P.C. RESOLUTION NO. 94- 12
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING A
NEGATIVE DECLARATION FOR ENVIRONMENTAL
ASSESSMENT NO. 660, ASSOCIATED WITH
CONDITIONAL USE PERMIT NO. 179, TO ALLOW THE
PERIODIC PARKING OF A MOBILE DIAGNOSTIC
IMAGING FACILITY AT 29000 SOUTH WESTERN
AVENUE.
WHEREAS, on April 2, 1990, the City Council approved
Conditional Use Permit No. 146, and adopted an associated
Negative Declaration for Environmental Assessment No. 576 to
allow the periodic parking of mobile diagnostic imaging vans at
29000 South Western Avenue, for a period of one year, with
extension privileges subject to the review and approval of the
Director of Environmental Services (now known as the Director of
Planning, Building, and Code Enforcement) ; and,
WHEREAS, the applicant allowed the permit to expire on April
2, 1991, without requesting an extension from the Director of
Planning, Building, and Code Enforcement; and,
WHEREAS, new applications were filed (Conditional Use Permit
No. 179, and Environmental Assessment No. 660) in November of
1993 to allow the use to continue; and,
WHEREAS, pursuant to the provisions of the California
Environmental Quality Act, Public Resources Code Sections 21000
et. seq. ("CEQA") , the State CEQA Guidelines, and the City's
Local CEQA Guidelines, the City prepared an Initial Study and
determined that there was no substantial effect on the
environment. Accordingly, a draft Negative Declaration was
prepared and notice of that fact was given by the manner required
by law; and,
WHEREAS, a duly noticed public hearing was held before the
Planning Commission at its regular meeting on April 26, 1994, at
which time all interested parties were given the opportunity to
be heard and present evidence and testimony.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS
FOLLOWS:
Section 1: That the project would not significantly
increase noise levels which would affect neighboring properties
due to the trailer's location along the Western Avenue frontage,
which results in an insignificant increase to existing ambient
noise levels, and also due to the limitation of hours of
operation.

Section 2: That the project will not produce significant
light and glare due to its proximity to street lighting on
Western Avenue, and due to the limited hours of operation.
Section 3 : That the project will not result in a
significant impact to transportation and/or circulation on the
site since there will be a very limited number of people
accessing the site, and this will occur after normal office
hours.
Section 4: That the location of the trailer along the
Western Avenue frontage will not create an aesthetically
offensive site open to the public view, in that the project is
located in a commercially-zoned parking lot adjacent to a major
thoroughfare, and is not considered to impair any scenic view.
Section 5: That, based on the Initial Study for
Environmental Assessment No. 660, which is incorporated herein by
reference, there will be no significant environmental impacts
resulting from this project, particularly with the implementation
of the Conditions of Approval in Exhibit "A, " which are contained
in P.C. Resolution No. 94- 13 approving Conditional Use Permit
No. 179, which are hereby incorporated by reference.
Section 6: Based on the facts contained in this Resolution,
in the Staff Report, Minutes, and other components of the
legislative record, in the draft Negative Declaration, and in the
public comments received, the Planning Commission of the City of
Rancho Palos Verdes hereby adopts the Negative Declaration
associated with Environmental Assessment No. 660 for Conditional
Use Permit No. 179, for the mobile diagnostic imaging facility at
29000 South Western Avenue.
PASSED, APPROVED, and ADOPTED this 26th day of April 1994.
