A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES RECOMMENDING TO
THE CITY COUNCIL APPROVAL OF GENERAL PLAN
AMENDMENT #21, TO ALLOW FOR THE ADDITION OF AN
AUTOMOTIVE SERVICE OVERLAY CONTROL DISTRICT TO
THE CITY'S GENERAL PLAN.
WHEREAS, eight service station sites currently exist in the
City of Rancho Palos Verdes. Four are located in Commercial zones;
three are located in Residential zones; and one is located in an
Institutional zone. Pursuant to the Development Code, service
stations within any Commercial zone require a Conditional Use
Permit, and those located within the Residential and Institutional
zones are currently non -conforming uses which may not make
significant expansions or improvements; and,
WHEREAS, it is the intent of the City to encourage the eight
existing service stations to remain in business and provide
necessary services to the citizens of Rancho Palos Verdes; and
therefore the City has initiated General Plan Amendment #21, Zone
Change #22, and Code Amendment #37 to amend land use and zoning
designations in order to allow the service stations to become legal
and conforming uses; and,
WHEREAS, duly noticed public hearings before the Planning
Commission of the City of Rancho Palos Verdes to consider the
proposed draft Negative Declaration associated with the project
were held on July 27, 1993 and August 24, 1993, at which time
public comments were received by the Planning commission; and
WHEREAS, on September 14, 1993, the Planning Commission
adopted P. C. Resolution No. 93-24 recommending approval to the
City Council of a Draft Negative Declaration associated with
Environmental Assessment No. 653, for amendments to the City's
General Plan and Municipal Code regarding land use and zoning
designations; and
WHEREAS, after notice pursuant to the provisions of the Rancho
Palos Verdes Municipal Code, and Government Code Section 65353,
public hearings were held before the Planning Commission on July
27, 1993, August 24, 1993, at which time all interested parties
were given an opportunity to be heard and present evidence
regarding the General Plan Amendment; and
WHEREAS, after notice pursuant to the provisions of the Rancho
Palos Verdes Municipal Code, the City Council further considered
the proposed amendments to the City's General Plan and Municipal
Code regarding land use and zoning designations on September 21,
1993 to provide further direction to Planning Commission; and

WHEREAS, after notice pursuant to the provisions of the Rancho
Palos Verdes Municipal Code, a public hearing was held before the
Planning Commission on October 12, 1993 to consider the Council's
recommendations of September 21, 1993, and to review proposed
changes to the City's General Plan (see attached Exhibit "All for
the text changes), as required by Section 65354 of the Government
Code, in order to implement amendments to the City's Municipal Code
for the changes in land use and zoning designations to allow for
automotive service uses.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: The Planning Commission finds that General Plan
Amendment #21 is consistent with the Rancho Palos Verdes General
Plan in that it upholds, and does not hinder, the goals and
policies of the General Plan, and further serves to carefully
control and direct future growth toward making a positive
contribution to all elements of the community.
Section 2: The Planning Commission further finds that the
amendments to Title 17 are necessary to preserve the public health,
safety, and general welfare in the area.
Section 3: For the foregoing reasons and based on the
information and findings included in the Staff Reports and records
of the proceedings, the Planning Commission hereby recommends to
the City Council approval of General Plan Amendment #21, making
certain amendments to the City's General Plan set forth in the
attached Exhibit "All to create an Automotive Service Overlay
Control District for the City.
PASSED, APPROVED AND ADOPTED this 12th day of Octobe 993.

1. Page 84: The paragraph entitled "Service Stations" shall be
modified as follows:
The number of service stations has decreased from ten in 1975
to s*xinez eight in 1993, which includes two sites on
Western Avenue, which were annexed into the City in 1983.
There is no longer an oversupply along crest Road or Palos
Verdes Drive South.
2. Page 196: The last paragraph on this page, which reads as
follows, shall be deleted:

This paragraph shall be replaced with the following language:
Over the course _of_the past twenty years, the community has
become accustomed to and deRendent on certain commercial
activities which are scattered throughout the City. The
location of these commercial uses are on corner lots along the
City's most predominant arterials or collector streets, and
the community has become accustomed to these uses. Due to the
length of time that these businesses have been in existence,
and the community's demand for them, it is preferable that
these sites should not revert to the surrounding land use, but
rather that the sites retain the flexibility to either
continue as their existing use or revert to the underlying
land use _as warranted by future economic and social
conditions.
3. Page 205: The following section shall be added:
Control Districts Applying to Automotive Service Uses
The Automotive Service Overlay Control District is established
to preserve existing commercial services which Rrovide
essential uses to the residents of the City.

The development criteria for such developments
shall require that adequate provisions be
incorporated into the design in order to reduce
negative impacts on adjoining residential areas.
The development criteria for such developments
shall create a balance between any negative impacts
associated with the development of the use against
the environmental, social, and aesthetic concerns
of the existing surrounding uses for each specific
site.
