A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES DETERMINING THAT
THE PROPOSED VACATION OF A PORTION OF A PUBLIC
RIGHT-OF-WAY AT PALOS VERDES DRIVE EAST, EAST OF
4301 VIA FRASCATI, IS NOT CONTRARY TO THE GENERAL
PLAN
WHEREAS, the City of Rancho Palos Verdes Department of Public Works has received a
request to vacate a 600 square foot portion of the Palos Verdes Drive East nght-of-way easement
that is located immediately east of the property at 4301 Via Frascati; and,
WHEREAS, on May 3, 1994, the City Council referred the vacation request to the Planning
Conumssion for review of the request and its conformity with the City's General Plan, and,
WHEREAS, on June 28, 1994, the Planning Commission considered the vacation request, at
which time all interested parties were given an opportunity to speak and present evidence
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS
Section 1: That the vacation of a 600 square foot portion of the public right-of-way
easement shown as Exhibit "A" along Palos Verdes Drive East (immediately east of 4301 Via
Frascati) is not contrary to the provisions and policies of the General Plan, since the vacation will
not interfere with the use of the right-of-way easement for any trails identified in the General Plan
and Conceptual Trails Plan (Transportation Systems Element, page 137) and, the landowner
would be unable to take vehicular access from Palos Verdes Drive East due to the distance from
the street to the proposed vacation and the seventy of the transitional slope (Vehicular Network
Element, page 117), and,
Section 2: In exchange for the vacation of the 600 square feet street right-of-way easement,
the Planning Commission recommends that the City Council consider requiring some form of
monetary compensation from the applicant
Section 3: For the foregoing reasons and based on the information contained in the Staff
Report and records of proceedings, the Planning Commission recommends approval of the right-
of-way easement vacation request to the City Council
