RESOLUTION NO. 94- 19 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 360 FOR CONSTRUCTION OF A 430 SQUARE FOOT SECOND STORY ADDITION LOCATED 12.5 FEET INTO THE REQUIRED FRONT YARD SETBACK AREA, AND 26.5 FEET IN HEIGHT ON PROPERTY LOCATED AT 6931 KINGS HARBOR DRIVE. WHEREAS, Vlasta and Zelkjo Zic have submitted an application for Variance No. 360 to allow construction of a 430 square foot second story addition to an existing structure which is located 7.5 feet into the required 20 foot front setback area, (12.5 feet from the front property line) and 26.5 feet in height (the Code maximum is 26 feet); and WHEREAS, on February 8, 1994, the Director of Planning, Building, and Code Enforcement conditionally Approved Height Variation No. 781 for construction of the second story addition, contingent upon subsequent approval of Variance No. 360 by the Planning Commission; and, WHEREAS, after notice issued pursuant to the provisions of the Development Code, the Planning Commission of the City of Rancho Palos Verdes held a public hearing on April 12 and May 24, 1994, at which time all interested parties were given an opportunity to be heard and present evidence; and, WHEREAS, after considering the plans as submitted, the Planning Commission, on April 12, 1994, directed the applicants to revise the plans and provide articulation along the front of the structure. Revised plans were submitted to the City on May 10, 1994, and were reviewed and considered by the Planning Commission on May 24, 1994. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That due to the unusual location of the existing structure within the required front setback, any second story addition to the existing structure would also be located within the required front setback. Additionally, extreme slopes located in the rear of the property limit the amount of buildable area on the property. These conditions result in exceptional or extraordinary circumstances, which do not apply generally to other property in the same zoning district. Section 2: Upon completion, the subject residence will be comparable in size to homes immediately surrounding it. Therefore, this Variance is necessary for the preservation and enjoyment of a home similar in size to those surrounding it, which right is possessed by other property owners under like conditions in the same zoning district. Section 3: The granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located since the proposed second story addition has been revised to provide articulation along the front facade of the structure, the addition has been designed so as to not significantly impair views from any surrounding property and is architecturally compatible with the existing residence and neighboring properties, and the landowners will be required to comply with all recommendations and requirements of the Division of Building and Safety. Section 4: The granting of the Variance will not be contrary to the objectives of the General Plan since the property will continue to be used for single family residential purposes. The property is not located in the Coastal Zone, and is therefore not subject to the policies or requirements of the Coastal Specific Plan. Section 5: For the foregoing reasons, and based on information and findings contained in the Staff Report, minutes, and records of the proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby grants Variance No. 360 for construction of a 430 square foot second story addition which encroaches 7.5 feet into the required 20 foot front setback area and which is 26.5 feet in height to match the existing ridgeline on property located at 6931 Kings Harbor Drive, subject to the conditions contained in the attached Exhibit "All which are necessary to protect the public health, safety, and welfare. Page 2 of 3 EXHIBIT "A" CONDITIONS OF APPROVAL VARIANCE NO. 360 6931 KINGS HARBOR DRIVE 1. Construction shall substantially conform to the plans revised stamped as received by the city on May 10, 1994. Any proposed modifications shall be subject to review and approval by the Director of Planning, Building, and Code Enforcement. 2. Portions of the new construction located within the required front setback shall not extend beyond the vertical plane of the existing structure below. The following minimum setbacks shall apply for the new construction: Front: 12.5 feet - CRITICAL - CERTIFICATION REQUIRED Side: 5 feet Rear: 15 feet 3. The maximum height of the new construction shall not exceed 26.5 feet to match the existing ridgeline. Height shall be measured from the highest grade covered by the structure, located at the southeast corner of the existing garage. CRITICAL - RIDGE CERTIFICATION REQUIRED. 4. No grading is permitted with this approval. 5. Prior to submittal of plans to the Division of Building and Safety for plan check, the landowners shall submit to the City a Covenant to Maintain Property to Protect Views. TS111 I REVAR360 PC P.C.
