RESOLUTION NO. 94 - 23
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING A NEGATIVE
DECLARATION IN ASSOCIATION WITH ENVIRONMENTAL
ASSESSMENT NO. 664 AND CONDITIONAL USE PERMIT NO.
92-REVISION "E", AND GRADING NO. 1733, THEREBY
ALLOWING A TWO STORY ADDITION TO BUILDING "C" AND
300 CUBIC YARDS OF GRADING WITH A MAXIMUM CUT DEPTH
OF 11'- 0" AT 30840 HAWTHORNE BOULEVARD.
WHEREAS, the Salvation Army submitted Environmental Assessment
No. 664 on April 13, 1994, to allow a two story addition to the
east and west elevations of Building "C" to a maximum height of
30'- 0"; and,
WHEREAS, pursuant to the provisions of the California
Environmental Quality Act, Public Resources Code Sections 21000 et.
seq. ("CEQA) , the State CEQA Guidelines, and the City's local CEQA
Guidelines, the. City has prepared an Initial Study and determined
that there should be no potentially significant effects on the
environment. Accordingly, a draft Negative Declaration was
prepared and notice of that fact was given by the manner required
by law; and,
WHEREAS, a Negative Declaration associated with Environmental
Assessment No. 664 was prepared in compliance with CEQA
requirements, and that the Planning Commission considered the
information and conclusions contained in said document prior to
taking action on this project; and,
WHEREAS, the Planning Commission held a duly noticed public
hearing on the project on May 24, 1994, at which time all
interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: The Planning Commission finds that the proposed
additions are specifically permitted in the Institutional Zoning
district, as defined in Section 17. 28. 020 of the City's Development
Code.
Section 2 : The Planning Commission ' has reviewed and
considered the Initial Study, the proposed Negative Declaration and
finds that the proposed project, as conditioned herein should not
create any significant adverse effects to the adjacent properties
or the permitted use thereof. The City has determined that no
potentially significant environmental effects should occur or as a
result of the proposed additions to the main administrative complex
(Building "C") .
Section 3 : For the foregoing reasons and based on
information and findings included in the Staff Report, and evidence
presented at the public hearings, the Planning Commission of the
City of Rancho Palos Verdes hereby adopts the proposed Negative
Declaration associated with Environmental Assessment No. 664, in
conjunction with Conditional Use Permit No. 92 - Revision "E" , and
Grading No. 1733, subject to the conditions of approval contained
in P.C. Resolution 94 - for Conditional Use Permit No. 92-Revision
"E", which are necessary to protect the public health, safety, and
general welfare.
Section 4 : The time within which judicial review of the
decision reflected in this Resolution, if available, must be sought
is governed by Section 1094. 6 of the California Code of Civil
Procedure.
PASSED, APPROVED AND ADOPTED this 24th day of May 1994.
