PC RES 1994-0180 RESOLUTION NO. 94 -,18 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING GRADING PERMIT NO. 1485 -REVISION "A", IN CONJUNCTION WITH CONDITIONAL USE PERMIT NO. 92 -REVISION "D111, THEREBY ALLOWING 6,000 CUBIC YARDS OF ADDITIONAL GRADING AND RETAINING WALLS TO A MAXIMUM HEIGHT OF 26'-1" FOR CONSTRUCTION OF AN EDUCATION/ CONFERENCE CENTER AT 30840 HAWTHORNE BOULEVARD. WHEREAS, the Salvation Army received approval by the City Council on May 18, 1993, for Conditional Use Permit No. 92 -Revision "D" and Grading Permit No. 1485 to allow construction of an Education/Conference Center (hereon referred to as the ECC), consisting of conference/meeting room space and 55 guest units, and 106,000 cubic yards of associated grading to accommodate the ECC, on a 7 acre portion of the 42 -acre Salvation Army Western Territorial Headquarters facility; and WHEREAS, on March 3, 1994, the Salvation Army submitted Grading Permit No. 1485 -Revision "A" to allow 6,000 cubic yards of additional grading to facilitate construction of the ECC; a retaining wall for the auxiliary parking lot behind the Guest - Facility portion of the ECC with a maximum height of 26'-111; and new retaining walls on the east and west elevations of the ECC from 21- 7" to a maximum of 26'-1" in height. WHEREAS, the Planning Commission held a duly noticed public hearing on the project on May 10, 1994, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: In approving the revision to the project applications, the Planning Commission finds as follows: A. That the additional retaining walls and 6,000 cubic yards of additional grading necessary to develop the ECC and auxiliary parking lot behind the Guest Facility portion of the ECC will not change the overall height and mass of the ECC, as approved and conditioned through Conditional Use Permit No. 92 -Revision "D" and Grading No. 1485. B. That the proposed project, as conditioned herein would not create any significant adverse effects to the adjacent properties or the permitted use thereof. In accordance with Section 15168 of the State California Environmental Quality Act (CEQA) Guidelines, the City has determined that no new environmental effects could occur or new mitigation measures would be required as a result of the proposed revision to the grading plan of the ECC. Section 2: Pursuant to Section 17.50-070 of the Development Code, the City Council in approving Grading No. 1485 -Revision "All finds as follows: A. That the additional 6,000 cubic yards of grading for development of the ECC, is not excessive beyond that necessary for the permitted primary use of the property, since the grading will be balanced on site with no export of excavated material. B. That the grading and/or construction does not significantly adversely affect the visual relationships with, nor the views from, neighboring sites since the proposed grading will allow the proposed ECC to be set down into the existing slope which minimizes the visual impact and preserves view corridors from upslope residential properties and adjacent Pt. Vicente Park. . C. The additional grading to accommodate the ECC and the retaining walls located in the rear of the Guest Facility and on the east and west elevation of the ECC would be screened by a landscaped earthen berm and would not be visible from Palos Verdes Drive South. D. The nature of the grading minimizes disturbance to the natural features since no grading activity will occur in the extreme slope areas of the project site and the development of the ECC will substantially maintain the existing sloping topography of the site. Section 4: The time within which judicial review of the decision reflected in this resolution, if available, must be sought is governed by Section 1094.6 of the California Code of Civil procedure. Section 5: For the foregoing reasons and based on information and findings included in the Staff Report, and evidence presented at the public hearings, the Planning Commission of the City of Rancho Palos Verdes hereby approves Grading Permit No. 1485 -Revision "All, subject to the conditions of approval contained in the attached Exhibit "A", which are necessary to protect the public health, safety, and general welfare. All conditions of Conditional Use Permit No. 92 -Revision "D" and Grading No. 1485 shall remain in effect. 2. Condition No. C4 of Resolution No. 93-42 is hereby modified to read: Any additional grading or retaining walls over 3 feet in which exceed 3 feet in height that exceed the scope of this project shall require a subsequent grading permit approval by the Director of Planning, Building and Code Enforcement. a 3. Condition No. C1 (a) of Resolution No. 93-42 is hereby modified to read: a. 59,000 cubic yards of cut 29,000 cubic yards under the buildings 30,000 cubic yards outside the buildings _ 4. The maximum height of the retaining wall adjacent to the ECC shall be in accordance with the submitted plans labeled "S-1.2" and dated April 13, 1994, and shall conform to the following: Cross Section B: The maximum height of the retaining wall shall not exceed V-611 as measured from finished grade elevation 88.5' and shall not exceed 8'-0 as measured from finished elevation 951. The walls shall maintain a minimum distance of three feet between their closest points. Cross Section C: The maximum height of the retaining wall shall not exceed 51- 0" as measured from the lowest finished grade elevation 99.01 and shall not exceed 101- 0" as measured from finished elevation 103.01, The walls shall maintain a distance of three feet between their closest points. Cross Section D: The maximum height of the retaining wall shall not exceed 26'-6" as measured from the lowest finished grade elevation 99.91. Cross Section E: The maximum height of the retaining wall shall not exceed 191- 0" as measured from the lowest finished grade elevation 99.901. P.C. Resolution No. 94- 18 0 Page 4 of 5 • Cross Section F: The maximum height of the retaining wall 4110 shall not exceed 13'- 0" as measured from the lowest finished grade elevation 97.0' Cross Section G: The maximum height of the retaining wall shall not exceed 9'- 0" as measured from the lowest finished grade elevation 72.5' . Cross Section H: The maximum height of the retaining wall shall not exceed 9'- 0" as measured from finished grade elevation 80.0' and 3'- 10" as measured from grade elevation 76.2' . 5. The completed project shall substantially conform to the plans identified as and stamped as received by the Planning Division on March 3 , 1994. 6.
