RESOLUTION NO. 93-42 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 365 FOR CONSTRUCTION OF AN 860 SQUARE FOOT SECOND STORY ADDITION LOCATED TEN FEET INTO THE REQUIRED FRONT YARD SETBACK AREA AND TEN FEET FROM THE FRONT PROPERTY LINE ON PROPERTY LOCATED AT 30676 PALOS VERDES DRIVE EAST WHEREAS, Dr. and Mrs. Claudewell Thomas have submitted an application for Variance No. 365 to allow construction of an 860 square foot second story addition to an existing structure which is located ten feet into the required front setback, and ten feet from the front property line; and, WHEREAS, on October 18, 1993, the Director of Planning, Building, and Code Enforcement conditionally Approved Height Variation No. 784 for construction of the second story addition, contingent upon subsequent approval of Variance No. 365 by the Planning Commission; and, WHEREAS, after notice issued pursuant to the provisions of the Development Code, the Planning Commission of the City of Rancho Palos Verdes held a public hearing on November 23, 1993, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That due to the unusual configuration of the property and location of the existing structure within the required front yard setback area, any second story addition to the existing structure would also be located within the required front setback. Therefore, this results in an exceptional or extraordinary circumstance applicable to the subject property, which does not apply generally to other properties in the same zoning district. "Section 2: Upon completion, the subject residence will be comparable in size to homes immediately surrounding it. Therefore, this Variance is necessary for the preservation and enjoyment of a home similar in size to those surrounding it, which right is possessed by other property owners under like conditions in the same zoning district. Section 3: The granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located since the proposed second story addition will not significantly impair views from any surrounding property and the landowner will be required to comply with all recommendations and requirements of the Division of Building and Safety. i i. Section 4: The granting of the Variance will not be contrary to the objectives of the General Plan since the property will continue to be used for single family residential purposes. The property is not located in the Coastal Zone, and is therefore not subject to the policies or requirements of the Coastal Specific Plan. Section 5: For the foregoing reasons, and based on information and findings contained in the Staff Report and records of the proceedings, the Planning commission of the City of Rancho Palos Verdes hereby grants Variance No. 365 for construction of an 860 square foot second story addition which encroaches ten feet into the required front setback and which is located ten feet from the front property line on property located at 30676 Palos Verdes Drive East, subject to the conditions contained in the attached Exhibit "All which are necessary to protect the public health, safety, and welfare. tBrnarl , AICP ecVor Pl nning, Code Enforcement the commission Building, and Secretary P.C. Resolution No. 93-42. Page 2 of 3 EXHIBIT "A" CONDITIONS OF APPROVAL VARIANCE NO. 365 30676 PALOS VERDES DRIVE EAST 1. The maximum height of the new construction shall not exceed 24.0 feet. The maximum ridge elevation shall not exceed 124.75 feet. Height shall be measured from elevation 100.75 located at the northernmost corner of the existing structure. CRITICAL - RIDGE CERTIFICATION REQUIRED. 2. Portions of the new construction located within the required front setback shall not extend beyond the vertical plane of the existing structure. The following minimum setbacks shall apply: Front - 10 feet; Side - 5 feet; Rear - 15 feet. CRITICAL - SETBACK CERTIFICATION REQUIRED. 3. No grading permitted with this approval. 4. Prior to submittal of plans to the Division of Building and Safety, the landowner shall submit to the City a Covenant to Maintain Property to Protect Views. 5. Construction shall substantially conform to the plans stamped as received by the City on August 5, 1993. Any proposed modifications shall be subject to review and approval by the Director of Planning, Building, and Code Enforcement. P.C. Resolution No 93-42. Page 3 of 3
