RESOLUTION NO. 94-13 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 179 TO ALLOW THE PERIODIC PARKING OF A MOBILE DIAGNOSTIC IMAGING FACILITY AT 29000 SOUTH WESTERN AVENUE. WHEREAS, on April 2, 1990, the City Council approved Conditional Use Permit No. 146, and adopted an associated Negative Declaration for Environmental Assessment No. 576 to allow the periodic parking of mobile diagnostic imaging vans at 29000 South Western Avenue, for a period of one year, with extension privileges subject to the review and approval of the Director of Environmental Services (now known as the Director of Planning, Building, and Code Enforcement); and, WHEREAS, the applicant allowed the permit to expire on April 2, 1991, without requesting an extension from the Director of Planning, Building, and Code Enforcement; and, WHEREAS, new applications were filed (Conditional Use Permit No. 179, and Environmental Assessment No. 660) in November of 1993 for the project to allow the use to continue; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"'), the State CEQA Guidelines, and the City's Local CEQA Guidelines, the City prepared an Initial Study and determined that there was no substantial effect on the environment. Accordingly, a draft Negative Declaration was prepared and notice of that fact was given by the manner required by law; and, WHEREAS, a Negative Declaration associated with Environmental Assessment No. 660 was prepared in compliance with CEQA requirements, and that the Planning Commission adopted a Negative Declaration through P.C. Resolution No. 94- on April 26, 1994, and considered the information and conclusions contained in said document prior to taking action on this project; and, WHEREAS, a duly noticed public hearing was held before the Planning Commission at its regular meeting on April 26, 1994, at which time all interested parties were given the opportunity to be heard and present evidence and testimony; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the subject site is adequate in size and shape to accommodate the intended use, since the parking lot is to be used after hours only, and provides sufficient parking area (over 65 spaces) for the mobile diagnostic imaging trailer, as well as customer parking. Section 2: That access to the site is from Western Avenue, a major commercial thoroughfare, whose traffic capacity is adequate to serve the site without suffering significant impacts to its level of service. Section 3: That, in approving the subject use at the specific location, there will be no significant adverse effect on the adjacent properties from the proposed use due to the conditions of approval in the attached Exhibit "A," which require a specific location for the parking of the mobile diagnostic imaging trailer, which limit its hours of operation, and which limit the length of the permit life in a manner which grants the Director of Planning, Building and Code Enforcement the right to limit the length of the approval, if necessary. Section 4: That the granting of the Conditional Use Permit will not be contrary to the objectives of the General Plan since the proposed use is commercial, and the site is designated and zoned for commercial uses. Section 6: Based on the facts contained in this Resolution, in the Staff Report, Minutes, and other components of the legislative record, in the Initial Study, the Negative Declaration, and in the public comments received, the Planning Commission of the City of Rancho Palos Verdes hereby approves Conditional Use Permit No. 179, subject to conditions listed in Exhibit "A," attached hereto, which are deemed necessary to protect the public health, safety and general welfare in the area. The mobile diagnostic imaging trailer (hereafter "Facility") shall be parked parallel to and along the west side of the office building, between the office building and Western Avenue, and shall be in conformance with the site plan prepared by Courtney-Readick dated October 7, 1993. 2. The hours of operation for the Facility, including arrival to and departure from the site, shall be limited to the following: Monday -Friday 6:00 p.m. - 9:30 p.m. Saturday 8:00 a.m. - 8:00 p.m. 3. The truck engine shall not run while the truck is parked. 4. No additional signage relative to this operation shall be permitted on this site. 5. No independent power generation (including gasoline or diesel) shall be permitted. All power shall be by direct electrical connections with the Fidelity Federal Building through approved electrical connections. 6. The Conditional Use Permit shall be in effect for a period of only one year from the date of approval. The Director of Planning, Building, and Code Enforcement, at his or her discretion, may approve additional one year extensions, provided that the request is made prior to the expiration date. 7. The applicant and landowner shall file a statement, in writing, with the City within thirty (30) days of this approval, stating that they have read, understand, and consent to the conditions herein imposed on the project.
