfare. PASSED APPROVED AND ADOPTED on this 9th day of At 1994.
