A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING AN
AMENDMENT TO COASTAL PERMIT NO. 77 FOR
REMEDIAL GRADING AT THE WESTERN BOUNDARY OF
THE PORTUGUESE BEND CLUB, ALONG YACHT HARBOR
DRIVE.
WHEREAS, on November 14, 1989, the Planning Commission
approved Coastal Permit No. 77 and Grading Application No. 1315 to
allow the Portuguese Bend Club Homeowners Association (PBCHOA) to
perform remedial grading at the western portion of the Portuguese
Bend Club along the exposed part of the toe of the Portuguese Bend
landslide, in order to protect several residences threatened by
earth movement and to ensure continued access to the area via Yacht
Harbor Drive; and,
WHEREAS, a duly noticed public hearing was held on November
12, 1991, at which time all interested parties were given the
opportunity to attend and present testimony, the Planning
Commission approved a request by the PBCHOA for a two-year
extension of the applications with modifications to allow an
increase in grading quantities from a maximum 10,000 cubic yards to
a maximum 27,000 cubic yards; and,
WHEREAS, on August 16, 1993, the PBCHOA submitted a request
for a two year extension of the Coastal Permit and Grading
Application, since the remedial grading had not been completed; and
WHEREAS, pursuant to a duly noticed public hearing on October
26, 1993, at which time all interested parties were given the
opportunity to be heard and present evidence, the Planning
Commission held a public hearing.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That the Planning Commission has previously
reviewed and approved, through P. C. Resolution 89-65, the
contents of Environmental Assessment No. 586 prior to taking action
on these applications, and a Negative Declaration was subsequently
issued for the project.
Section 2: That the proposed project is consistent with the
Coastal Specific Plan since:
a) the project is necessary to prevent earth movement
from causing the deterioration and destruction of
the coastal zone and coastal environment.
b) the project is necessary to prevent earth movement
from causing damage or destruction to at least four
single family residences within the Portuguese Bend
Club and Yacht Harbor Drive.
Section 3: That the proposed project is in conformance with
applicable public access and recreation policies of the Coastal Act
since the project involves excavation of earth at the exposed
portion of the toe of an active landslide where general public
access is not appropriate until the area is stabilized.
Furthermore, the project preserves shoreline access for residents
of the Portuguese Bend Club by ensuring the continuing
accessibility of Yacht Harbor Drive.
Section 4: That this approval is subject to the conditions of
approval for Grading Permit No. 1315 -Time Extension, which are
incorporated herein by reference and made a part hereof.
Section 5: For the foregoing reasons, and based on
information and findings contained in the public record, including
the Staff Reports, minutes, records of proceedings and evidence
presented at the public hearing, the Planning Commission of the
City of Rancho Palos Verdes hereby approves a two year time
extension for Coastal Permit No. 77, subject to the extension of
Grading Permit No. 1315.
