A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES DENYING THE APPEAL OF HEIGHT
VARIATION NO. 765 THEREBY APPROVING A REVISED SECOND
STORY ADDITION TO A MAXIMUM HEIGHT OF 23'- 0", AT
6414 SEABRYN DRIVE.
WHEREAS, Mr. Cheng Hsiao has requested a Height
Variation to allow a 272 sq. ft. second story addition to the
existing residence at 6414 Seabryn Drive at the proposed
height of 23 '-0", as measured pursuant to Section 17. 02 . 040
of the Development Code; and,
WHEREAS, on April 15, 1993, the Acting Director of
Environmental Services approved the project, subject to
conditions of approval; and,
WHEREAS, Mr. and Mrs. Parsa, and Mr. and Mrs. Gerrie,
filed a written appeal on April 30, 1993, within 15 days of
the (then) Acting Director's decision, to the Planning
Commission; and,
WHEREAS, after notice issued pursuant to the
provisions of the Rancho Palos Verdes Development Code, a
public hearing was held on June 8, 1993 , August 10, 1993, and
September 28, 1993, which time all interested parties were
given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND
RESOLVE AS FOLLOWS:
Section 1: That pursuant to Section 17.02.040 of the
Development Code and the adopted Height Variation Guidelines,
the applicant has complied with the provisions set forth for
early neighborhood consultation, in that they discussed the
proposed project and obtained the signatures of 71% of the
neighbors within a 500 foot radius of the subject property.
Section 2 : That the applicant erected a temporary space
frame to represent the outline of the proposed addition; the
height and location of which was verified by Staff.
Section 3: That the structure does not significantly
impair a view or vista from public property (parks, major
thoroughfare, bikeway, walkway, equestrian trail etc. ) which
has been identified in the City's General Plan, Coastal
Specific Plan or City approved viewing area.

Section 4: That the proposed structure is not located on
a ridge or promontory.
Section 5: That no significant cumulative view
impairment would be caused by granting the application since
the majority of the residences on Seabryn Drive are existing
two story structures and similar second story additions would
not impair views from the surrounding properties.
Section 6: That the portion of the proposed structure
over 16 feet in height (to a revised maximum height of
23'-0") , when considered exclusive of foliage, does not
significantly impair a view from the primary viewing areas at
6408 Seabryn Drive, since the primary view is taken from the
rear of the residence facing south, and from 28926 Doverridge
Drive, and 28927 Doverridge Drive, since the overall height
of the project has been reduced by 2 feet and the addition
has been set back 10'- 0" from the front elevation of the
existing garage.
Section 7: That the scale, exterior finishes,
architectural style, roof design, and front yard setback of
the second story addition would be compatible with other
existing residences in the neighborhood.
Section 8: That the proposed project complies with all
other requirements of the Development Code.
Section 9: That pursuant to the provisions of the
California Environmental Quality Act, (CEQA) and the City's
local CEQA guidelines, the proposed project has been found
categorically exempt (Class III) , pursuant to Government Code
Section 15301.
Section 10: For the foregoing reasons, and based on the
information and findings included in the Staff Report,
minutes and evidence presented at the public hearing, the
Planning Commission of the City of Rancho Palos Verdes
hereby denies the appeal of Height Variation No. 765, thereby
approving the revised second story addition at 6414 Seabryn
Drive, subject to the conditions of approval attached in
Exhibit "A" , which are necessary to protect the public health
safety and welfare.

Conditions of Approval
Height Variation No. 765 - Appeal
6414 Seabryn Drive
1. The property owner shall submit a notarized covenant to
protect views to the Department of Planning, Building,
and Code Enforcement prior to submittal of plans for
building plan check.
2 . The following minimum setbacks shall be maintained for
the second story addition:
front yard: 20'- 0"
side yard: 5'- 0"
rear yard: 15'-0"
3 . In addition to condition b, above, the front facade of
the second story addison shall be setback a minimum of
10'- 0" from the front facade of the garage below.
4 . The maximum eave projections into any required setback
area shall not exceed 4" per each one foot of required
setback.
5. The maximum height of the residence shall not exceed a
height of 23'- 0" as measured from finished grade.
Ridgeheight Certification is required.
6. The lot shall maintain a minimum of 55% open space.
7. Skylights shall be flush mounted, and shall not exceed
6" above the roofing material.
8 . The tree located on the east side property line adjacent
to the front courtyard shall be removed , or trimmed to
16' in height and verified by the Planning, Building,
and Code Enforcement Department, prior to issuance of
building permits.
