RESOLUTION NO. 94-33 A RESOLUTION OF THE PLANNING COMMISSION OF THE ,CITY OF RANCHO PALOS VERDES APPROVING COASTAL PERMIT NO. 123 FOR CONSTRUCTION OF A 244 SQUARE FOOT ADDITION TO ENCLOSE AN EXISTING COVERED PATIO AREA THAT ENCROACHES 4.25 FEET INTO THE REQUIRED REAR YARD SETBACK AREA WITHIN THE COASTAL SETBACK ZONE ON PROPERTY LOCATED AT 4181 MARITIME ROAD WHEREAS, on May 24, 1994 the applicant submitted Variance No. 376 and Coastal Permit No. 123 to the City, and on June 24, 1994 the applications were deemed complete for construction of a 244 square foot addition to enclose an existing covered patio area that encroaches 4.25 feet into the required rear yard setback area within the Coastal Setback Zone; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act (CEQA), and local CEQA guidelines, the proposed project has been found to be categorically exempt (Class III); and, WHEREAS, pursuant to the requirements of the City's Development Code, the Planning Commission of the City of Rancho Palos Verdes held a public hearing on July 26, 1994, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES HEREBY FINDS, DETERMINES, AND RESOLVES AS FOLLOWS: Section 1: That the proposed development is in conformance with the Coastal Specific Plan since the proposed construction will not increase the lot coverage or further reduce any required setback area. Additionally, the property will continue to be used for single family residential purposes. Since the owners will be required to comply with all requirements of the City Geologist and Division of Building and Safety, the project will not result in any adverse impact to the nearby bluff, coastline, or open space areas. Section 2: That the proposed development, which is located between the sea and the first public road, is in conformance with applicable public access and recreation policies of the Coastal Act, since the City's Coastal Specific Plan and Conceptual Trails Plan do not include a trail in or adjacent to the subject property. Section 3: The time within which judicial review of the decision reflected in this Resolution, if available, must be sought is governed by Section 1094.6 of the California Code of Civil Procedure. j7' 0 0 Section 4: For the foregoing reasons and based on the information and findings contained in the Staff Report and records of the proceedings, the Planning Commission hereby approves Coastal Permit No. 123 for construction of a 244 square foot addition to enclose an existing covered patio area that encroaches 4.25 feet into the required rear yard setback area within the coastal Setback Zone on property located at 4181 Maritime Road. PASSED, APPROVED, and ADOPTED this 26th day of July 1994.
